Meeting opens at 5:36 PM.

Wayne made motion to accept minutes of January 12, 1012 seconded by Joe.  All in favor.

Case # 3061 – Fasolo – Requesting 6-month extension
Letter was read requesting 6-month extension for property on Goodwin St.
Motion made and seconded to Grant 6-month extension

A Special Permit from Section 5.2 and a Variance from Section 7.4 of the Zoning Ordinance to allow the modification of existing mill buildings for use as an Assisted Living Facility in a Business District with a maximum height of 56 feet and 4 stories (instead of 40’ maximum & 3 stories)                                                                                   
Request to continue until next month and waives the time frame on which to act on this proposal.

For: A Variance from Section 7.7 of the Zoning Ordinance to allow a 27’ x 52’ above ground pool having one foot rear setback (instead of 10 feet)

Mr. Kasanowsky explains he wishes to put an above-ground swimming pool in backyard but due to the house being set back so far from front they will be one foot from property line. But there is open space in back so no one will be affected.  He stated he wishes to put pool back further from deck for safety of his children.  He stated there are other pools in the cluster development and the association is aware of the request.  Wayne asked what is in back? Mr. Kasanowsky answers open space which will never be built on.  No one in favor or opposed. Letters from the B.O.H., Conservation Commission and City Planner were read into the record.

For a Variance from Section 6.3 and a Special Permit from Section 5.2 of the Zoning Ordinance for the reconfiguration of 2 pre-existing non-conforming lots & allowing a 2 family in an Urban Residential District resulting in Lot 1 - 12 Jackson Street a reduction of frontage from 83.5’ to 68 (100’ req’d.) and lot width of 64 ‘(instead of 100’) a reduction of lot area & dry area from 10,200 sq. ft. to 6,000 sq. ft.  (15,000 sq. ft. lot area & 11,250 sq. ft. of dry area) a sideline setback of 12 feet (instead of 15’) on the east side of the property; on Lot 2 the construction of a 2-family dwelling on a parcel having 13, 203 sq. ft. (instead of 15,000 sq. ft.) and a sideline setback of 9’ (instead of 15’) for decks in rear of bldg.

Atty. Gay stated that last month they continued to come up with new plans and meet with neighbors.   Atty. Gay gave background of petition for Wayne Berube so he can vote on this case.  The original petition was for a 3 family and they made presentation and continued so they could look at putting a duplex style (2 family) on lot which is what the neighbors would be in support of.   Wayne asked about the area behind he building. Atty. Gay pointed out there will be fences and walkways with landscaping along Washington Street.  The parking and access will be from Washington Street. Atty. Gay stated Lot 1 – 12 Jackson St. now has 68 feet of frontage and 6,000 square feet (bigger than previous proposal)    They also added 6 parking spaces (2 extra) and will install fencing along Maher property of which will taper off to not obstruct site distance.  On the west side they are proposing removal of the chain link fence and put 6 foot up.   Along Jackson Street the existing chain link fence dividing property will remain.   They are proposing a duplex style house and will have enclosed play area with gate at parking lot.  The proposed walkways will most likely be fieldstone or pebble stone. Atty. Gay stated the style house is like a raised ranch (2) put together.  28’ deep by 80 length.   It was asked how many bedrooms?  Atty. Gay stated two 3-bedrooms each, 2 story.  Chairman Ackerman said this is a much better plan.  Cary Crossman, 10 Jackson St. stated he approved new proposal.  Martin Powers, 19 Jackson St. stated he is not against proposal anymore. He also wanted to thank the Board and Atty. Gay for meeting with neighbors.  
No new department letters in the file.  

Motion to Grant as Presented based on adherence to the submitted application including the
Submitted plans and all bulk, size and intensity criteria contained therein (See paragraph 1 of this decision) and the following conditions:
  • Compliance with plans dated 2-6-12 submitted by petitioner showing a duplex style home (2 family dwelling – 3 bedrooms each) 28’ x 80 including fencing, landscaped area, parking, two 10’ x 10’ decks, etc.    
  • Lot 2 restricted to no more than 2 units, 3 bedrooms each.
