Minutes of the Taunton Conservation Commission August 8, 2011


Present:  Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Ernest Enos, Renny Chapman, and Steven Turner.  Commissioners Marla Isaac and Debra Botellio absent.  

Motion to approve the minutes from the July 25, 2011meeting.NK, second EE, so voted.

Certificate of Compliance
1.  18 Ingell St, McDow, (COC), SE73-1179  Field report states that this project was for the construction of a septic system with associated grading.  All work has been completed in significant compliance to the Order of Conditions issued on 6.11.1998.  MR recommends that the TCC issue a COC for this project.  Motion to approve RC, second ST, so voted.
2.  154 Burt St, Hawthorne Development, (COC), SE73-2451  Field report states that this project was for the construction of a single family home with garage, driveway, septic system, associated utilities, and grading. All work has been completed in significant compliance to the Order of Conditions issued on 10.20.2010. Roof drains go into dry wells, the lawn is stable, and there is no indication of runoff into the adjacent wetlands. MR recommends that the TCC issue a COC for this project.  Motion to approve RC, second ST, so voted.  
3.  36 Jessie Lane, Laranjo, (COC), SE-73-1152  Field report states that this project was for the construction of a single family home with garage, driveway, associated utilities, and grading.  All work has been done in significant compliance to the Order of Conditions issued on 3.04.1998. MR recommends that the TCC issue a COC for this project.  Motion to approve, RC, second ST, so voted.  
4.  14 Marcia Bliss Way, Fombuh, (COC), SE 73-1200 Field report states that this project was for the construction of a four-bedroom single family home with garage, driveway, associated utilities, and grading. All work was completed in significant compliance to the Order of Conditions issued on 7.08.1998 and amended on 10.26.1999. MR recommends that the TCC issue a COC for this project. Motion to approve, RC, second ST, so voted.
5.  36 Davis St, Kerr, (COC), SE 73-1329 Field report states that this project was for the construction of an above-ground pool and deck. All work was completed in significant compliance to the Order of Conditions issued on 7.20.1999. MR recommends that the TCC issue a COC for this project. Motion to approve ST, second, RC, so voted.
6.  427 Winthrop St, Arpin, (COC), SE 73-2391 Field report states that this project was to replace an existing single family home, out-buildings, and farm stand with a single retail building with required parking and associated utilities and grading. All work was completed in significant compliance to the Order of Conditions issued on 7.28.2009. All areas are stable, detention basin is functioning as prescribed and there is no indication of siltation into the adjacent wetlands. The parking lot is separated from the wetlands and detention basin by a block wall and roof drains go into underground detention chambers. MR recommends that the TCC issue a COC for this project. Motion to approve, RC, second, ST, so voted.

7.  95 Norton Ave, Cabral , (COC), SE 73-2433  Field report states that this project was for the construction of a single family home with septic system, garage under, driveway, utilities, and associated grading. All work was done in significant compliance to the Order of Conditions issued on 10.28.1998. All areas are stable and roof drains go into dry wells. MR recommends that the TCC issue a COC for this project. Motion to approve, ST, second RC, so voted.

8. 440 Staples St, B&T Realty Trust, (COC), SE 73-2433 Field report states that this project was for the construction of a single family home with driveway, utilities, and associated grading. All work was done in significant compliance to the Order of Conditions issued on 5.13.2010. Roof drains go into dry wells and all lawn areas are stable. MR recommends that the TCC issue a COC for this project. Motion to approve, ST, second RC, so voted.

Continued Public Meetings
1.  220 O’Connell Way, Phillips Feed & Pet Supply, (RDA), DSE-1020  This project was continued per the TCC request that the COC for a previous filing, SE 73-2262, be recorded. The recording information was received. Motion to close the hearing and issue a Negative Determination with SC 1-4, 14, 18, and 19, RC, second EE, so voted.

1.  206A Tremont St, DeOliveira, (NOI), SE 73-2407  DEP has not approved the wetland replication and therefore has not issued a Superseding COC. MR recommends that this be continued to the end of the growing season. Motion to continue to October 24, 2011 with no ad required, RC, second NK, so voted.

3.  19 Ingell Street, 19 Ingell Street 2011 Taunton Trust, (NOI), SE73-2479 John DeSousa, Representative. Field report states this filing is for the proposed removal and re-positioning of the existing driveway, moving the existing shed from the rear of the house to the northerly part of the lot, installing a low pressure environmental/one grinder pump chamber with connection to municipal sewer, invasive species (Japanese knotweed) management, and re-grading of a portion of the lot. This lot is outside the 200-foot riverfront areas of the Mill and Taunton Rivers, but is within the floodplain as designated by the FIRM map. The Mill River is a tributary of the Taunton River and flows north to south into the Taunton. There is a wetland area along the northwest boundary that is subject to flooding during storm events, primarily from stormwater entering upstream from the Mill River. The property is also designated as being within Zone AE (el 12) floodplain of the 100 year storm. This land is considered, according to the Flood Insurance Study dated June 18, 1987, as being under the influence of tidal flooding from the Taunton River. The Applicant has referred to the land as Land Subject to Coastal Storm Flowage which is defined as “…land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater.” This area is subject to flooding from both the Mill River and areas upstream during storm events, and from the Taunton River. This area is subject to protection under M.G.L. c. 131 § 40.

Work does fall within the 100-foot buffer zone to the BVW located to the west and within the floodplain but not within the area subject to coastal storm flowage. A siltation barrier is shown on the plan and will be the limit of work.

MR reviewed the wetland line on May 31, 2011and recommends that the TCC approve the delineation as follows: flags 3, 6, and 7, and for reference purposes only flags 2, 4, 5, and 8-10. These flag numbers were retrieved from the plan submitted for the RDA. Motion to approve delineation, ST, second, RC, so voted.

The Applicant is proposing to reconfigure the driveway from a straight pull in with bump out to a somewhat circular design. A portion of the existing paved driveway will remain, and the rest will be converted to lawn. The additional area of paved surface will be 120 sf. The Applicant is also proposing to grade along the north and west sides of the property raising the grade from 9.5 to 12. This area of grading is within the 100-year floodplain as determined by the National Flood Insurance Program. This area is under to influence of tides so that any fill should not increase the flooding on adjacent properties.

Discussion ensued on the invasive species management. The Commission approved to change SC 28 to read that management will be done by hand and through injection of Round-Up. No spraying is to be permitted. Motion to close the hearing and issue an Order of Conditions with the following Special Conditions1-5, 16, 17, 19, 21, 25-27, 28, ST, second RC, so voted.
4.  565/569 Winthrop St, Lopes, (ANRAD), SE 73-2478 Gary James, representative. Filing was continued as there was no representative at the previous hearing. MR reviewed the wetland line with Gary James from Green Seal Environmental on Tuesday, July 12th. While in the field, they agreed to move two flags closer to the toe of slope and a revised plan was submitted with those changes. MR agreed with the placement of the flags and recommends that the TCC approve the delineation as follows:
  • Along the west: flags WF28 to WF48;
  • Along the east: flags WF1E to WF11E; and
  • Along the north: flags WF1to WF11, A1 to A11, and WF21 to WF27.
Motion to close hearing, approve delineation, and issue an ORAD, ST, second, EE, so voted.

Other Business
1.  Discussion of stamped plans. RC stated that all members should be present for the discussion and motioned that this be continued to the Aug. 22 hearing, second NK, so voted.
2.  Old COCs. There has been a great deal of negative feedback regarding charging fees to close out old filings so MR requested that the TCC waive the filing fee for COCs up through Jan. 1, 2005. Motion to waive fees ST, second, RC, so voted.
3.  ST asked if there were projects for Eagle Scout Billy Jenkowski. ST said that he would have Billy contact me.
4.  Dept. of Corrections ST stated that the Dept of Corrections in Plymouth, minimum security, is looking for work to do – clearing, whatever. MR to ask Tony Abreau and Marilyn Green what projects may be around that they can do. Have them give Steve  a call.
5.  Weir Riverfront Property. BM stated that there is money in the account to do work but that the Commission has not heard from the President. Need 3 bids before the money can be requisitioned. ST will look into this.
6.  Meetings. ST stated that he is now unable to meet on the last Monday of the month because he is on another board. Asks that the TCC look at schedule and see if dates can be changed. Only one that is coming up is September 26. Bring up at the next meeting.
