Minutes of the Taunton Conservation Commission November 15, 2010


Present: Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Steven Turner, Ernest Enos, Marla Isaac, Debra Botellio, and Renwick Chapman.

Motion to approve the minutes of November 1, 2010, ST, second RC, so voted.

Continued Public Hearings
  • 110 Prince Henry Drive, Tribe Mediterranean Foods, Inc., (NOI), SE73-2445  A field report was read stating this project is to upgrade an existing drain line that discharges to the Mill River near Hopewell Park.  The project will include a Vortechnics water quality structure that will fully treat stormwater quality prior to entering the Mill River from this line.  This project is part of the ongoing sewer/stormwater separation project.  The wetlands were flagged by Wetland Strategies, Inc. on 1-27-10.  At the Mill River, the top of the inland bank was identified using flags TOB1 through TOB10.  A BVW was also flagged here using flags labeled BVW1 through BVW11.  A second BVW fed by an intermittent stream was flagged at Hopewell Street using flags FL1A through FL12A and flags FL1B through FL9B.  MR is in agreement with the delineation and recommends that the Taunton Conservation Commission approve the delineation as follows: Flags TOB1-TOB10, BVWE1-BVW11, FL1A-FL12A, and FL1B-FL9B.  Work will consist of laying 1,060 feet of new 21” RCP drain and associated drainage structures parallel to the existing storm drain pipe from Broadway to Hopewell Street (via Purchase St. and Bay St.)  Stormwater will be conveyed through both pipes during storm events and will be combined in a drain manhole at the east side of Hopewell Park prior to entering a new 42” RCP drain to the Mill River.  Another 420 feet of new 42” RCP drain pipe and associated structures will be installed parallel to the existing 30” storm drain pipe from Hopewell Street to the Mill River.  The 30” pipe will be abandoned in-place upon completion of the new drain pipe as the 42” pipe will have adequate capacity to handle all stormwater from Broadway to Hopewell St.  A Vortechnics 16000 subsurface water quality structure and associated flow diversion manholes will be installed under a portion of Hopewell Park and will provide full treatment for the peak flow rates associated with the water quality storm event.  There will not be an increased impervious area in the watershed or resource areas.  The majority of he disturbance will be temporary in nature with approximately 595 square feet of bordering land subject to flooding temporarily altered, and 6,515 square feet of riverfront temporarily altered.  The permanent alteration will be the addition of the new concrete headwall and riprap pad at the end of the new outfall pipe at the Mill River.  A siltation barrier will be installed along the length of the project to protect wetlands and adjacent properties.  Once installation is complete, all disturbed areas will be loamed and seeded.  The project as presented should not negatively impact the resource areas; in fact, the discharge into the Mill River will be improved through the addition of the water quality structure.  MR recommends that the TCC approve this project and issue an Order of Conditions to include the attached Special Conditions.  Request for a continuance to December 6, 2010.  Motion to continue to December 6, 2010, DB, second MI, so voted.
  • 366 Prospect Hill Street, Winterton Corporation, (NOI), SE73-2401  Brian Dunn was present representing the TCC and Bill Buckley was present for the applicant.  Presentation was heard, discussion of what Mr. Dunn wanted to see done in order for the TCC to approve the project.  All issues brought up by Mr. Dunn were completed and he was in agreement with the project.  Motion to approve with special conditions 1, 2, 3, 4, 5, 6, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28-sand, no salt in winter, 29-no ATVs, put this as a restriction in the deed, 30-easement put on the plan, and 31 approximately 450 feet of fence put up along the back perimeter as a precaution, ST, second NK, so voted.  Abutters Steve McRae and Timothy Bunnewith spoke regarding their issues and questions they had.  The left satisfied with the answers given by the TCC and the applicant.
Public Hearings
  • Hopewell Park, Hopewell & Bay Streets, COT-DPW, (NOI), SE73-2455  Motion to approve the wetland line as delineated, ST, second DB, so voted.  Marilyn Greene, head of Department of Parks and Recreation and Robert Lane, commissioner for Parks and Recreation were both present at the meeting with some concerns.  They run their summer program at Hopewell Park and will be present while this work is taking place.  It was worked out that the disturbance to the field will be repaired as soon as the work is done, the area will be encircled with a safety fence, and any equipment left there during work will be properly secured.  Motion to approve with conditions 1, 2, 3, 4, 5, 6, 19, 20, 21, 25, 26, 27, and 28-a safety fence will be put around the perimeter, RC, second ST, so voted.
Public Meetings
  • 65 Meadow Brook Lane, Bliss, (RDA), DSE-1002  Field report states that this project is for the installation of a 24’x14’ shed.  The applicant is proposing to place this shed at the end of his driveway at an angle.  There is BVW that runs along the east and to the north of the existing house.  The flags on the plan were from an earlier project to build the house in 1989.  The wetland is still accurately displayed but the flags are no longer in the field.  The shed will be close to the edge of a steep slope that adjoins the wetland 30 feet away.  The shed will be pre-constructed and put into place.  There will not be a poured foundation for the shed.  The project as proposed will not negatively impact the wetland, therefore MR recommends that the TCC approve the work and issue a Negative Determination to include the attached Special Conditions.  Motion to issue a negative determination with conditions 1, 2, 3, and 4, ST, second NK, so voted.
  • 300 Scadding Street, Russell, (RDA), DSE-1003  Field report states that this project is for he installation of a replacement well.  The well will be approximately 16 feet from the northwest corner of the house and approximately 14 feet from the existing patio.  The well will be 101 feet from the leaching field, thus meeting Board of Health requirements.  The well will also be 68 feet from the high water mark of Sabbatia Lake.  MR recommends that the Applicant place a siltation barrier between the lake and the construction area of the well, setting the siltation barrier as the limit of work.  The project as proposed will not negatively impact the lake, therefore MR recommends that the TCC approve the work and issue a Negative Determination to include the attached Special Conditions.  Motion to issue a negative determination with conditions 1, 2, 3, 4, 14-(hay bales), 18, and 19, RC, second DB, so voted.
Violations
  • Town of Rehoboth.  Work was done out on this site.  Everything seems to be working smoothly now.  Abutters present were told that if any issues arise, contact TCC asap.  
Other Business
  • 2011 Meeting Schedule.  BM is still awaiting a response, he would like this discussion and vote, tabled until he receives a reply.  MR needs to know with enough notice because these are legal notices.  Motion to continue to December6, 2010, DB, second NK, so voted.
  • 84 acre Land Deal.  Motion to move this over for conservation to take the 84 acre parcel over, DB, second MI, so voted.
  • Letter for 147 Winthrop Street.  Discussion followed.
