Public Hearing Minutes 6/13/17
        Continuation of Glenwood Place 6 Estate Lots Public Hearing
Present: Norman Anderson, chairman; Dick Williams; Marilyn Sidoti; Shawn Moore;
Jeff Bagg (Town Planner), Tim Nahrwold (remote participation)

Continuation of Public Hearing - CB Blair Development Corp. application to create 6 estate lots on Glenwood Place
Hearing opened at 7:53pm

Tim Nahrwold was participating remotely by telephone due to being out of state.

Norm stated that the board received the Glenwood Street Extension Trust drafted by Kiritsy shortly before the meeting and did not have sufficient time to review it.  It was noted that the word Street would need to be revised to the word Place.  Norm refers to the document as the Homeowners’ Association and spoke to the importance of the document guaranteeing absolute protection for the town that the private road will be maintained for emergency vehicles to get through in years to come.  Norm would like the board to review the document and come back at the next meeting to discuss changes, if any, they would like made before submitting the document to KP Law for a second opinion. Kiritsy states he does not want to pay for KP Law. Norm will look into who legally needs to pay for the legal review of the document.  

Silvia Ruzbasan expressed concerns about the Glenwood Place extension being an illegal road. The board stated that the road is not illegal.  Tim questioned the improvements to the public part of the road. Norm stated that would be a condition for special permit acceptance.  Jeff Bagg stated that there should be a written document with the improvements agreed upon by the DPW and Blair.  The fire department was concerned having a proper turn around and about the grade of the road. It is 8.5% at the steepest portion. Norm would like them to look into putting in a fire pond. Silvia questioned how the builders could be selling lots if they have not been approved yet. Norm said, if someone buys a lot that does not get approved, they own a piece of property that they cannot build on. It is not illegal to sell an unapproved lot. Discussion ensued about the repair of the public portion of the road should it be damaged during construction.  

There was discussion as to whether the road should be maintained by the 5 homeowners on the private way or if it should be all 11 homeowners and include those on the public road. Further discussion about this will take place at a future meeting.

Resident R. Philip Laroche expressed concerns about not being able to access his property due to the ditch created during construction where his property abuts the road. Blair said he would fill in the ditch for him as long as he has permission to be on his property. Permission was granted.  

Tim moved to recess the public hearing to June 13, 2017 at 7:30pm Marilyn 2nd. Tim-aye. Norm-aye. Dick-aye. Shawn-aye. Marilyn – aye.
Public hearing recessed at 8:50pm.
