10.24.11 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission October 24, 2011

Present Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Debra Botellio, Ernest Enos, Steven Turner, and Renwick Chapman.
Absent: Commissioner Marla Isaac

Motion to approve the minutes of 9-26-11 and 10-17-11, RC, second ST, so voted.  DB voted present for 9-26-11.

Public Meetings
1.  Route 140, Mass DOT, (RDA), DSE-1028  Field report states that this project involves pavement milling, resurfacing, and related items necessary to rehabilitate Route 140 from Hart’s Four Corners to the Route 24 intersection.  All work will be within the existing roadway and appropriate siltation barriers will be placed along the areas which are close to wetlands.  The wetlands areas along the proposed work are located on the east and west sides between Mozzone Boulevard and the Mobil gas station with a stream crossing under the road.  The other areas are on the east and west sides of the road at the Route 24 interchange.  The work as presented is within an existing road and, with the siltation barriers up, will not negatively impact the wetlands or stream crossing.  MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions.  Motion to open the hearing DB, second RC, so voted.  Tom Maguire DOT Highway Division and the assistant Mike Clemens were present.  No redesign in the scope.  DB said is the work to be done before the winter season or in the spring?  They will not be able to get to it this year, definitely be done next year.  RC asked if its within the limits of paving that currently exist?  Yes they are reconstructing sidewalks that are in disrepair, no additional work.  RC asked if they will remove all asphalt and find grading then paving?  They don’t believe it will be that involved but no reconstruction of the gravel box, they are not adding any new sidewalks.  The sidewalks run from Hearts Four Corners to the Highway Department and some on the other side.  Motion to close the hearing and issue a negative determination with conditions 1, 2, 3, 4, 5, 6, 14, 18, and 19, RC, second DB, so voted.
2.  Robert Boyden Road, Norton Hill Street, LLC, (RDA), DSE-1029  The field report states that this project involves a 4” overlay of existing pavement and widening the existing road to a consistent 24-foot width from the Norton line to the front of 34 Robert W Boyden Road (formerly Hill St.)  The road currently varies in width from 18 feet to 24 feet and this work is being required by the City of Taunton as part of a pending agreement among the City of Taunton, the Applicant, and Waste Management of Massachusetts.  There is a culvert under the road connecting the wetlands n each side of the road.  These wetlands were flagged by LEC (series A) for the Town of Norton in 2010.  The B series was flagged by Wetland Preservation Inc. in May of 2010.  There are existing drainage swales (shown as green on the plan) on both sides of the road that connect to both existing wetlands.  The culvert is in good shape and the stream flow is unrestricted.  There are guardrails running along both sides of the road and will remain in place.  There will be no widening on the western side of the road but a siltation barrier should be placed along that side as well during the paving process through the first rain to catch oils.  The are along the western side of the road is within the Three Mile River ACEC.  Widening along the eastern side of the road will come within 35 feet of the wetland closest to Norton, within 20 feet at the culvert opening, and within 34 feet of the wetland at the section closest to 34 Robert W Boyden Road.  A siltation barrier is depicted on this side of the road.  This should remain in place through the first rain.  The work as presented should not negatively impact the wetlands or stream crossing.  MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions.  Motion to open the hearing, DB, second ST, so voted.  Representative Mark was present to answer any questions.  MR asked if they were ok with putting up the siltation barrier?  Yes they are ok with putting it up on both sides.  Mark would also like to maintain vegetation on side of the road, limited maintenance of higher branches but not tree cutting.  Trimming branches and some pruning.  Agreement between Taunton, Norton, Developer of Norton Hill St, and Waste Management Maintenance Facility for WM trucks.  Motion to close the hearing and issue a negative determination with special conditions 1, 2, 3, 4, 5, 6, 14, 18, 19, and 20, RC, second ST, so voted.  

Continued Public Hearings
1.  206A Tremont Street, DeOliveira, (NOI), SE73-2407  Motion to continue this hearing to November 14, 2011 and not require Mr. DeOliveira to be present, ST, second Db, so voted..

Other Business
1.  MR still working on culvert information.  

2.  Letter re: Boyden and junk car on the property.  This gentleman wants to remove it.  Motion to accept the letter and place it on file, ST, second DB, so voted.  MR was asked to check the acres in re: to Electric Co. land, and speak with the gentleman to see where this car is.  

Motion to adjourn, DB, second RC, so voted.  Meeting ended at 7:30pm.
