Continuation Thurston Hill Blair Common Driveway Public Hearing

Public Hearing Continuation – CB Blair Builders application for a common driveway servicing 1-3 or 2-4 Thurston Hill Road
Hearing opened at 7:06pm
The question was asked at the last hearing whether the board had the authority to approve the common driveway servicing lots 2, 3 and 4 without going to ZBA for a variance. Kwesell from KP Law reviewed the plans and said that no, the board does not have this authority. Norm said that given that legal opinion, there would be no further consideration of that plan by the board.
The board reviewed the plans for the driveway servicing lots 1, 2, and 3. The board looked at the Homeowners’ Agreement (HOA). Kiritsy added the meets and bounds as requested by KP Law. Kwessel only had a few comments and they have been addressed. Tim would like a condition of approval that we have a final review from KP Law that the HOA has been corrected to their satisfaction. Norm agreed.
While Knipe (Fire Chief) was not happy with the driveway for lot 4 with this plan, it was determined that the driveway for lot 4 was not the item being discussed for today’s approval. While everyone prefers the plan for the driveway servicing lots 2, 3, and 4, it is not legal without a variance. Kiritsy believes it is unlikely a variance would be granted. The board agreed that the common driveway servicing lots 1, 2, and 3 conforms to all town bylaws and regulations.
Shawn motioned to close the public hearing. Dick 2nd, all in favor.
