Minutes of the Taunton Conservation Commission August 9, 2010

Motion to table the minutes of July 26, 2010, EE, second RC, so voted.


Certificate of Compliance
  • 1288 S. Precinct St, Smith, (COC), SE 73-1983 Field report states that this project was for the installation of a new septic system. This project was continued from the meeting on May 10, 2010 because the front lawn had been newly seeded and was not stable. The lawn area is now stable and has been mowed several times. All work has been completed in significant compliance to the Order of Conditions issued on November 16, 2004. MR recommends that the Taunton Conservation Commission issue a Certificate of Compliance for this project. Motion to approve and issue COC DB, second RC, so voted.
  • 8A & 8B Hern Avenue, Guimares, (COC), SE 73-2268 Field report states that MR spoke with the Applicant regarding the rear of the property as it is not quite finished. He stated that he will be loaming and seeding it in September and that the area should be complete by the middle of October. MR recommends that the Taunton Conservation Commission continue this hearing to October 18, 2010. Motion to continue to 10.18.10 RC, second DB, so voted.

  • 421 Joseph Warner Blvd., Sylvia, (COC), SE 73-2251 Field report states this project was for the construction of a single family home with driveway, septic system, well, and associated grading and utilities. The project involved creating a gravel driveway over an existing cart path with wetlands along the left side (southern) of the road. A second wetland is downgrade from the current house and circles the property west to north. MR states that all work was completed in significant compliance to the Order of Conditions issued on May 24, 2007 and extended to May 24, 2011. All areas are stable and there is no indication of encroachment into the adjacent wetlands. MR recommends that the Taunton Conservation Commission issue a Certificate of Compliance for this project. Motion to approve and issue COC DB, second RC, so voted.

Public Meetings
  • 91 Downing Drive, Gemme, (RDA), DSE-993  Field report states that this project filing is for the proposed installation of a 21’ diameter, above-ground pool with a 6’ x 8’ deck. This property is on the corner of Downing Drive and Barnswallow Circle. A portion of a bordering vegetated wetland is at the southwest corner of the property. The pool and deck will be located 85 feet from the wetland at the closest point. The project as presented should not negatively impact the wetlands. MR recommends that a non-backwash filter such as a cartridge filter be used. MR also recommends when draining the pool, the water be emptied on the lawn and allowed to filter back into the ground rather than using a hose into the wetland. MR recommends that the Taunton Conservation Commission approve this project and issue a Negative Determination to include the attached Special Conditions. Motion to issue a negative determination with special conditions 1, 4,18, 19, 20, and 21 RC, second DB, so voted.
  • 9 Robin Drive, Buffington, (RDA), DSE-994 Peter Buffington present. Field report states that this project is for the construction of a 10’ x 16’ shed within the 100-foot buffer zone of a bordering vegetated wetland, which is a red maple swamp. This property is located at the end of Robin Drive within the Driscoll Farms Subdivision off Norton Avenue, via Lori Lane. The original subdivision plans show a detention area behind this home. MR inspected this site on July 15th after the owner had applied for a building permit. He was unaware that he was near wetlands, and he had also said that there was no detention basin behind his home. The only stormwater management area, a grassed swale, is located on the north (left) side of the property. The plan the Applicant is using shows the non-existent detention basin. The shed will be placed on blocks and the closest corner will be 48 feet from the wetland. MR  recommends that the Taunton Conservation Commission approve the project and issue a Negative Determination to include the attached Special Conditions. Motion to issue  Negative Determination with Special Conditions 1, 4, and 19 EE, NK, so voted.
  • 262 Plain St., Cote, (RDA), DSE-995 John Cote present. Field report states that This project is for a 26-foot above-ground pool and a 20’ x 16’ deck. This property is on the east side of Plain Street and has a bordering vegetated wetland along the northern property line. The landing will be 55 feet from flag Y-J-7 and the pool will be 77 feet from the wetland. MR  met with the homeowner to review his project. The deck will be on three sona tubes and the landing will be set on two tubes. The ground will be leveled for the pool and at some point in the future, the owner will add an additional deck from the new deck to the pool for easier access. The Applicant is planning to use salt water as his filtering system. This system uses a cartridge filter and is environmentally- and user-friendly. He also pointed out three dead trees that will need to be cut. Two of these trees are along his driveway and right up against electrical wires. The third is off to the side of his back yard and could damage property or hurt someone with falling limbs. The projects as presented will not negatively impact the adjacent wetlands. MR recommends that the Taunton Conservation Commission approve the projects and issue a Negative Determination to include the attached Special Conditions. Motion to issue a Negative Determination with Special Conditions 1, 3, 4, 18, and 19 RC, second DB, so voted.
  • Field St (15-131), Cave, (RDA), DSE-996 Motion to move to Public Hearings NK, second DB, so moved.

Amendment
  • 145 Craven Court, Dunham, (AMEND), SE 73-2364 Field report states that the original Notice of Intent was for the construction of a single family home and garage. Since the issuance of the Order of Conditions in 2008, the current owners bought the house and are now filing an Amendment to the original Order of Conditions in order to construct an in-ground pool. All work will fall within the original parameters of the site work, that is, the pool and skirt will be within the siltation barrier and the 25-foot Wetland Protection Zone (WPZ) will remain unaltered. The owner will be installing a salt water filter which is a cartridge filter, not a backwash filter. MR recommends that the Taunton Conservation Commission approve the project and grant the Amendment. All original general and special conditions remain in effect and the date of expiration does not change.  Motion to approve DB, second RC, so voted.

  • 36 Stevens Street, LaGace, (NOI), SE 73-2444  This was continued from 7.26.10.  Motion to approve and issue an Order of Conditions to include Special Conditions 1, 2, 4, 5, 19, 21, 25, 26, and 27, DB, second RC, so voted.
  • 206A Tremont Street, DeOliviera, (NOI), SE 73-2407 Motion to continue to 9.27.10 DB, second RC, so voted.
Public Hearings
  • # 4 Public Meeting. Field Street (15-131), Cave, RDA, DSE-996 Paul Patneaude.  Field report states that this project is for the construction of a single family home with septic system, utilities, and associated grading. This property is the middle of three lots located on the north side of Field Street, just west of Lothrop Street, associated with a common driveway approved under file number SE 73-2361. A siltation barrier is noted on the plan as the limit of work and is at least 25 feet from the wetland, providing a 25-foot wetland protection zone (WPZ) per the Taunton Conservation By-Law. The plan also shows a dewatering area and concrete washout area. Both the washout area and dewatering area are outside the 100-foot buffer zone. The closest work on the property will be grading which will be 60 feet from the wetland line located south of the lot and on the other side of the common driveway. The majority of the work will be outside the 100-foot buffer zone. The only work within jurisdiction will be the septic system, the front part of the driveway, and grading. MR recommends that the Taunton Conservation Commission approve this project and issue a Negative Determination to include the attached Special Conditions. Motion to issue a Negative Determination with Special Conditions 1-4, 7, 8, 14, and 17-19, RC, second DB, so voted.
  • Field Street (15-82), Cave, (NOI), SE 73-2446 Paul Patneaude. Field report states that this project is for the construction of a single family home with septic system, utilities, and associated grading. This property is located on the north side of Field Street just west of Lothrop Street and is one of three house lots associated with a common driveway approved under file number SE 73-2361. A siltation barrier is noted on the plan as the limit of work and is at least 25 feet from the wetland, thus providing a 25-foot wetland protection zone (WPZ) per the Taunton Conservation By-Law. The plan also shows roof drains into drywells as well as a dewatering area and concrete washout area. Both the washout area and dewatering area are outside the 100-foot buffer zone. The closest work on the property will be grading at 40 feet from the wetland line. MR recommends that the Taunton Conservation Commission approve this project and issue an Order of Conditions to include the attached Special Conditions.  Motion to approve project and issue an Order of Conditions with Special Conditions 1-5, 8, 9, 15-17, 19, 21, and 23-27, RC, second DB, so voted.
  • Field Street (15-132), Cave, (NOI), SE 73-2447 Paul Patneaude. Field report states that this project is for the construction of a single family home with septic system, utilities, and associated grading. This property is the most westerly of three lots located on the north side of Field Street, just west of Lothrop Street, associated with a common driveway approved under file number SE 73-2361. A siltation barrier is noted on the plan as the limit of work and is at least 25 feet from the wetland, providing a 25-foot wetland protection zone (WPZ) per the Taunton Conservation By-Law. The plan also shows roof drains into drywells as well as a dewatering area and concrete washout area. Both the washout area and dewatering area are outside the 100-foot buffer zone. The closest work on the property will be the driveway which will be 40 feet from the wetland line at flag #56. MR recommends that the Taunton Conservation Commission approve this project and issue an Order of Conditions to include the attached Special Conditions. Motion to issue an Order of Conditions with Special Conditions 1-5, 8, 9, 15-17, 19, 21, and 23-27, EE, second RC, so voted.
