8.22.11 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission August 22, 2011


Present: Chair Brian Marques, Vice Chair Neil Kelly, Commissioners Steven Turner, Debra Botellio, Marla Isaac, Ernest Enos, and Renwick Chapman


Motion to approve the minutes of August 8, 2011, ST, second RC, so voted.  DB and MI voted present.

Certificate of Compliance
1.  109 E. Water Street, Saba, (COC), SE73-2469  Field report states that this project was for the construction of replacement decking within the existing footprint of the current deck, within the riverfront area of the Taunton River.  All work has been completed in significant compliance to the Order of Conditions issued on 5-25-11.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC RC, second DB, so voted.
2.  426 Prospect Hill Street, Poltrino, (COC), SE73-1370  Field report states that this project was for the construction of a new well including excavation to connect well to dwelling and associated grading.  All work has been completed in significant compliance to the Order of Conditions issued on 11-4-99.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, MI, second DB, so voted.
3.  1156 Somerset Avenue, Dupont, (COC), SE73-1280  Field report states that this project was for the construction of a 15’ x 14’ addition to the back of an existing dwelling.  All work has been completed in significant compliance to the Order of Conditions issued on 3-31-99.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, RC, second DB, so voted.
4.  1 Ridgewood Drive, Clarewood Homes, (COC), SE73-1218  Field report states that this project was for the construction of a single family home with utilities and associated grading.  All work has been completed in significant compliance to the Order of Conditions issued on 9-3-98.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, MI, second RC, so voted..
5.  507 County Street, Lewis, (COC), SE73-1055  Field report states that this project was for the construction of additional parking at the above address.  This project was never started and needs to be closed.  MR recommends that the TCC issue a COC for this project.  Motion to approve the COC, ST, second NK, so voted.
6.  164 Dexter Farms Road, (COC), SE73-1301  Field report states that this project was for the construction of a single family home with deck, driveway, septic system, utilities, and associated grading.  All work was completed in significant compliance to the Order of Conditions issued on 5-17-99 and amended on 1-19-00.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, DB, second RC, so voted.
7.  171 E. Water Street, Braga, (COC), SE73-2393  Field report states that this project was for the construction of a single family home with garage, driveway, utilities, and associated grading within the riverfront are of the Taunton River.  All work has been completed in significant compliance to the Order of Conditions issued on 6-9-09.  Roof drains go into drywells, the lawn is stable and there is no indication of negative impact on the bank of the river.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, RC, second DB, so voted.
8.  180 Wisteria Place, Robertson, (COC), SE73-1225  Field report states that this project was for the construction of a single family home with driveway, septic system, utilities, and associated grading.  All work has been completed in significant compliance to the Order of Conditions issued on 9-25-98.  MR recommends that the TCC issue a COC for this project.  Motion to approve COC, RC, second DB, so voted.


Public Meetings
1.  830 Whittenton Street, Chevalier, (RDA), DSE-1022  Field report states that this project is for the construction of a 12’ x 14’ addition and filling approximately 580 cubic feet of a locally jurisdictional ILSF.  This ILSF is located to the right (east) of the house and from the steep slope down to the ILSF, take up a significant portion of the yard.  MR visited this property on Friday, 8-12-11.  MR observed a great deal of vegetation and no standing water.  This is most likely a small kettle hole created when ice left after the glacier retreated and then melted.  This ILSF has no significant wetland vegetation, has no wetland dedication on MassGIS, and if filled, would not negatively impact the Applicant’s property or those adjacent to the property.  The addition would be added to the rear of the house and hay bales have been added to the plan.  The hay bales would be unnecessary if the TCC approves filling the ILSF.  MR recommends that the TCC approve this project and issue a Negative Determination with the attached special conditions.  Motion to amend the filing to be specifically the addition, take out the part about the fill (that would need to be its own filing), with special conditions 1, 2, 3, 4, 18, 19, and no filling is to be done, in order to do any filling the applicant must come back before the TCC, ST, second NK, so voted.


Continued Public Hearings
1.  97 Ingell Street, Cooperative Production, Inc., (NOI), SE73-2452  No field report tonight.  Present were Timothy Darling the engineer and David Wilding the Property Manager for Cooperative Production, Inc.  Motion to approve the wetland flags as delineated, RC, second DB, so voted.  Motion to close the hearing, RC, second DB, so voted.  Motion to approve the project with special conditions 1, 2, 3, 4, 5, 17, 19, 21, 25, 26, 27, and 28- no snow in the wetland or to be stored within 25 feet of the wetland, ST, second DB, so voted.


Other Business
1.  Discussion of stamped plans.  Motion that anything greater than 200 square feet and within 50 feet of a wetland/resource area under discretion of the Conservation Agent, will require an engineered stamped plan, ST, second DB, so voted.  
2.  Televised Meetings.  Motion to televise the meetings DB, second RC  4-3 Motion does not pass.  MI and DB are in favor, feel it will educate the public.  BM not easy to find someone to run the cameras.  ST does not agree, feels there may be grandstanding.  BM said this is a relaxed environment, television will change that.  MI asked if there have been requests from the public for the meetings to be televised?  No.  
3.  36 Shore Drive.  Motion to issue a violation, the owner must appear before the TCC at the next meeting, DB, second RC, so voted.
4.  Culverts inspected.  ST wants to have MR look into how many culverts are in the city of Taunton and if possible a list of dates they were put in and if there is money in the account to hire people to go out and clean them.  Motion to first check with legal department to see if hiring an outside company would violate any contract with Veola, ST, second DB, so voted.
