CITY OF TAUNTON
ZONING BOARD OF APPEALS
  MAY 14, 2015  – 6:00 pm.       
(held at Maxham School, 141 Oak St, Taunton, Ma.)

Members Present:  Wayne Berube, Steven Vieira, Michael Staples , George Moniz and  Steven Figueiredo.
  
Meeting opens at 6:02 PM   

Wayne made motion to accept minutes of April 9, 2015, as amended, seconded by George.  All  in favor.  

Clerk Vieira explained the ZBA process. He stated the petitioner presents their case, then they hear in favor and the opposition. They allow petitioner to address any of the opposition’s concerns. They do not go back and forth.  

    

Case #3271                       Lima                                North Walker St.(Prop.I.D.63-64)

For: A Variance from Section 6.2 & 6.3 for the division of one lot into two lots resulting in Lot 4B having zero feet of frontage & lot width (instead of 150’ frontage & 100’ of lot width)  

For the Petitioner:  Karen Patneaude, P.E., Earth Services Corp., 198 Crane Ave. So., Taunton, Ma.
                                
In favor:  None  

Opposed: Manuel DaFonte, 50 Rose Way,Taunton, Ma. had some questions.

Karen Patneaude, P.E. Earth Services Corp. stated the petitioner is requesting to divide one large piece and build house for himself and brother on each lot.  There will be acceptable and adequate access to back lot via a easement.  Steve asked what size is the driveway?  Karen answers about 20 feet wide. Mike asks of there would be emergency access?  Karen states there is a turnaround at end of driveway.   George stated the proposed driveway is very long.   Wayne stated there is 50 feet of access so there is flexibility to how wide they actually make driveway.  Karen stated petitioner owns 25 feet and she said there would be a hammerhead turnaround.  Mr.Lima stated it will either be recycled asphalt or stonedust.  Mr. Manuel DaFonte, 50 Rose Way had some questions about leaving tree buffer.  He lives in Fall Brook Fields subdivision and they have walking trail around subdivision.  Karen explained the background of the division of these lots.   Someday in the future the petitioner hopes to put subdivision on the remaining land and that would be closer to Fall Brook Fields subdivision.  Wayne stated according to the plans his property is over 500 feet away.  There will be no impact on his property from this request.    Mike asked if they could widen the turnaround to about 40 feet to accommodate emergency vehicles.   Letters from Conservation Commission, City Planner and Fire Dept.were read into the record.       

Motion made and seconded to grant with the following condition:
  • That the recorded copies of the access easements including maintenance and snow plowing responsibilities be provided to the ZBA Office prior to any building permits.
  •  Turnaround on Lot 4B shall be widened to 40 feet to accommodate for emergency vehicles

Vote: Vieira, Staples, Berube, Moniz, Figueiredo ........ …Yes

Case #3272                               Paiva                                                         85 Viking St.
For: A Variance from Section 6.3 to allow a 20x 26’ garage having a 6 foot side setback (instead of 25 feet)    

For the Petitioner: Greg Logan, Rep. Kathleen Paiva, 85 Viking St.,E. Taunton, Ma.
                              
In favor:  Joseph & Linda Marqus, 75 VikingSt.,E.Taunton, Ma.  

Opposed: None

 Greg Logan, contractor representing petitioner explained how the petitioner has lived here for 44 years.  She has 2 sheds for storage purposes and wants to build garage for storage.  They had to have land surveyed due to it age.   Greg explains how he cannot attach garage to house because of large stone in front. He points out if he could attach they would need variance.   The stone in front and the leaching field creates a hardship.   They spoke to direct abutters and they are in support, Joseph & Linda Marques.   Wayne asked if the existing shed is staying and Greg answers they will try to save it for her quilting materials.   She simply doesn’t have enough storage room.  No one opposed.  Dept. Letters from Conservation Commission, City Planner and Fire Dept.were read into the record.       

Motion made and seconded to grant as presented:

OTHER BUSINESS:


SUMMER  SCHEDULE –   July & August and re-schedule September meeting  
Discussion took place to combine summer meetings into one meeting.  Typically the Board takes August off.   Mike suggested just keeping the summer months as is due to deadlines.   

Wayne made motion to reschedule July meeting from July 9th  to July 16th. Seconded by George. All in favor.

Wayne made motion to keep August 13th.( can change if not needed) Seconded by George. All in favor.

Wayne made motion to re-schedule the September meeting from September 10th  to September 17th.  Seconded by George .All in favor.
