ZONING BOARD OF APPEALS

Members Present:  Chairman Ackerman, Berube, Medeiros, Amaral and Joyce.   
                               Enos present at 6:48 PM.
      
Meeting called to order at 6:47 PM.
Wayne made motion to accept minutes of April 9, 2009 meeting, seconded by Joe. All in favor.

For:  A Variance from Section 6.2 & 6.3 to allow the division of one lot into two lots. Lot 1A a conforming lot and Lot 1B having 20 feet of frontage & lot width (instead of 100 feet)

Paul stated the proposal is to create new lot in back for daughter and finance’ to live.  They are a young couple just starting out and this will give them the change to have new house and be close to parents.  There is a street along the property (Belmont Street) but it’s wet and cannot be developed.  It would also be very difficult to bring utilities down.   The new lot will be serviced by City Water & Sewer.  The lot only needs variance for frontage & lot width, it has over the required lot area.   Troy asked what kind of house were they thinking of?  Paul stated because it’s high water table so it possibly be a raised ranch.   The parents’ house in front is a raised ranch.  Troy asked if that would be compatible to the area and Paul answers yes.  No opposition. Paul submits petition signed by abutters in favor.  Letters from the City Planner, B.O.H., Fire Dept., Water Dept. and Conservation Commission were read into the record.

Hearing held on May 14, 2009

For:  A Special Permit from Section 5.3.4 to allow the alteration/extension of a pre-existing non-conforming lot by allowing the reduction of 9,381 sq. ft. (to be combined with 32 Liberty St.) from Lot 1 (28 Liberty St.) resulting in a 15,842 sq. ft. lot.

In favor:  Lisa LaBella, 5 Brookside Ave., E. Taunton, Ma.

Mr. Brown stated he and his neighbor are in mutual agreement to swap some land which would benefit both lots.  Troy asked if there would be any new construction?  Mr. Brown answers no this will affect the stone wall and driveway.  Wayne states it would even off the boundary lines?  Mr. Brown answers yes.  He will get half of his driveway back and the neighbor will get some property in the rear of his property.   In favor: Lisa LaBelle, stated she’s in favor of petition.  Letters from the City Planner, B.O.H., Fire Dept., Water Dept., and Conservation Commission.

OTHER BUSINESS:  

The Settlement – Letter from Malloch Construction requesting re-location of some of the affordable units.

Michael Malloch & Joseph Malloch spoke to Board about switching 3 of the affordable units from the main subdivision and re-locate them to Colt Circle which is the duplexes houses.   Michael stated due to the market they are not selling many houses and would like to at least get the affordable buyers in.  He also asked the Board to lift the 2 bedroom restriction on Colt Circle to allow the affordable buyers to get in quicker.  He stated all the affordable units in Phase 1 are completed.  They have 2 duplex which is 4 units sold on Colt Circle and 2 more units sold.  There are 10 units left on Colt Circle.  Michael stated if the Board determines that the proposed changes are minor they don’t’ need public hearing.  He stated even thought the number of bedrooms might change the footprint will not.  They are all 1,500 square foot houses.  Wayne asked if they are doing to this fulfill their obligation to build the affordable?  Mike answers yes they have to still build some but this will help.  Michael said the total number of houses in the subdivision is 99 and they are allowed to build a certain number of 4 bedrooms units. He is willing to exchange the number of 4 bedrooms and allow 3 bedrooms units to be built on Colt Circle.
The Board considers the proposed changes are a Minor Change.  

Wayne made motion to approve the proposed change to re-locate 3 of the affordable units to Colt Cirlcle and REMOVE 2 bedroom Restriction on Colt Circle and to allow a maximum of 3 bedrooms per unit in the entire subdivision with no more than 4 bedrooms homes allowed in any of the 99 units with the Exception of Lot 79 and Lot 81 is a MINOR CHANGE.  Seconded by Gill.
