1.09.12 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission January 9, 2012

Present: Chair Brian Marques, Vice Chair Steven Turner, Commissioners Ernest Enos, Marla Isaac, and Debra Botellio.  Absent: Renwick Chapman and Neil Kelly.

Motion to approve the minutes of 12-14-11, DB, second ST, so voted.

Certificate of Compliance
  • 157 East Water Street, Kelley, (COC), SE73-2405
 Field report states this project was for the construction of a single family home with garage, driveway, and utilities.  The Applicant constructed a 1200ft driveway rather than a 530sf driveway and did not construct the garage.  This resulted in 130 additional square feet of impervious area.  This additional impervious area will not negatively impact the riverfront area.  All work has been completed in significant compliance to the order of conditions issued on 8-12-09.  Roof drains go into drywells, and the lawn is stable.  There is no sign of negative impact to the river.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, DB, second MI, so voted.
  • 171 Hodges Street, O’Brien, (COC), SE73-2033
 Field report states that this project was for the construction of a 24’ x 26’ attached garage.  All work has been done in significant compliance to the order of conditions issued on 4-20-05.  Roof drains go into drywells and all lawn areas are stable.  MR recommends that the TCC issue a COC for this project.  Motion to issue a COC, DB, second MI, so voted.  
  • 50 Homestead Crossing, Pendexter, (COC), SE73-2086
 Field report states that this project was for the construction of a single family home with associated grading.  The house is outside the 100-foot buffer zone of the BVW but a portion of the grading to the northeast was in jurisdiction.  All work has been completed in significant compliance to the order of conditions issued on 8-15-05.  MR recommends that the TCC issue a COC for this project.  Motion to approve the COC, DB, second EE, so voted.

Public Hearing
  • 25 Linden Street, Machado, (NOI), SE73-2485  
Field report states that this project is for the razing of an existing house, filling inn of the existing cesspool, and construction of a single family home with utilities and associated grading.  Wetlands to the rear of the site were delineated by Stephen Gilbert on 11-18-11.  MR reviewed the wetland line and is in agreement with the placement of the flags.  MR recommends that the TCC approve the wetland line as follows: flags 1-4, for reference purposes only.  The site is relatively flag with a U-shaped stockade fence along the rear and halfway up the sides of the property.  The house has been razed and no debris has migrated to the wetland.  A siltation barrier is depicted on the plan.  The home will be connected to city sewer and, as stated above, the cesspool will be abandoned.  MR recommends that roof drains go into drywells.  A concrete washout area and dewatering area should also be included on the plan.  The work as presented should not negatively impact the adjacent wetlands.  MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions.  Representative Brad Fitzgerald was present.  Motion to open the hearing, DB, second EE, so voted.  Motion to approve the wetland line, MI, second DB, so voted.  Motion to close the hearing and issue an order of conditions with special conditions 1, 2, 3,4 ,5, 10, 15, 19, 21, 23, 24, 25, 26, and 27, ST, second DB, so voted.
  • 70 Bettsy Road, Federal Nation Mortgage Assoc., (NOI), SE73-2486  
Field report states that this project is for a septic system upgrade with associated grading.  MR visited the site today and reviewed the placement of the flags.  MR is in agreement with the delineation and recommends that the TCC approve the delineation as follows: 2 through 8 with flag 1 for reference purposes only.  The septic system will be placed in the front yard and the 1500 gallon pump chamber will be 63 feet from the wetland at the closest point.  The plan shows a siltation barrier along the driveway to the west of the project.  The leach field will be located close to the cul-de-sac.  The project as presented will not negatively impact the wetland.  MR recommends that the TCC approve the project and issue an order of conditions to include the attached special conditions.  Darrien from Foresight Engineering was present.  Motion to open the hearing, DB, second EE, so voted.  Motion to approve the wetland line, DB, second ST, so voted.  Motion to approve, close the hearing, and issue an order of conditions with special conditions 1, 2, 3, 4, 5, 16, 17, 19, 21, 25, 26, and 27, ST, second DB, so voted.  
Motion to go back to the regular order of business, DB, second MI, so voted.
Continued Public Hearing
  • 565/569 Winthrop St, Lopes.  Motion to continue to January 23, 2012, DB, second MI, so voted.


Other Business
  • Boyden.  Removing trees in the river.  April the gate keeper was present, also present Michael Bovick, both citizens will to help at Boyden.  Sgt. McCaffrey was present from TPD, he will offer help with the TPD dive team.  Richard Saxon from Lopes Construction was also there to discuss their help with the removal.  MR will speak with Dighton, Lopes will also speak with them.  They have better access from that side.  They will also address standing wood out there.  Motion to have MR go out there and speak with the owner ST, second DB, so voted.  Motion to put a sign at Boyden on the day of tree removal stating: caution while work is in progress, DB, second MI, so voted.  Sgt. McCaffrey will contact MR a week prior to removal.
 Motion to revert back to the regular order of business to hear from Lopes, DB, second MI, so voted.

Continued Public Hearing
  • 565/569 Winthrop St., Lopes.
 Gary James-Green Seal Environmental, was present.  Motion to re-open the hearing, DB, second ST, so voted.  The Peer Review was discussed, almost every single item was addressed, 2 items that were not were agreed upon while reading was done at meeting.  Motion to close the hearing, approve with an order of conditions with special conditions 1, 2, 3, 4, 5, 7, 8, 11. 19, 20, 21, 22, 25, 26, 27, and 28-pending revised calculations to be put in the record, ST, second DB, so voted.  
Motion to cancel the hearing on January 23, 2012, DB, second MI, so voted.  

Other Business
  • Conservation Agent’s Report
  • Shaws Plaza Issue-rectified.
  • 34 ½ Briggs St.  There is time to get stuff done, order of conditions is until 2013, MR is just keeping on it re: people calling.
  • East Whitehill St. MR went out to check it out, has addressed it.
  • 147 Winthrop St.  Motion to send a letter to the new city solicitor asking about the status of the $30,000 remediation for this property, DB, second MI, so voted.
  • Lynne Hurley leaving.  Motion to send a letter to her thanking her for all of her great work, ST, second DB, so voted.
