Present: Joseph Amaral, George Moniz, Wayne Berube, Pete Wasylow, Mike Staples.
Meeting opens at 6:00 pm
Dennis Ackerman present at 6:23 pm.
Joe made motion to approve minutes of April 10, 2014 seconded by Pete. All in favor.
Wayne explains the ZBA process. The petitioner presents their case, then they hear from in favor and opposed and then the petitioner has chance to answers questions. We do not go back and forth.
Case #3224 Weir Redevelopment Co. LLC 336 Weir St.
A Special Permit from Section 5.2 of the Zoning Ordinance to allow the following uses in the Business District namely: ( Unit 5A – 3,985 sq. ft.) motorcycle inspection with retail sales, repair & office, (Unit 7 – 10,740 sq. ft.)- power washing business with truck storage & office. (Unit 7 – 2,850 sq. ft.) -motor vehicle restoration facility with motor vehicle repair and paint booth. ( Unit 3A – 7,100 sq. ft. ) general storage & warehouse facility with motor vehicle repair. ( Unit 2 – 13,350 sq. ft.) - motor vehicle retail sales with repairs, customization and paint booth.
For the Petitioner: Atty.William Rosa, Wynn & Wynn, 90 New State Highway, Raynham, Ma.

Atty. Rosa states this is the site of the former Haskon and the zoning was recently changed from Industrial to Business District. Atty. Rosa went over the various uses in each unit. Unit 5A will occupy 3,985 sq.ft. for motorcycle inspection and minor renovations and routine maintenance. All business will be inside.
Unit 3A will occupy 7,100 sq.ft. and will be a general warehouse with some personal items and vehicular repair of his own vehicles. Unit 2 will occupy 13,350 sq. ft. and will be customization of vehicles with all business inside and Unit 7 will occupy 10,740 sq.ft. for powerwashing which currently has 6 trucks. Unit 7A will occupy 2,850 sq. ft. and will have a painting booth for customizing for motor vehicle with repair. Atty. Rosa stated this approval will allow some new business in the City. Wayne asked how many employees for the powerwahsing business? Atty. Rosa answers 9 employees but most of the other business have 1-2 employees.
Joe recalls a previous case involving computer recycling company. Atty.Rosa stated he wasn’t involved in that. No one in favor or opposed. City Comments from City Planner, Conservation Commission, and City Engineer were red into the record.

Case #3223 Portuguese American Civic Club 175 School St.
A Special Permit from Section 5.3.4 of the Zoning Ordinance for a 14’6” x 40’ outdoor restroom building
For the Petitioner: John Arruda, Club Manager, 175 School St., Taunton, Ma.
In favor: None
Opposition: None
Mr.Arruda states they are proposing to construct an outdoor restroom building for the outdoor pavilion. They have a lot of meat on a stick and currently they either rent a port o potty or they have to use the restroom inside. They new building will be 14’ 6” x 40’ and it will be handicapped accessible. He stated they try to help out with neighbors and the only complaint has been about the port o potties. Wayne asked if it will be full building and he answers yes. No one in favor or opposed. Dept. letters from Conservation Commission, City Planner, Fire Dept. and City Engineer.

Case #3222 Menard 890 Middleboro Ave.
A Variance from Section 6.3 of the Zoning Ordinance for a 20’ x 22’8” addition having a 10.5’ side setback instead of 25 feet.
For the Petitioner: Mindy Menard, 890 Middleboro Avenue, E. Taunton, Ma.
In favor: None

Mrs. Menard states they are proposing an addition to the first floor to accommodate their disabled daughter. She needs to be on the first level due to her being in a wheelchair. Currently they must carry her upstairs. No one in favor opposed. She stated it’s only the corner of the addition that needs zoning relief. Dept. letters from Conservation Commission, City Planner, Fire Dept. and City Engineer. (it was noted the City Engineers letter was not relative to the proposed request)

Case #3225 CREF II Silver City LLC 2 Galleria Mall Dr.
A variance from Section 7.5.5, 7.5.6, 7.5.3.4 of the Zoning Ordinance for the replacement of the existing pylon sign. Proposal is 672 sq. ft. for the primary sign, a 672 sq.ft. electronic color message center and tenant panels equaling 3,216 sq.ft. at an overall height of 137’.
For the Petitioner: Atty. Edmund Brennan, One Church Green, Taunton, Ma.

Atty. Brennan handed out plan showing the proposal with a height of 137 feet. He stated the ZBA approved variance in 1991 and now they are wishing to enlarge that sign. He stated there will be major renovations to the mall which will cost over 6 million dollars with $780,000 for signage. Atty.Brennan stated the current sign has been inoperable at times. This new proposal will allow all the major anchor store to be on it. They are staying the same height of 137 feet. They know they will have to go to mass. Highway for approval due to the trees. They are aware of the LED restrictions and this will allow them to remain competitive. Board has any questions. Dennis asked if they would be displaying Amber Alerts and they answered yes they could. They currently have 700 sq.ft. of signage andnew proposal is for 3,200 sq. ft. The ideal height would be 160 feet. Dennis suggest it being higher than exiting because it will be better visibility. It was suggested continuing and re-advertise or new height but they wanted to have approval tonight. They will come back for new height. Dept. letters from City Planner, Conservation Commission, City Engineer and Fire Dept. were read into the record.

Case #3226 Anderson 1094 Bay St.
A Special Permit from Section 5.3.4 of the Zoning Ordinance for the construction of a 6’ x 7’ vestibule and 4’x 10’ set of stairs.
For the Petitioner: Rob Anderson, 38 Robert St., Taunton, Ma.
In favor: None
Opposition: None
Mr. Anderson is proposing to remove the 2nd set of stairs inside and replace with a vestibule to his restaurant, Home Plate. This will help keep heat and air condition inside. He is also adding as set of stairs to the side for access to basement. He stated the deliveries take about an hour which currently happens through the kitchen. The new side access will allow for food to be brought right inside to freezer. No one in favor or opposed.
Dept. letters from City Planner, Conservation Commission, City Engineer and Fire Dept. were read into the record. It was suggested to request that the Site Plan Review process be omitted.
