Roll Call: Faulkner, Dermody, Spencer, Abreau, Pimental, Lopes. Also present was City Planner Kevin Scanlon. Bob Campbell present at 5:31 PM. Meeting opens at 5:30 PM.
Arthur made motion to approve minutes of October 2, 2008, seconded by Manny. All in favor.
Cont’d. Public Hearing – Prospect Hill Preserve - 22 single family homes within a condo community on 42.2 acres o the west side of Prospect Hill Street, known as 366 Prospect Hill Street – submitted by Winterton Corp.
Request for continuance until next month, they are still working with Natural Heritage for approval of changes.
Dick made motion to grant continuance, seconded by Manny. All in favor.
Public Hearing – Zoning Map Amendment – for property located on E. Water Street – Proposal is to change from Industrial District to Urban Residential District. Submitted by Kevin Braga.
Hearing opens at 5:31 PM. Roll call: Spencer, Campbell, Pimental, Abreau, Lopes, Faulkner, and Dermody present. The City Planner went on record in favor of zoning change. Paul Patenaude, P.E. was invited into the enclosure. He stated he is representing Kevin Braga on the proposed zoning change. Mr. Patenaude showed the exiting zoning in the area and there are 13 homes that are subject to change. He stated 10 of the 13homes affected are in favor, the other 2 were unable to reach. Mr. Braga wants to construct a single family house and currently he would need a SP to put house in Industrial District. After looking at neighborhood and speaking with the City Planner they concluded they would change zoning to Urban Residential. It made sense to change whole
strip after speaking with the City Planner. Arthur asked if this affected the Board Club? Mr. Patenaude stated they are in favor. Dave stated several years ago there was a new house constructed down there. Paul stated that was Mark Braga and there was a Roadway Improvement Plan done. In favor: Jack Pillsbury, owns 139 E.Water Street, he stated it makes sense to change from Industrial to residential and it will allow local people to live next to family. No Opposition.
Tony made motion to close public input, seconded by Manny. All in favor.
Bob suggested having the park in the OSC district. Kevin agreed with that.
Bob made motion to change from Industrial to Urban, and change Weir Riverfront Park (Property I.D. 92-270 thru 920279) to Open Space Conservation. Seconded by Manny. All in favor. Hearing closes at 5:39 PM

Cont’d. Preservation Drive - E-5 Circulated – completion of subdivision
Letter s from the Fire Dept., Water Dept., Conservation Commission, and City Engineer were read into the record and placed on file. Atty. David Gay was invited into the enclosure. He stated there were 2 additional bounds that the City Engineer wanted on plans and that has been done.
Arthur made motion to find the subdivision to be complete, recommend approval of street approval, and release all monies after Municipal Council action on street acceptance. Seconded by Tony. All in favor.
Special Permit/Site Plan Review – 14 Granite St., - to allow an existing 4 -family home, submitted by Louis Borges – Need to forward a recommendation to Municipal Council.
Kevin stated the Board needs to forward a recommendation to Municipal Council. Atty. Brian Hughes was invited into the enclosure. The property has been owned by Louis Borges for many years and it was been used as a 4-family for some time. They have been thru the DIRB process and now will have public hearing with Municipal Council. There will be no changes just legalizes what has been in existence for many years.
Manny made motion to forward a positive recommendation to the Municipal Council, seconded by Tony. All in favor.
River’s Edge – E-5 Circulated – Release of All Surety & completion. Holding Lot 14 & $92,000) located off Worcester St.
Letters from the City Engineer, Fire Dept., B.O.H., Conservation Commission, City Planner were read into the record and placed on file. Holding Lot 14 and $92,000. Steven Case was invited into the enclosure. He stated he received notice from the City Engineer everything is ok with As-Built. Kevin stated the Board can take vote contingent on his approving As-/Builts.
Bob made motion to find the subdivision to be complete, release all surety upon City Engineer’s approval of As-Builts and Municipal Council action on street acceptance, and forward a positive recommendation for street acceptance. Seconded by Dick. All in favor.
Ciera Circle Subdivision – E-5 Circulated – release of all surety (Holding $11,000 and one lot) located off Dighton Ave.
Joe Malloch was invited into the enclosure. Mr. Malloch stated the City Engineer approved as-built. Kevin stated they could vote contingent on his approval.
Bob made motion to find the subdivision to be complete, release all surety upon City Engineer’s approval of As-Built Plan and Municipal Council action on street acceptance, and forward a positive recommendation to Council for street acceptance. Seconded by Manny.
Proposed Zoning changes – submitted by the City Planner – need to refer to public hearing process
City Planner Kevin Scanlon explained to the Board these changes are to be forwared to the public hearing process which means the Municipal Council & Planning Board needs to hold public hearings. He asked the Board if they had any questions as these proposed changes were sent out earlier for review.
Tony asked about storage containers that are appearing in everyone’s yard? Kevin stated he has made provisions for that. Dave commented on some of those “container” storage units are big. Kevin stated they are subject to setbacks and they need to get permits. Tony asked about solar panels? Kevin stated he put them in there and windmills also. It was asked about outside boilers? Kevin said they are subject to DPE and B.O.H. approval.
Bob made motion to refer to the public hearing process, seconded by Manny. All in favor.
