Minutes of the Taunton Conservation Commission 4-27-09
Present: Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Ernest Enos, and Renwick Chapman. Commissioner Steven Turner arrived at 7:15 p.m. Absent: Marla Isaac and Robert Newhall. The meeting began at 7:00 p.m.
Motion to approve the minutes of April 6, 2009, RC, second EE, so voted.
Certificate of Compliance
1. 34 Shores Ave., Silveira, (COC), SE73-2360 A field report was read stating that MR visited the site on April 22, 2009 and observed that all work has been done in significant compliance to the Order of Conditions issued on 10/22/08. All areas have been seeded and are growing. MR recommends that the TCC issue a COC for this project. Motion to approve and issue a COC for this project, NK, second RC, so voted.
2. 628 Caswell Street, (COC), SE73-2168 A field report was read stating that this project was for a septic system repair. All work has been completed in significant compliance to the Order of Conditions issued on May 3, 2006. All areas are stable and there was no impact to adjacent wetlands. MR recommends that the TCC issue a COC for this project. MR said there is a small pile of debris/rubbish but she was ok with it. Motion to approve and issue a COC for this project, RC, second EE, so voted.
Continued Public Meetings
1. 38 Thunder Road, Knief, (RDA), DSE-945 A field report was read stating that this project is for a proposed repair and upgrade of a residential septic system. There is a BVW located in the southeast corner of the property. MR reviewed the line delineated by George Collins on 2/27/09, and agrees with the placement of the flags. MR recommends that the TCC approve flags WF1 through WF6. Work located within the 100 foot buffer zone includes the 1,500 gallon septic tank and distribution box with riser, as well as some excavation of the leaching bed. The siltation barrier/limit of work will be located 80 feet from the
wetland. The closet work to the wetland will be at 93 feet, with the house between the work and the wetland. As proposed, the work will not negatively impact the resource area. MR recommends that the TCC approve the project and issue a Negative Determination. Motion to approve flags WF! Through WF6, NK, second EE, so voted. George Collins from Collins Engineering was present representing the applicant. No real estate transaction is taking place, they are just having issues out there and the Board of Health has been involved. He said a copy of the As Built Plan can be sent to the TCC. The system has failed. The water table is at 68 and 85 inches, all medium to coarse sand. They are put the new system where the old one was, it was built and finished 2 weeks ago. Motion to issue a Negative Determination and Mr. Collins send the As Built plan to the TCC so it can be placed in the file, EE, second RC, so voted.
Public Meetings
1. 67 Jaclyn circle, Zakrzewski, (RDA), DSE-947 A field report was read stating that the Applicant is proposing to erect a 10’ x 14’ shed on concrete blocks approximately 10 feet from the edge of a BVW. The area up to the wetland boundary is established lawn with a play area to the right of the proposed location for the shed. The wetlands were delineated by Walter Hewitson on 9/25/08. MR is in agreement with the placement of the flags and recommends that the TCC approve the line as follows: flags 4 through 9, and flags 1 through 3 for reference purposes only. As proposed, this project will not negatively
impact the wetland, therefore MR recommends that the TCC approve the plan and issue a Negative Determination. Motion to approve flags 4 through 9, and for reference purposes only, 1-3, NK, second RC, so voted. Homeowner was asked what will be stored in the shed? Kids toys, bikes and patio furniture. Told no lawnmowers, etc, nothing with fuel. He said he only stores those things in his garage so it would not be a problem at all. Motion to issue a Negative Determination, with the conditions that no fuel ever be stored in the shed, RC, second NK, so voted.

2. 75 Round Street, Bristol County Savings Bank, (RDA), DSE-948 A field report was read stating that this project is for a residential septic system repair. There are two BVWs , one across the street from the house, and the other located along the southwest property line. Wetlands were delineated by George Collins. MR reviewed the line today and agrees with the placement of the flags. MR recommends that the TCC approve the delineation as follows: flags RPC to RPM, and for reference purposes only, RPA, RPB, and RP1 to RP3. A siltation barrier is depicted on the plan titled “Plan and Details Subsurface
Sewage Disposal System Upgrade” and dated 3/30/09. The siltation barrier is at least 52 feet from the wetland. The closest work will be 55 feet from the wetland. As presented, this project should not impact the adjacent wetland area; therefore MR recommends that the TCC issue a Negative Determination for this project. George Collins was present, representing the homeowner. He passed out a new plan because there were some comments that needed to be addressed and he did not receive the comments until Friday. The banks owns the house, it is in foreclosure. If the system fails at all before the house is sold, the bank is responsible for the system. Motion to approve flags RPC to RPM, and for reference purposes only RPA, RPB, and RP1 to RP3, NK, second ST, so voted. Motion to issue a Negative Determination for this project, RC, second EE, so voted.
Extensions:
1. Plain Street (Sydney’s Way), AGS Development Corp., (EXT), SE73-2178 A field report was read stating that the Applicant has requested a three year extension on the Order of Conditions issued on 7/20/06. Work that still needs to be done consists of: top course paving, sidewalks, and shoulder treatments. Lots 1 through 4 have not been developed as of yet. The sidewalks and top course paving are planned to be done upon the development of these lots. All other work has been carried out in accordance with the Order of Conditions and Special Conditions. MR recommends that the TCC issue a three year Extension
for this project. Rich Riccio was present representing the owner. Motion to approve the extension for three years, to 2012, NK, second ST, so voted.
Public Hearings:
1. Bay Street, COT-Water Dept., (NOI), SE73-2385 A field report was read stating that this project is for the construction of a new industrial park booster station as part of a new high service system to promote the continued development of the Myles Standish Industrial Park. Proposed work will consist of construction of a new 24’ x 28’ booster pump station and associated piping, and a 46 foot long gravel access driveway. Roof runoff will be directed to two 4’ wide gravel infiltration trenches equipped with six inch diameter perforated high density polyethylene (PDPE) pipes. The water will then be piped via
6 inch solid HDPE pipes to a 1.5 foot deep retention basin prior to discharge to Sabbatia Lake. The retention basin will have an impervious liner installed over 6 inches of sand. Twelve (12) inches of loam amended with synthetic anionic polymer root watering crystals will cover the liner. New England Roadside Matrix Wet Meadow Seed Mix will be used to seed the detention basin. The site is located on the east side of Bay Street and abuts Sabbatia Lake along the western shore. It consists of three lots totaling 1.18 acres and is currently owned by Ramo Riva. A “Permission for Access” letter is in the record. The wetland resource area, BLSF, was flagged by Camp Dresser & McKee Inc., (CDM) on 3/12/09. The flags were placed at the top of Inland Bank along Sabbatia Lake. MR is in agreement with the placement of the flags and recommends that the TCC approve the flags as follows: flags 4-1 through 4-7. A siltation
barrier consisting of straw bales and siltation fence is depicted on the plan titled “2009 Water System Improvements” dated May, 2009. MR recommends that a dewatering station be depicted on the plan because grading will be below flood elevation 65 and the lake is at a high water point at this time. The project as presented should not negatively impact the resource area. MR recommends that the TCC approve the plan and issue an Order of Conditions to include the attached Special Conditions. Motion to approve flags 4-1 through 4-7, NK, second ST, so voted. A memorandum from the City Engineer was read into the record. Present representing the City of Taunton was Ben Levesque, Magdalena Loftstedt, and Cathal O’Brien. The building to house this booster station will look like a little house. They checked things out and hydraulically this is a good place to tie in. This will help residential as well as the industrial
park. It is a 1 million gallon tank. The city is in the process of taking this property by eminent domain. RC asked that the representatives explain their plan. Some discussion ensued regarding the plan and the work to go on at this site. There will be a fence around it, it will be visited twice per day by an employee, and it will have a camera that if the building is entered, it will trip the camera, which will send a signal to Lakeville, who in turn calls the Police to alert them. Based on the plan and notes, the site work and pad will be the only excavation work. The house is pre-fab and comes in two halves which are then quickly put together. The building will be 24 x 28, on a concrete pad, the finish elevation of the pad is 66.1-top of pad. They are designing the pad so they aren’t sure how thick it will be yet. It won’t have a frost wall, will be built like a dumpster pad. The pad is strictly there
to hold the walls and roof up on the house, the pumps, etc. will be on their own stands. RC would like to see the City Engineer’s questions answered to his satisfaction. The representatives are just seeing the City Engineer’s questions tonight. Motion to issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 8, 9, 11, 16, 17, 19, 20, 21, 22, 23, 25, 26, and 27, with the condition that the 3 questions from the City Engineer are met, and approved by the City Engineer in writing, and signed off on by MR, RC, second ST, so voted. Letter granting access was read into the record. Motion that letter granting access be part of the record, NK, second ST, so voted.
2. Briggs Street, COT-Water Dept., (NOI), SE73-2388 A field report was read stating that this project is for the 2009 Water Mains Improvements Project. Streets that will be involved in this project are Briggs, McSoley, Marvel, Billings, Godfrey, Knight, Exeter, Bradford, and Dean Streets. Approximately 10,500 linear feet of existing 6-inch, 8-inch, and 12-inch diameter cast iron water mains will be replaced with new 8- and 12-inch ductile iron and polyvinyl chloride water mains. There are 14 wetlands identified throughout the project and the proposed work will be in BLSF, Riverfront, 100-foot buffer zone of BVW, and Inland
Bank. All construction will be within existing roadways and will not be in any resource areas. Any alterations cased by the work will be temporary and will be restored to pre-construction grades. All roadways will be repaved. The 100-year floodplain is present around a small area on Briggs Street, approximately half of Knight Street, a small area of Godfrey Street, and a section of Dean Street. The 200-foot Riverfront area is associated with the Taunton River, Cobb Brook and perennial tributaries. MR recommends that the TCC approve the following wetland lines for reference purposes only: Wetland 1: flags 1-1 through 1-11 (BVW), Wetland 2: flags 2-1 through 2-11 (BVW), Wetland 3: flags 3-1 through 3-10 (BVW), Wetland 6: flags 6-1 through 6-4 (Top of Bank), Wetland 7: flags 7-1 through 7-5 (BVW), Wetland 8: flags 8-1 through 8-27 (BVW), Wetland 9: flags 9-1 through 9-4 (BVW), Wetland 10: flags 10-1 through 10-6 (BVW), Wetland 11: flags 11-1
through 11-6 (Pond), Wetland 12: flags 12-1 through 12-3 (BVW), Wetland 13: flags 13-1 through 13-4 (Top of Bank), Wetland 14: flags 14-1 through 14-4 (Top of Bank), Wetland 15: flags 15-1 through 15-6 (BVW), Wetland 16: flags 16-1 through 16-3 (BVW). The work as presented should not impact any wetland resource areas. All areas will be protected by a siltation barrier when work is occurring near each area. All disturbances are temporary and the work area will be restored to its previous condition and all roadways will be repaved. MR recommends that the TCC approve this project and issue an Order of Conditions to include the Attached Special Conditions. Representatives Ben Levesque, , Magdalena Loftstedt, and Cathal O’Brien. Motion to approve the flags as stated in the field report, NK, second ST, so voted. ST asked how long the project would last? Approximately 18 months. They answered the three questions from the City
Engineer at the meeting. 1. They will provide temporary water to 100% of the customers affected by this. 2. They will have 2 hydrants, and 3. this is going under the existing culvert and it is going into a sleeve. Motion to approve and issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 6, 7, 19, 21, 25, 26, and 27, and with the condition that the 3 questions from the City Engineer are met, approved in writing from the City Engineer, and signed off on by MR, EE, second ST, so voted.
3. John Quincy Adams Road, COT-Water Dept., (NOI), SE73-2386 A field report was read stating that this project is for the High Service System which will incorporate the Ever Wells and the Dever campus into the existing water transmission system. This will entail the replacement of the existing Industrial Park Tank and the Dever Tank with a new one million gallon elevated steel water storage tank and the construction of a new booster pumping station (filing SE 73-2385). This is necessary as the area currently has reduced water pressure and fire flow capacity which is an impediment to business interested in this area. Enclosed
is the Environmental Notification Form (ENF) submitted to MEPA for the sale, lease or transfer of Rights to the Dever Wells, from the Commonwealth to the City of Taunton for water supply purposes. On 8/10/07, the Secretary issued a Certificate on the ENF stating that the project does not require an Environmental Impact Report (EIR) and can be adequately addressed in the Mass DEP permitting process. A Notice of Project Change (NPC) was filed with MEPA on 3/16/09, for the implementation on the High Service System. On 3/12/09, and 8/20/07, CDM wetland scientists delineated the wetland resource areas located in the area of the Dever Wells and Dever Tank. The Dever Wells are within the 100-foot buffer zone to a BVW and are flagged using flags 1-1 through 1-12. A large emergent marsh is flagged using flag series 2-1 through 2-22. The third wetland is a red maple swamp located near Well House #1 and is flagged using series 3-1 through 3-86. An
intermittent swale runs along the dirt road and is flagged with series 5-1 through 5-18. MR recommends that the TCC approve the flag series listed above. Work on the Dever Replacement Wells includes: 1. Installation of permanent 24x18 inch diameter gravel-packed water supply wells at the sites of test wells 3-07 and 6-07, which will eventually replace the existing wells #1 and #2; 2. Short-duration process performance tests on the completed wells to verify yield and drawdown; 3. Installation of a temporary well cap on both wells; and 4. Possible installation of additional wetland piezometers, if required by DCR. Work on the Replacement Water Tank will include: 1. Clearing of existing vegetation for a tank construction staging and stockpile area, and tree clearing as necessary to provide this area. Tree cover will remain between the tank and John Quincy Adams Road; 2. The tank will include an overflow and drain pipe. These two pipes will be combined
into one and discharge to the existing swale. The part near the pipes will be modified with rip rap to reduce discharge energy and prevent erosion; 3. The existing Dever Tank is in poor condition and has paint chippings and erosion. This paint may contain lead and testing of existing soil will be performed. If lead is present, the bid package will address the required soil handling procedures; 4. The replacement tank will have usable space within the pedestal. Chemical feed and control facilities for the two Dever replacement wells will be installed there; 5. The access road from John Quincy Adams Road will be widened to allow truck access and serve as the main road to the new tank. This road will be gravel. The only pavement included in this project will surround the base of the tank; 6. Operation of the new booster station will be based on the water level in the tank; 7. A common practice with installing a water storage tank is to install
communication equipment neat the top. The Police and Fire Departments are expected to relocate their existing communication equipment from the existing Industrial Park Tank to this one. The work area for this project is within the 100-foot buffer zone to a BVW and 25-foot WPZ. The plan as presented should not negatively impact the adjacent resource areas, therefore MR recommends that the TCC approve the project and issue an Order of Conditions to include the attached Special Conditions. Motion to approve the flags as stated in the field report, NK, second RC, so voted. Representatives Ben Levesque, , Magdalena Loftstedt, and Cathal O’Brien. The city is leasing these wells. Paul Dever School is 152 acres, 2/3 will be for industrial use. They will add a guard rail as requested. Motion to issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 10, 11, 19, 20, 21, 22, 25, 26, and 27, ST, second NK, so
voted.
Motion to go out of order to hear from Zachary Wirth, an Eagle Scout here with a presentation, ST, second NK. Roll Call Vote: ST-yes, EE-yes, RC-yes, NK-yes, and BM-yes.
Zachary is with Troop 61 out of Norton. He has a project that he needs to complete and would like to redo the information board at Boyden Sanctuary. It is currently just 2x4’s with a roof and push pins. He would like to take the time to redo it, cover the board with plastic to protect the information displayed on it. He will fundraise and solicit donations from Lowe’s and Home Depot. Motion to send a letter of thanks to Zachary for his outstanding work out at Boyden with the projects he has done out there, ST, second NK, so voted. It will need to be finished before June. Motion to approve this project at Boyden, send a letter to Troop 61, Friends of Boyden, TRWA, and Marilyn Greene from Park and Recreation, stating that Zachary Wirth has the TCC’s permission to
go out and complete this project on the information board, ST, second NK, so voted.

4. Meadow Street, COT-DPW, (NOI), SE73-2384 A field report was read stating that this project is for the installation of a 250 linear foot grassed swale to control stormwater prior to discharging at the Mill River. Silt fence and hay bales will be installed to prevent construction debris from entering the river. Access will be at the corner of Meadow Street and Meadow Avenue and will be constructed on land owned by Reed and Barton and will be a drainage easement protected by an existing chain link fence. This work is mandated by the EPA to reduce the volume of stormwater entering the sanitary sewer system. Currently,
there are two stormwater inlets that collect runoff and pipe it directly to the sanitary sewer system on Cottage Street. This project will eliminate this cross-connection and redirect the stormwater through a grassed swale to the Mill River. A BVW is located at the end of the proposed swale. The BVW was flagged by Wetland Strategies, Inc. on 3/19/09 using pink flags numbered 1-7. This marsh is the closest resource area to the work site. The Mill River is within the BVW but was unable to be flagged at this visit due to the flooded condition of the marsh. MR recommends that the TCC approve the delineation marked by flags 1 through 7. A siltation barrier is shown along the work area and is marked as the limit of work. The outlet of the swale, with a rip rap pad, will be at the edge of the wetlands. Trees at this end will be protected from construction vehicles. This work is necessary and the proposed swale will be long enough
to allow for energy dispersal and pick up of sediment prior to exiting to the wetland. MR recommends that the TCC approve this plan and issue an Order of Conditions to include the attached special conditions. Motion to approve the flags as stated in the field report NK, second ST, so voted. Motion to issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 6, 19, 20, 21, 25, 26, and 27, and respond in writing to the City Engineer’s concern, EE, second ST, so voted.

5. 761 Joseph Warner Boulevard, Draka Cable, (NOI), SE73-2375 A field report was read stating that this project is for the proposed repair and upgrade of a commercial septic system. Wetland resource areas include BVW, a drainage easement, and top of bank for the Three Mile River. The wetland resource areas were flagged by George Collins on 2/26/09. The drainage swale was delineated with flags DW-1 through DW-4 along the east side of the site. The Three Mile River is along the west side of the site and was flagged using flags TB-1 through TB-10. At the entrance, a small wetland was flagged using flags RP-1 through
RP-5. MR is in agreement with the placement of the flags and recommends that the TCC approve the delineation as follows: flags DW-1 to DW-14, TB-1 to TB-10, and RP-1 to RP-5. The majority of the work will be within the 100-foot riverfront area. The siltation barrier will be set up at 29 feet from the tip of bank. The closest work will be grading at 33 feet. The new leaching field will be 51 feet from the top of bank. The new leaching field will be in a grassed area and close to the original leaching field. The work as presented should not negatively impact the adjacent resource areas. MR recommends that the TCC approve this plan and issue an Order of Conditions to include the attached Special Conditions. Motion to approve the wetland line as stated in the field report, ST, second RC, so voted. George Collins representing the owner. (NK back during the discussion) Discussion over project and plan. RC
favors a way of doing things that this engineer does not use so much. They discussed reasons behind using this method to get information needed on a site. Motion to issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 10, 19, 21, 25, 26, and 27, with a letter from the TCC to the Board of Health that this is a failed system and this needs to be moved along quickly, job needs to be done quickly due to failure, ST, second NK, RC opposed. Vote 4-1, motion carries.
6. 314 Broadway, LeClair/General Fire Extinguishers, (NOI), SE73-2380 A field report was read stating that MR visited this site on 4/22/09 and noticed that there were no flags visible. MR recommends that the ILSF be re-flagged prior to commencement of work. The wetlands were approved under SE 73-2155 and an ORAD was issued on 12/05/06. The site is partially developed with an undeveloped area to the rear. The ILSF is located within a depression created when a gravel removal operation existed on the site. The Applicant is proposing to construct a new 6000 square foot building, keep the current 1100 square foot
existing building and create a 20,000 square foot parking and driveway area. The Applicant is alos proposing to fill a small portion of the ILSF (2,249 square feet) along the southwest portion of the site and add 6,204 square feet to the northern portion of the ILSF, with associated grading, for stormwater management. This use is allowed under the Wetlands Protection Act 310 CMR 10.05 (6)(k): “No Area Subject to Protection under M.G.L. c.131,40 other than Bordering Land Subject to Flooding, Isolated Land Subject to Flooding, Land Subject to Coastal Storm Flowage, or Riverfront Area may be altered or filled for impoundment or detention of stormwater, the control of sedimentation, or the attenuation of pollutants in stormwater discharges and the applicable performance standards shall apply to any such alteration or fill.” The existing ILSF volume is 19,575 cubic feet. The proposed new volume will be 28,647 cubic feet, an additional increase
in volume of 9,072 cubic feet. The increase in volume of the ILSF will be greater than the increase in runoff to the ILSF with the additional impervious surfaces, and will be able to retain and infiltrate runoff from the 100-year storm. The Applicant has met all the stormwater standards. The only issue in the design is that there are no roof drains to drywells or infiltration system. MR recommends that roof drains to drywells be added to the plan. The plan does not show any siltation barrier, dewatering area, or washout area. Also missing is the local 100-foot buffer zone for the ILSF. MR recommends that these items be added to the plan and a new plan be submitted prior to sending the Order of Conditions. MR recommends that the TCC approve this plan and issue an Order of Conditions to include the attached special conditions. Representative Byron Holmes present. His plan does not include MR's concerns but he does not have a
problem with any of them. Agrees to re-flag. Motion to issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 8, 9, 10, 15, 16, 17, 19, 21, 23, 24, 25, 26, 27, and 28-re-flag, submit a revised plan, RC, second EE, so voted.
7. 200 Norton Avenue, Bay State Sewage Disposal, (NOI), SE73-2382 A field report was read stating that this project is to install new sewer lines and pump chamber to connect to municipal sewage, thus replacing failing on-site septic systems. This site is a trailer park and work will be within Riverfront Area and Bordering Land Subject to Flooding. The Top of Bank of Stonebridge Brook is accurately displayed on the plan, although no flagging was done. A siltation barrier is depicted on the plan titled “Sewer Improvement Plan In Taunton, MA” dated 3/9/09. Filter fabric will also be placed under the existing
catch basins on Westbridge Street. Work will include installing 8’ sewer lines, 3’ force mains, pump chamber, sewer manholes, and abandonment of an existing septic systems and will be better environment for the resource areas. MR recommends that the TCC approve this plan and issue an Order of Conditions to include the attached special conditions. Representative Jonathan Pink. Motion to issue a standard order of conditions with special conditions 1, 2, 3, 4, 5, 7, 19, 21, 25, 26, and 27, ST, second EE, so voted.
Violations
1. 655 West Water Street. These owners make an effort to be present every time called in to keep the TCC up to date on their progress on taking care of this matter. Motion to continue to May 18, 2009, ST, second NK, so voted.

Other Business
1. Motion to approve letter RE: Registry of Deeds and paying fee to record this onto a deed, ST, second NK, so voted.

3. MR was asked to go out and check Scadding Street.
4. MR will do research on when City Hall will have web access.
5. Laptops- BM said TCC will pay $600-$700 per laptop, before shipping and handling.
