Meeting called to order at 6:49PM
Peter made motion to accept minutes of February 12, 2009, seconded by Gill. All in favor.
Case # 2909 – Request for 6 – Month Extension – Variance granted April 24, 2009 –
Motion made and seconded to grant 6-month extension.

A Variance from Section 7.8 to allow a dwelling conversion of a 2-family dwelling to a 3-family dwelling having 7,276 sq. ft. (instead of 15,000 Sq. ft.) and having 5 spaces (instead of 6)
Petitioner requested a continuance until next month due to 4 members being present.

For: A Variance from Section 6.3 of the Zoning Ordinance to allow the construction of a single family dwelling on a lot having 25,000 sq. ft. (instead of 60,000 sq. ft.) and 24, 867 sq. ft. dry area (instead of 43,560 sq. ft.)
For the Petitioner: Richard Robidoux, 16 Priscilla Dr., Lakeville, Ma. 02347
In favor: None
Opposed: None
Mr. Robidoux stated he needs variance to be able to put house on a 25,000 sq. ft. The lot was purchased from the City of Taunton by a tax sale and he has an Agreement purchase it from the gentleman who purchased it from the City. He thought it was a buildable lot. Letters from the City Planner, Conservation Commission, Fire Dept., B.O.H., and Water Dept. were read into the record. Mr. Robidoux was aware of the dept. letters and will tie into city water. He stated he has a P&S to purchase subject to approval? He lives in Lakeville now on Long Pond and was thinking he may want to re-locate to this smaller house lot.

1. Lot must be serviced by Municipal Water.

For the Petitioner: Atty. P. Burke Fountain, 111 Dean St., Taunton, Ma.

Atty. Fountain states petitioner purchased the property 6 months ago from a foreclosure sale. It has been set up as a two-family for at least 60 years with two means of egress. The First floor has a 2 Bedroom apartment and the Second Floor has a 3BR apartment. There is plenty of room for parking. Atty. Fountain passed out pictures showing large yard. He stated this is the only single family in the whole neighborhood. Joe asked about the house has been used as a 2 family? Atty. Fountain answers yes probably the last 50 years. Peter stated he drove by and the yard is good sized. No one appearing in favor, No one appearing in opposition. Letters from the City Planner, Fire Dept., B.O.H., Conservation Commission were read into the record.

For: A Special Permit from Section 5.3.4 of the Zoning Ordinance to allow expansion of a pre-existing non-conforming structure.

Atty. Rounds stated petitioner is requesting a Special Permit to allow the construction of a 714 sq. ft. 2 story addition to an existing dwelling. The addition is going along the sideline which will not meet the 15 foot sideline but the addition will not go any closer to the property line. The addition is for extra living space and the direct neighbor, Pacheco, have no objection to the proposal. Chairman Ackerman asked about the 2 story addition and about the existing car port? John DeSousa, stated the carport will be coming down. No one appearing in favor or opposed to the petition. Letters from the Fire Dept., B.O.H., Conservation Commission, City Planner were read into the record. Peter asked about the parking and if they meet the requirement? Chairman Ackerman already asked the Secretary
and they do comply.
