RUTLAND PLANNING BOARD
MEETING MINUTES MAY 26, 2015
Open: 6:33 P.M.
Present: Chairman Norman Anderson, Marilyn Sidoti (aka Marilyn Gilman), Richard Williams, Addison Redfield
Absent: Timothy Nahrwold, Susan Ducharme
Guest: Will Cassanelli (several other guests arrived later)
- Discussion about Rte. 68 property owned by Robert Harthan and being used by others as an illegal operation. There are many violations of the use of said property and attempts are being made to stop and solve the violations. The Building Inspector, Will Cassanelli, presented a letter to be sent to the owner. We approved the letter with a slight modification.

Public Hearing minutes of 5/12/15 (Estate lot on Ridge Rd.) approved with corrections.
Public Hearing minutes of 5/12/15 (Estate Lot of David Szczurko –Maple Ave) approved with corrections.
- Szczurko special permit reviewed and approved and signed by all members present.
- Ridge Rd special permit reviewed and approved and signed by all members present. (Special note: The question of the written notice of the ZBA action on this was raised. It is felt that a notice of the ZBA action needs to be supplied and attached to the file).
- ANR plan for lot 1 on Maple Ave. presented by David Szczurko: moved to endorse by Addison, 2nd by Richard Williams—3-0) (Marilyn was temporarily absent during vote).
- Nexamp and Treasure Valley representatives presented an introduction to the proposed one (1) Megawatt solar addition at Treasure Valley. There were many questions and comments regarding the project, but most focused on the

type and amount of screening to be either left or provided. It was pointed out that most of the proposed site was quite well screened by rather large growth trees and shrubs.
- Vincent Ross, Sylvia Stachova, and Roman Ruzbason appeared to complain or question the filling, tree felling, and general land disturbances being undertaken by Martelli Construction (C. B. Blair) at the end of Glenwood Place. It was stated by the complainants that fill was being trucked onto the site by Martelli and that that fill is coming from Holden. The questions seemed to revolve around the intent of the work: trees being cut and buried under fill; is a road being constructed; what is the ultimate intent of the work; is there intent to connect Glenwood Place with Bushy Lane? It appears that all work is being done without permit(s). Richard Williams suggested that Blair may be burying wetlands. There was much back and forth discussion. Norman stressed the point that the Planning Board has little to no authority over what occurs on private land
for any personal use. The complainants were offered suggestions as to whom to call if they believe or see violations of wetland areas.
- Nexamp appeared to request the conditions of approval for the Morrow property solar farm (Golden Hills).Norm assured the Nexamp representatives that he would attempt to have a draft ready for the next meeting (June 9, 2015).
- Norman and Richard referenced DCR possibilities for future help with planning issues.
- Clealand Blair, Jr. submitted a release of covenant document to cover two (2) lots at Bear Hill II. The Board returned the document for re-submission due to errors in wording and syntax.
- There was discussion regarding our ejection and eviction from the Planning Board office. It was pointed out that the replacement space allotted to the Planning Board is smaller and just not satisfactory. Possible suggestions for solving our space problem(s) were suggested and will be further explored.
