11.05.12 Conservation Commission Minutes
Minutes of the Taunton Conservation Commission November 5, 2012

Present: Chair Brian Marques, Vice Chair Steven Turner, Commissioners Ernest Enos, Marla Isaac, Debra Botellio, Neil Kelly, and Renwick Chapman

Motion to approve the minutes of October 15, 2012, DB, second RC, so voted.  BM voted present.  

Certificate of Compliance
1.  9 Boxwood Way, Slater, (COC), SE732214  Field report states that this project was to regrade two areas in the backyard to create two grass swales designed to direct surface water from the foundation.  The plan also includes a 4” drain from the sump pump and roof drains to the wetland.  All work has been completed in significant compliance to the order of conditions issued on 12/12/06.  All areas are stabilized and there is no indication of siltation into the adjacent wetland.  MR recommends that the TCC issue a COC for this project. Motion to approve the COC, ST, second DB, so voted.

Public Meetings
1.  1034 Norton Avenue, Brennan, (RDA), DSE-1046  Field report states that this project is for a septic system repair to include draining, filling, and abandoning the existing leaching field and septic tank, and replacing them with a 1500 gallon tank and Quick4 Plus standard LP chambers.  Wetlands were flagged by Walter Hewitson on 9/20/12.  MR reviewed the flags and agree with their replacement.  MR recommends that the TCC approve the delineation as follows: Flags 10 through 13 with flag 9 for reference purposes only (this is a continuation of the flagging from 1022 Norton Avenue).  The only work that falls within the riverfront of the Three Mile River is the decommissioning of the soil absorption system (SAS) which is 194 feet away from the river and 65 feet from the wetland.  The new SAS will be outside the riverfront area and 77 feet from the wetland.  A siltation barrier is depicted 60 feet from the wetland at its closest.  The work as presented should not negatively impact the wetland therefore MR recommends that the TCC approve the project and issue a negative determination to include the attached special conditions.  Representative Brad Fitzgerald is for the owner.  Motion to open the hearing, ST, second MI, so voted.  Motion to approve the wetland line, DB, second MI, so voted.  Motion to approve with conditions 1, 2, 3, 4, 14, 18, 19, RC, second DB, so voted.  Motion to close the hearing, MI, second DB, so voted.

2.  68 Dunbar Street, Cabral, (NOI), SE73-2521  Representative Brad Fitzgerald.  Motion to approve wetland, ST, second RC, so voted.  Motion to approve with conditions 1, 2, 3, 4, 5, 15, 16, 17, 18, 19, 21, 25, 26, 27, DB, second NK, so voted.  Motion to close the hearing, MI, second DB, so voted.

1.  1022 Norton Avenue, Mello, (NOI), SE73-2522  Field report states that this project is for a septic system repair to include draining, filling, and abandoning the existing leaching field and septic tank, and replacing them with a 1500 gallon tank and Quick4 Plus standard LP chambers.  Wetlands are flagged by Walter Hewitson on 9/20/12.  MR reviewed the flags and agree with their placement.  MR recommends that the TCC approve the delineation as follows: Flags 5 through 9 with flags 1-4 and 10-13 for reference purposes only.  All work is outside the riverfront area of the Three Mile River.  A siltation barrier is depicted at least 30 feet from the wetland and is the limit of work.  The existing soil absorption system and septic will both be drained, filled, and abandoned.  The new system will be 51 feet from the wetland with associated grading 45 feet away.  The work as presented should not negatively impact the wetland therefore MR recommends that the TCC approve the project and issue an order of conditions to include the attached special conditions.  Representative Brad Fitzgerald.  Motion to open the hearing, DB, second RC, so voted.  Motion to approve the line, ST, second NK, so voted.  Motion to approve with conditions 1, 2, 3, 4, 5, 17, 19, 21, 25, 26, 27, RC, second DB, so voted.  Motion to close the hearing, ST, second DB, so voted.

2.  Off John Hancock Road, Henderson, Taunton Dev./MassDev. Corp. (NOI) SE73-2524  Representative Ken Motta.  Motion to continue to 11/19/12, only if all information from both sides is in by the Thursday prior to this scheduled continuance, if not the meeting will not be held, ST, second DB, so voted.

3.  18 Marvel Street, Guaranteed Builders & Developers, Inc., (NOI), SE73-2523  Field report states this filing is for the razing of an existing garage and the construction of a new, two car garage, with associated site work.  The Top of Bank (of a tributary of Cobb Brook) was flagged by Hawk Engineering on 10/5/12.  MR reviewed the flags and is in agreement with the placement-all flags were accurately placed along the top of bank which runs roughly south-north within the rear of the property.  MR recommends that the TCC approve the line as follows: flags WF1 to WF4.  This property has been in existence since 1920, prior to the Rivers Protection Act.  This means that the Commission may allow alteration of up to 5,000 sf or 10% of the riverfront area, whichever is greater (310 CMR 10.58 (4)(d)1).  The existing garage is 46 feet from the brook and is 12 x 23 (276 sf).  The proposed garage will be 39 feet from the brook at its closest point and 576 sf (24 x 24), a difference of 300 sf.  The owner has no other alternative but to expand closer to the brook rather than the house due to the decks and configuration/angle of the garage to the house.  A siltation barrier is depicted at least 26 feet from the brook and will be the limit of work.  The work as presented should not negatively impact the resource area even though the structure will be larger and closer to the brook.  In addition to the requested work, the owner may want to research cutting some of the dead pines in his yard.  These pines are tall, close to the house and may be a problem in the future.  MR is not referring to the healthy trees.  MR recommends that the TCC approve this project and issue an order of conditions to include the attached special conditions.  Tracey present for the applicant.  Motion to open the hearing, ST, second DB, so voted.  Motion to approve the line, ST, second DB, so voted.  Motion to approve with conditions 1, 2, 3, 4, 5, 8, 19, 21, 24, 27, applicant was asked to provide-detail of temporary dewatering pit, detail of siltation barrier-straw waddles, RC, second DB, so voted.  Motion to close the hearing, DB, second MI, so voted.
