Minutes of the Taunton Conservation Commission May 12, 2014

Motion to approve the minutes of February, March, and April meetings, DB, second MI, so voted. RC voted present for April.
Certificate of Compliance
1. 447 Broadway, Matos, (COC), SE73-2533 Field report states that this project was for a septic system repair with associated grading and paving at the above address. All work has been completed in significant compliance to the order of conditions issued on March 4, 2013. MR recommends that the TCC issue a COC for this project. Motion to approve, NK, second RC, so voted.
2. 18 Marvel Street, Lofgren, (COC), SE73-2523 Field report states that this filing was for the razing of an existing garage and the construction of a new, two car garage, with associated site work. All work has been completed in significant compliance to the order of conditions issued on November 7, 2012. MR recommends that the TCC issue a COC for this filing. RC is grass growing? MR yes. Motion to approve, RC, second NK, so voted.
Amendment
1. 700 Joseph Warner Blvd., St.-Gobian Performance Plastics Corp., (Amendment) SE73-2558 Field report states that the applicant has revised the parking expansion by reducing the number of spaces by 20 for a total of 78 parking spaces rather than the proposed 98 spots. The reduction in parking is all in the front of the building. The additional driveway onto Joseph Warner Boulevard to the south side of the property was also eliminated. The Stormwater management system has also been revised. The plan calls for a smaller system to include sediment forebays, a water quality swale, and an infiltration basin. As a result of the reduction of parking, elimination of the additional driveway, and reduced storm water system, there will be a reduction of additional impervious surface by
9,732 square feet. All work will be further from the wetland (45 feet rather than the previous 17 feet) and there will be no disturbance to the woods as previously required for the expansion. All other work as previously proposed remains the same. The decrease in the scope of the project will have fewer impacts on the surrounding wetlands and natural areas. MR recommends that the TCC approve this project modification and issue an amended order of conditions to include the previously approved general and special conditions. Public Meeting
1. 144 Hart Street, Canterbury Village Condominium Trust, Lorell Management, (RDA), DSE-1071 Bob Rogers Tibbetts Engineering. Field report states that this filing is for work involving the removal of existing cantilevered exterior decks and replacement with post supported decks of the same size on two of the three condo units that are within 100 feet of a BVW. The wetland was delineated by Michele Grenier on March 18, 2014. Blue flags were hung, series #1 through #15. MR reviewed the line and agrees with the placement of the flags. The plan depicts a siltation barrier along the northwest sides of both condos and should be considered the limit of work. The work on the decks will fall within 56 feet at the closest point of condo #2 and as far as 81 feet for condo #3.
Work will be done by hand. There will be no grading and all disturbed areas will be returned to their original state. The work as presented should not negatively impact the adjacent wetlands. MR recommends that the TCC approve the delineation, flags WF#4 to WF#15, with WF#1 to WF#3 for reference purposes only, and approve the project and issue a negative determination to include the attached special conditions. As part of the special conditions, MR recommends that the Applicant repair the concrete culvert that goes from the detention basin to the wetlands at flag WF#10. In addition, the basin needs to be cleared of debris so that it can funcition as originally designed. RC asked only work is removing and replacing decks? Bob Rogers stated yes and siding. RC asked no re-grading? No. RC asked what about the outlet? MR said it’s concrete and broken, not really functioning. Once cleared MR was able to see the
pipe and its not in good shape. Previous owner did nothing with it. MR there wasn’t an order of conditions on it but is now. RC asked that straw wattles be placed 5 feet along wetlands line along perimeter of detention basin that abuts the wetlands. Motion to issue a negative determination with special conditions 1, 2, 3, 4, 14, 15, 18, 19, 20, 21, 22, 23, 28-maintenance plan for MR to review for detention basin maintenance, 29-siltation barrier placed adjacent to flags 6, 7, 8, 9, 10, and 11, RC, second NK, so voted. Motion to close, DB, second MI, so voted.
2. Tremont Street (Various), Columbia Gas of MA, (RDA), DSE-1072 Field report states that this filing is for the replacement of a gas main in portions of Tremont Street, Monaddnock Avenue, Cleveland Road, Anawan Street, Oakland Avenue, and Shores Street. Portions of this project fall within the 100 foot buffer zone to a BVWs and the 200 foot Riverfront Area of a perennial stream (Cobb Brook). All work will be within the existing paved roadway and/or the edge of roadway, and there will be no work within the resource areas themselves. The resource areas were delineated by Environmental Consulting & Restoration, LLC on March 25, 2014. The flags as follows:
-A1 to A6 and A100-A102 are located in the west side of Tremont Street south of Downing Drive;
-E1 to E5 is on the east side of Tremont Street between #179 and #171;
-F1 to F3 is on the west side of Tremont Street between #176 and #174;
-Cobb Brook crosses under Tremont Street at #125 (north side) and #124 (south side) and is flagged at the culvert on the north by flag IB-BVW and by series IB200-IB204 and the BVW by D1-D5 on the south side;
-On Shores Street, Cobb Brook and a BVW are delineated between 59 Clifford Street and 101 Shores Street on the north side-flags IB200-IB202 and IB100-IB102 (Cobb Brook) and C1-C6 (BVW), and on the south side at #110 Shores Street by flags IB1-IBIB4 (Cobb Brook) and B1-B6 (BVW). The work will involve digging a 2-3 foot wide by 4 foot deep trench and will be limited to what can be laid and completed within one day. Upon completion of the job, all temporary pavement will be removed and permanent paving will be laid. All non pavement areas will be replaced in kind. No work will occur within resource areas. Straw wattles will be installed prior to work within the buffer zones of the BVW and Riverfront Areas. There will be no permanent changes to surfaces and all work areas will be
restored to their original elevations and conditions. No work will be conducted along resource areas during rain conditions. Catch basins will be protected and there will be no overnight stockpiling within buffer zones. All unused spoils will be removed and disposed of according to all applicable laws. The work as proposed will not negatively impact the resource areas, therefore MR recommends that the TCC approve the wetland delineation as described above for reference purposes only, and issue a negative determination to include the attached special conditions. Motion to open, DB, second RC, so voted. Brad Holmes present from Environment Consulting.
DB asked if street will be put back properly so it wont sink or puddle there? Yes Holmes said they will follow DPW protocol. RC new or replacement? New gas lines. RC asked if siltation barrier was up to contractor? Holmes said that is why they file an RDA so they will know after meeting with TCC where they need to be placed. MR said they can call her each day and she will go out and check the siltation barrier. ST asked how long it will last? 80-300 feet per day, but it depends on what they find there. RC silt sacs in all the catch basins in the roadway, MR said it was in specs but he wants it in the conditions. ST asked when they would be starting? ASAP, they will notify TCC when it begins. Motion to issue a negative determination with special
conditions 1, 2, 3, 4, 5, 6, 7, 8, 14, 18, 19, 20, 21, RC, second DB, so voted.
3. 580 Winthrop Street, Manheim New England, (RDA), DSE-1073 Field report states that this filing is for the installation of approximately 3,200 linear feet of new sewer line in order to connect the existing facility to a recently installed municipal sewer main located on Winthrop Street. The wetlands were approved and an ORAD was issued on April 6, 2012 under DEP file SE73-2493. All work will occur within paved areas of the roadway and parking areas. These areas are relatively flat, and the roadway work will be at least 60 feet from the BVW (flag WF19 is the closest point) with vegetated areas on both sides of the driveway. Silt sacks will be installed in the existing catch basins and if dewatering is required during trench work, a Dirt Bag sediment trap will be used (detail on
page 6 of 6). Because of the distance from the BVW and flatness of the roadway, it should not be necessary to install siltation controls along the edge of the driveway. A tight tank for the carwash and one for the body shop, as well as the leaching field located between the two front buildings, will be abandoned in place per Board of Health regulations 310 CMR 15.354(3). Work within this vicinity will be 38 feet from the adjacent BVW at the closest point and straw wattles will be installed prior to abandonment. The work as presented should not negatively impact the adjacent BVWs, therefore MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions. Bob Rogers present from Tibbetts Engineering. Motion to issue a negative determination with special conditions 1, 2, 3, 5, 6, 7, 8, 14, 18, 19, RC, second NK, so voted.
4. 28 Pineview Terrace, Connerton & Byington, (RDA), DSE-1074 Field Report states that this filing is for the removal of ten dead and/or dangerous trees on property abutting Lake Sabbatia. The applicant plans to have the trees cut down by hand (or by climbing) and not by truck. The stumps will remain in the ground. Four of the trees are at the edge of the lake and are dead or dying, and leaning dangerously. The two trees off property are leaning precariously and the applicant has the permission of the owner to cut them down. The trees in the middle of the property are tall and diseased and are leaning toward the cottage. The work as presented should not negatively impact the lake, therefore MR recommends that the TCC approve the project and issue a negative
determination to include the attached special conditions. Motion to open, DB, second MI, so voted. Father Byington present. Letter from owner of other property read into record-”As the owner of the property which abuts the property of Msgr. Connetong and Fr. Byington I am aware of their intent to remove several trees from their property. I hereby assent to such removal and furthermore I grant them permission to remove trees from my property as well.” Katherine Richards 24 Pineview Terrace. 5. 109 Powderhorn Drive, White, (RDA), DSE-1075 Field report states that this filing is for a septic system repair with associated grading at the above address. There is a BVW off-property to the east (behind). This BVW was flagged by SFG Associates on April 11, 2014 using pink flags 1-8. The existing soil absorption system will be pumped and the existing septic tank removed and a new 1500 gallon septic tank and S.A.S. installed. The extent of grading will come within 62 feet of the wetland and the new leaching field will be 77 feet from the wetland at flag #5. A siltation barrier is depicted on the plan at least 42 feet from the wetland and will be considered the limit of work. There is an existing drainage easement running along the side property line and a headwall
opens up to the rear of the property and into the wetland. This system accommodates the drainage from the street. The work as proposed will not negatively impact the resource area, therefore MR recommends that the TCC approve the wetland line for references purposes only and issue a negative determination to include the attached special conditions. Steve Gilbert present from SFG Engineering. Motion to issue a negative determination with special conditions 1, 2, 3, 4, 9, 14, 18, and 19, RC, second DB, so voted.
Public Hearing
1. Route 140, Perry, Mass DOT-Highway Division-District 5 Office, (NOI), SE73-2578 Field report states that this filing involves the widening of Route 140, County Street, between Mozzone Boulevard and the Route 24 on-ramps. This widening is to increase safety and decrease accidents by eliminating the bottleneck created at the Route 140/railroad section of the roadway where the road narrows from two lanes in one direction down to one lane. The wetlands were delineated by Pare Corporation (PARE) on March 8 and 9, 2012 using blue flags:
-Series A-Flags A1-A100 (plan depicts A1-A26 and A75-A99). This series is located on the northeast side of County Street and wraps around the MassDOT building on this site. Flags A1-A26 are on the south side of the facility and A75-A99 are on the north side of the building. There is a concrete headwall between A3 and A4 to channel storm water from a drain within the northbound side of County Street. An intermittent stream flows west to east (from series F wetland) under the roadway and flows through the headwall between flags A19 and A20.
-Series B-Flags B1-B40. This series is located on the northeast side of County Street and begins along the west side of the railroad embankment turning to follow the toe of slope along County Street ending across the road from Mozzone Boulevard. A culvert opens between B10 and B11 to continue the connection between Series D wetland and B wetland. A culvert runs under the road and opens at flag B22 to accommodate an intermittent stream that flows from Series C.
-Series C-Flags C1-C50 (plan show C1-C31). This series is located along the southwest side of County Street, from in front of TGI Friday’s to the north side of the Mobil gas station. The Taunton Crossing storm water swale along County Street flows through a double culvert under Mozzone Boulevard and opens into the wetland between C3 and C4. The overflow from TGI Friday’s storm water basin enters the wetland between flags C1 and C2. Between flags C8 and C9, there is an invert that opens into a culvert that goes under County Street and opens by Flag B22. The wetland then begins to open up to the south and rear of the Mobil station.
-Series D- Flags D1-D14. This series is located on the southwest side of route 140 and along the south side of the Mobil Gas station and the railroad embankment. This wetland connects to the B series via a culvert that runs under the road.
-Series E- Flags E1-E20. This series is located on the southwest side of Route 140 from the south side of the railroad embankment to Industrial Drive. A small culvert at flag E16 connects a drain manhole on County Street to the wetland system.
-Series F- Flags F1-F16. This wetland series depicts the northern border of the BVW located on the southwest side of Route 140 between Industrial Drive and the on ramp to Route 24 South. There is an intermittent stream associated with this wetland and connects to Series A via a culvert running under the street. Storm water runoff from the roadways runs into this system through a number of catch basins.
-Series G- Flags G1-G7. This series is located on the southwest side of Route 140 at the off ramp from Route 24 to Route 140 South and depicts to northern edge of the wetland. There is a catch basin near flag G5 that may convey storm water overflow under County Street to Wetland System A.
The work will involve the boxcut widening of the roadway to two 12 foot lanes with a 4 foot shoulder in each direction at the railroad crossing and from Mozzone Boulevard to the Route 24 on and off ramps. The pavement along the project limits will be milled and resurfaced to match the existing roadway. The median at the intersection of Route 140 and the on ramp to Route 24 South will be reconstructed; sidewalks will be added along . the southwest side of the road; new guardrails, deep sump catch basins, and drainage structure will be added, as well as new signage and pavement markings. In order to accommodate the required sidewalks, approximately 1,376 square feet of wetland will be filled and a 2,294 square foot replication area will be constructed along the north side of the road. The
plan set shows siltation barriers throughout the work area. The City Engineer was concerned about portions of the proposed drainage system, recommended changes and approved the revised plans. The work as proposed will greatly improve the safety along this stretch of roadway. The work does require filling of wetlands but the proposed replication area is a good choice for a successful wetland replication. MR recommends that the TCC approve the wetland delineation as described above and issue an order of conditions to include the attached special conditions. Motion to open, DB, second NK, so voted. Present Andrea Coates and Shawn Handy MassDOT. ST asked about the start date? This time next year. ST asked if they have contacted the railway regarding gates being put in there? Yes the entire railroad apparatus will be replaced. RC asked why no Stormceptors in the drainage system? Andrea said its not a policy to put
them in. With detention basin and street sweeping they are meeting TSS removal. RC hoods in? No hoods are not installed in any Mass Highway Project. RC so no hoods at all? No. Handy said this is a state highway layout not a town or city street so everything that’s put in has to be done as Mass State Highway does it, right now they do not put in hoods on any project. RC recommends that hoods be put in all drainage structures. NK disagrees and would not vote for this unless it is done according to Mass Highway/DOT standards. Motion to approve with special conditions and the condition that hoods be used in all catch basins, RC, second DB, 3 in favor-EE, DB, RC. 3 Opposed-NK, LF, ST. MI abstained. Motion fails 3-3. Motion to approve with special conditions, according to the plan presented, NK, second LF, 3 For-NK, ST, LF. 3 Opposed EE, DB, RC. MI abstained. 3-3 motion fails. ST could
they make it so that the catch basins are cleaned twice a year? Handy cannot agree to that, he is not authorized to do that. 2. Paige Way, Bairos, (NOI), SE73-2579 Field report states that this filing is for the construction of a single family home, garage, driveway, utilities, and associated grading within the 100 foot buffer zone of a BVW. The wetlands approved and an ORAD issued on April 11, 2007. The wetland boundary was re-delineated by Earth Services on April 3, 2014. All work will be outside the 25 foot WPZ. Mulch filter socks or straw wattles will be used as a siltation barrier and will be considered the limit of work. A dewatering area and concrete washout area are shown outside the 100 foot buffer zone. The closest work to the wetland will be the driveway, which will come up to 35 feet from the BVW at its closest point. Roof runoff will go into drywells. The work will
not negatively impact the BVW therefore MR recommends that the TCC approve the wetland line FL35 to FL38, with flags FL10 to FL34, and FL39 to FL40 for reference purposes only. MR also recommends that the TCC approve the project and issue an order of conditions to include the attached special conditions. Paul Patnaude present. DB went out to site, where in relation to mailbox and fire hydrant? Paul at the end of the cul-de-sac. The driveway will be to the right of the hydrant, double grading catch basin existing there now. Outside the 25 foot buffer zone. DB saw skunk cabbage in there. Paul said that was over further. MR walked the line and reviewed it afterwards. ST it is deceiving the way the driveway curves. RC said he has no problems here, when a stamped plan is in front of him he knows a professional has staked their name to it. NK maybe staking out the 4 corners of the house or hay bale line so it
shows up better. RC does also prefer house staked and siltation. Motion to approve with conditions 1, 2, 3, 4, 5, 7, 8, 9, 17, 19, 21, 24, 25, 26, and 27, RC, second NK, DB voted no, motion carries 5-1
Other Business
1. Boyden Request. Pilgrim Congregational Church use of Boyden on 6/8/14, 11:30-2, motion to approve, DB, second RC, so voted.
2. Council to Marla Isaac. Congratulations on receiving her certificate.
3. Re: Mill River Update to Councilor Cleary. MR read her letter she sent to Councilor Cleary on current conditions.
4. July Meeting. Move meeting from 7/14/14 to 7/21/14. Motion to approve the change, DB, second MI, so voted.
5. Letter from resident of Berkley regarding things to do at Boyden. Motion to give to MR have her make copies for all members of TCC, DB, second MI, so voted.
6. At Boyden, fence is fixed and TRWA shed was broken into. Police officer saw it and it appears nothing was taken.
7. Dam in East Taunton-Barstow’s Pond. ST requests an update.
8. Busting ATVs on Glebe Street. Signs are up but its difficult to catch them. MR is continuing to work on this.
9. LF asked what was the newest news regarding Duffy Drive and Wayne Farley’s property. MR will double check on the property and what work has been going on.
During this time, words were exchanged between the Chair and Vice Chair. The Vice Chair warned the Chair that she felt bullied and he was being put on notice that she is tired of it. Chair asked that this be part of the record, that he wanted it in minutes that he was accused by the Vice Chair of being a bully.
