Minutes of the Taunton Conservation Commission November 14, 2011


Present: Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Ernest Enos, Marla Isaac, Debra Botellio, Steven Turner, and Renwick Chapman

Motion to approve the minutes of October 24, 2011, DB, second RC, so voted.

Certificate of Compliance
  • 71 Rankin Road, Wilson, (COC), SE73-2354  Motion to approve COC for this project, DB, second MI, so voted.
  • 34 Twinbrook Lane, (COC), SE73-2342  Field report states that this project was for the construction of an in-ground pool with patio and fence.  All work has been completed in significant compliance to the order of conditions issued on June 25, 2008.  There is no indication of sedimentation into the adjacent wetland and all lawn areas are stable and have gone through at least a season’s mowing.  MR recommends that the TCC issue a COC for this project.  Motion to approve the COC, ST, second NK, so voted.
Public Hearings
Motion to move the public hearing on Bay Street to the end of the agenda, ST, second RC, so voted.

  • 206A Tremont Street, DeOliveira, (NOI), SE73-2407  Working with DEP, still no COC issued.  Motion to continue to December 5, 2011, DB, second ST, so voted.
Public Hearings
  • Bay Street, COT/DPW, (NOI), SE73-2482  Field report states that this project is for the installation of approximately 700 linear feet of new sidewalk along the west side of Bay Street from Paul Devers School entrance to just before Goward Street.  The sidewalk will consist of new hot mix asphalt and will have four bump-outs to meet ADA standards.  This project is along a very busy road that currently has no sidewalk and where a death occurred earlier this year.  This project was reviewed by Mark Slusarz, City Engineer, and Kevin Scanlon, ADA Coordinator and Director of Planning and Zoning.  A number of requests for revision were submitted by me and Mr. Slusarz, and all items have been satisfactorily met.  The revisions also meet with approval by Mr. Scanlon.  MR reviewed the placement of the wetland lines as delineated by Wetland Strategies, Inc. on March12, 2009 and reflagged by BETA Group on November 9, 2011.  MR is in agreement with the placement and recommends that the TCC approve the line as follows:  All flags are for reference purposes only.  Flags 1A-18A along the west side of Bay Street, and flags 1-3, and TOB 1 and 2 along the east side of Bay Street.  The Applicant has submitted an Environmental Notification form as part of the filing with the state.  The area is within the Canoe River Aquifer ACEC but is not within any NHESP designated areas.  The project does fall within an area subject to flooding (Zone AE, elevation 65, during the 100-year storm).  No work will be within the BVW but all work will be within the 25-foot WPZ.  The area is very tight and there are no viable alternatives to the width of the sidewalk which is 4 feet wide, with 5-foot bump outs every 200 feet to meet ADA standards.  The addition of deep sump catch basins and rip rap will improve the quality of the stormwater entering Watson Pond, thereby improving the quality of the associated resource areas.  The drainage areas, and drainage calculations, were revised per the request of the City Engineer to reflect a smaller drainage area (the original was picking up all runoff even though there were swales and site drainage systems on the east side of the street).  The manhole covers can only be located within the sidewalk layout as the water line runs very close to the edge of the road.  The work as proposed will have temporary disturbances, but will not negatively impact the resource areas or buffer zones once work is complete.  The plan depicts straw wattles as temporary erosion/siltation barriers.  MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions.  Motion to open the hearing, DB, second RC, so voted.  Motion to approve the wetland line, DB, second ST, so voted.  BM asked the purpose of the sidewalk?  Pedestrian safety.  Motion that the TCC send a letter to the council to contact DCR to see if it is possible to lower the price of the parking rate which may solve the problem of people parking on Bay Street, even a tier pricing or discount for Taunton residents, MA residents, etc, ST, second DB, so voted.  Motion to approve and issue special conditions 1, 2, 3, 4, 5, 19, 21, 25, 26, and 27, RC, second MI, so voted.  Motion to close the hearing, RC, second DB, so voted.
Other Business
  • Wintergreen Lane.  Neighbor vs Neighbor, trash and beer cans in the wetlands.  MR is sending letter, dealing with issue will report back.
  • Dick Schafer.  The jersey barriers up near the house at Boyden were a concern could be an issue with police and fire.  MR checked and it is fine to have them there.  Dick had an issue with people still having access to the water with canoes.  MI said they never used that area, they use the canoe trail to the ramp.  
  • Meetings.  Motion that due to lack of filings, there will be no meeting held on November 21, 2011, DB, second NK, so voted.
  • School Street Ext.  MR will check if there’s anything going on out there.  She will bring any copies of filings.  
  • Puffin Way.  Dumping again.  MR will do letter for residents.
