Minutes January 26, 2016

Meeting opened at 6:30pm
- Review minutes of 1.12.16
- Regular meeting minutes: Addison moved to approve with corrections, Tim 2nd, all in favor.
- Public hearing C.B. Blair/10 Naquag Street: Addison moved to approve as presented, Tim 2nd, all in favor.
- Public hearing Lussier Enterprises, LLC/Estate Lot: Addison moved to approve as presented, Marilyn 2nd, all in favor.
- Invoices: Tabled to later this evening.
- Old Business:
Item 1: 104 A and B Main Street: Chairman stated that Mr. Clealand Blair, Jr. wants to build houses on both lots. Mr. Blair went to the building inspector’s office to obtain a building permit and Will Cassanelli would not issue a permit as the driveway had not been finished.
Chairman received an email on 1/25 from Mr. Blair. Of note: The driveway exits onto Hawthorne Hill driveway which is not a town road and it appears another driveway is coming off that driveway which would equal a common driveway which would require a site plan approval. Chairman responded to Mr. Blair on 1/26/16 driveway at 104A Main expressing a number of issues that were not clear to him and offered a suggestion. He read the letter which is attached. Discussion ensued. Mr. Votruba who was present stated that if it shows probable driveway on the plan it could possibly mean proposed driveway.
Board believes they need to see a plan showing both. Mr. Blair needs to file for a common driveway and special permit. Chairman will contact Mr. Blair.
Item 2: 2 lots on the corner of Glenwood and Main Street: Mr. Blair has received an inquiry from the Bus Company to put a parking lot in (lots are in TC II District zone). It appears this is a less than desirable site for such use and could pose a detriment to the neighborhood. Discussion ensued.
6:59pm Meeting recessed for public hearing for special permit in TC district on Maple Ave./Highland Park/ J M Soucy Contracting, Inc.

- Purchase and Sale Agreement on Davis Farm:
Mr. Eric Smith, Planner, informed the Board that a response to the Selectmen is needed by 2/12/16. Addison moved that the Board notify the Board of Selectmen that the Planning Board has no interest in the Davis Property, Chapter 61A located on Main Street, Tim 2nd, all in favor.
- Brice Lemon Estates EIR (Environmental Impact Report): Response letter by Lucas Environment, LLC on behalf of Mr. Blair was referenced along with Planning Board Memo to Page Czepiga, Environmental Analyst, MEP Office, EOEEA stating that the Planning Board reviewed the EIR (EEA#13019). Any change in the water supply delivery would have to be approved by the Board of Health and the Planning Board would need to approve a set of revised definitive plans. Reference: 1/21/15 memo

- Chapter 61 Property on Route 68 lien: Chairman stated that he is not sure if this is this in Industrial Zoning. The town did not receive the proper notification. Mr. Gibbs did not present the proper document regarding the 50 foot right of way.
Mr. Smith did not find documentation in the office. He stated that he will speak with Jackie O’Brien on Monday. A re-notification will need to be sent out. The online GIS Map is outdated. (system which would show the zoning overlay). He is working with Assessors to get this rectified. Bill Scanlan was emailed today. A report to the Board will be provided. Discussion ensued.
- Attorney Kiritsy letters briefly discussed at the 1/12/16 meeting:
- Brintnal Estates Roadway: Mr. Blair would like to get the road accepted in May. Road is part of Bear Hill and part of Brintnal
- Mr. Blair may have to apply for both separately (One for Bear Hill and on for the pumping station). Bear Hill locus 2004 plan was referenced. Pumping station appears to be in Brintal and is at a right angle with no curve per Chairman.
- Could be in violation (bend in the road)
Pumping station appears to be in Brintnal and Bridge in Bear Hill.
Mr. Blair has already started work and it is an unbounded subdivision.
Chairman will send a letter to Mr. Blair stating that the Board is reviewing some aspects of the relationship of Brintanl Estates and Bear hill subdivisions.
Mr. Smith, Planner, will look at the subdivision decisions on Thursday.
Milliken Brook (lapses on 3/11/16): Mr. Blair is requesting a 2 year extension on special permit for open space. Attorney Kiritsy did not give the number of lots which is 35. . The Board has still not seen the definitive plan. The Preliminary plan is only good for so long. Anything Mr. Blair does is a major modification and will require a public hearing and extension. Zoning was referenced (violation of special permits).
Chairman will send a letter to Mr. Blair asking if he would be willing to grant an extension to 2018 and town counsel will be contacted for advice.
Nobel Hill: This is a definitive plan with 8 phases which are very detailed. Addison
moved to grant a 2 year extension, Marilyn 2nd, all in favor.
Mr. Eric Smith, Planner, will speak with Mr. Carl Hultgren, Quinn Engineering, regarding Brintnal and Bear Hill.
- By-law Subcommittee meeting: Tomorrow at 6:30pm
- Chairman informed the Board that Eric will start working on the Central Tree Sidewalks in February.
There being no further business the meeting adjourned at 9:15pm.
