Roll Call:  Abreau, Campbell, Lopes, Medeiros, Spencer, Faulkner and Dermody.  Meeting opens at 5:30 P.M. Also present was City Engineer Mark Slusarz and City Planner Kevin Scanlon.     
  
Arthur made motion to approve minutes of February 3, 2011 seconded by Manny.  All in favor.
 
Public Hearing - Definitive Subdivision entitled “Roundtable Lane Extension -  located off the southeast end of Roundtable Lane, including 71 Roundtable Lane and 3 proposed lots.   Submitted by Richard Feodoroff.
Roll Call:  Faulkner, Medeiros, Spencer, Campbell, Abreau, Lopes and Dermody present.  Public hearing opens at 5: 30 PM   City Planner Kevin Scanlon read comments from B.O.H., Conservation Commission, Fire Dept., TMLP and himself which were placed on record.   
Arthur made motion to invite petitioner into the enclosure. Seconded by Tony.  All in favor.
Richard Feodoroff, developer and Brad Fitzgerald, P.E., Senna, Fitzgerald & Gilbert Assoc. were invite into the enclosure.    Mr. Feodoroff states he owns 6.1 acres of land at the end of Roundtable Lane which borders on the northeast by Route 24 and on the remaining sides by single family homes.   They could develop into 4 lots but would rather develop into 3 lots with waivers from the Planning Board.  They will be adding a cul-de-sac to the existing cul-de-sac. They could, under the Subdivision rule & regs. Build a 455 foot roadway and get 4 lots but they are proposing a 200 foot common driveway with a “T” at the end which would remain private and there would be a homeowner’s association.  They are also proposing a 25 foot no cut along the Sullivan property.  They will have city services but the trash would have to be brought down and the mailboxes will be at entrance.  Mr. Feodoroff stated no City services would have to go down the private driveway.  Chairman Dermody asked Mr. Feodoroff asked if he met with the neighbors?  He answers he met with Sullivan, Cabral, Foley and he is proposing land swamp with Folger.   Mr. Feodoroff there will be no further subdivision.  Manny asks about Lot 247?  Mr. Feodoroff stated that lot abuts Route 24 which has fencing along the highway.  Mr. Feodoroff stated there will be City Sewer by gravity and city water.  Brad Fitzgerald, P.E. explained there is an existing water main in Roundtable, an 8” diameter, cement lined ductile iron water main will be extended from the main to the end of the proposed road.  A fire hydrant will be installed at the end of the road.  Kevin asked about the 25 foot no cute along the Sullivan line. Kevin suggests deeding this over instead of an easement.  Bob stated that permanent markers get lost and it would be easier if they just deed over.   Bob suggested reducing the frontage so there won’t be any more division of property, like a form A in the future.  Brad asks if Bob is suggesting reducing the radius and Bob answers yes.   Bob stated they have ample room and they could reduce and still accommodate the “t” and hydrant.     Tony suggested making room for snow removal something like an area of 40 x 40. Brad stated they could do that and they are not cutting any more trees than they need to.   Bob asked about the water line? Brad stated they showed if off pavement.  
Manny made motion to open public input, seconded by Tony. All in favor.
The City Planner explains at this time the subdivision control law and what the Planning Board is obligated to do if they proposal meets all the rules & regs.  The alternative proposal if a 4 lot subdivision with a full road of which the Board will have to approve.  He state what they would like to do is a 3 lots with the least impact and that would require some waivers. So the Board has to decide if the 3 lot option is the preferred choice and least impact and grant the waivers.   In favor:  Bob Tartufo, 172 Williams St. stated he has 772’ feet that surround this and he spoke to Mr. Feodoroff and he informed us of what he wanted to do. He is in favor of private driveway 3 lots instead of 4 lots.   Opposed:  Tammy Serpa, 34 Roundtable Lane stated the pump station has failed twice in the 13 years she has lived there. She has all stuff in her basement ruined and now she has hired an attorney.  Tony asked Brad if they checked the pump station to see if it could accommodate 3 more houses.  Brad stated there will be less than 1,000 per days generated from these new house lots which is very minute and it wouldn’t upset the pump station.  Mr. Feodoroff stated they turned that pump station over to the over 15 years ago and now Veolia services it.   Arthur asked if it’s a stand by generation?  Mr. Feodoroff answers yes.  It was stated the alarm never went off?    Ms. Serpa stated that during the floods last year, sometime in April the alarm never went off.   Ms. Serpa stated that her hot water boiler and all the  stuff in her basement was ruined.   She stated her neighbors had issues to but they now has backflow protector.  She is getting one on Saturday.
Arthur made motion to send letter to Veolia requesting a copy of report, and the issues surrounding the failure of the pump station that services Roundtable Lane. Also what is the capacity and if there any minor improvements  that could be made to accommodate 3 more houses. Seconded by Bob.    
   
Manny stated these neighbors have legitimate concerns and we don’t want to add to future problem.   Opposed: David Cabral, 61 Roundtable Lane stated the sewer backed up 2005.  He is concerned with the noise level, losing open space, perhaps they should put wall or berm to act as sound barrier. He went to SRPEDD and read about the expansion of Rte 24. He asked why DOT was not notified because they are abutters (rte. 24)  The City Planner stated as part of the abutters notification process land owners are notified, according to the most recent tax list per the Assessor’s Office.    The City Planner state the Rte. 24 is a ROW.   Mr. Cabral stated the homeowner’s associations are short term and under the Subdivision Control Law the proposal has to meet all 5 major goals and in his opinion don’t meet 3 out of the 5.  Mr. Cabral asked if roads can close to highway?  Kevin answers, but just because he hasn’t seen it doesn’t mean they can’t.  Bob stated if they widen Rte. 24 this will not be the only problem they will have.     Dick asked if they have detention or retention basin?  Brad answers they don’t have either one.  They are not changing the flow.    The houses will have roof drains and they are not going to cause any problems with the flow.     Mr. Cabral stated that originally there were going to be 37 homes and they reduced it to 20, he refers to 1996 Planning Board minutes.  Mr. Feodoroff stated they has some wetland permits and they took what we could get that would be the least impact.  Opposed:  Leigh-Beth Clark, 45 Sir Joseph Ct., stated he and her husband have lived here for 14 years and the reason why bought house was because it was at the end of cul-de-sac. Her 2 children play in that ‘safe area” at the end of cul-de-sac.    This would be a huge invasion to the neighborhood and they would have more noise, construction vehicles.  Mr. Feodoroff stated he does tell the construction crew to slow down and he agrees during construction it would be a inconvenience.  Opposed?  Rob Sullivan, 34 Roundtable Lane, stated his lot has the detention basin on it.  Brad stated as long as the basin is maintained there shouldn’t be any flooding.  Rob wanted to know why they inherit the basin?  And whos is the proper owner?   The basin is the responsibility of the homeowner and there is easement for city in case they have to fix.  He wants some assurance that it works they way they say it should?    Mr. Feodoroff stated his Engineer can do calculations and make part of the record.     It was suggested putting swale in but not taking away from the snow area.  Brad stated the minimum slope of roadway matches high point is now.  Bob suggests re-design to bring peak to where it is now.  Opposed:  Cheryl Sullivan, 34 Roundtable Lane stated she knows Mr. Feodoroff and abutter in favor.  Both are well respected but she has concerns with noise, trash, mailboxes, detention basins dangers, and concerned with the water level.  That detention basins does not drain and what about snow removal?      Brad stated they are not changing the cul-de-sac?  She asked Mr. Feodoroff if he has purchased land yet? Mr. Feodoroff answers yes purchased it from the Terra family.   Tony asks Brad to look at drainage and look at subservice system?    Brad state no test pits were done.  It was asked how the condition of the road side swale was?  Ms. Sullvian says it’s beautiful and green, but doesn’t drain?   Opposed:  Leoanrd Hartwell, 64 Roundtablle Lane said the entire road is cracked and the swale drains very slow.  
The Board is keeping public input open for next meeting.
Alan made motion to continue this to April 7, 2011, seconded by Tony. All in favor.  Hearing closes at 6:55 PM.
