Rutland Planning Board
Minutes
2/24/15

Present:  Norman Anderson, Addison Redfield, M. Gilman

Excused: Tim Nahrwold, Dick Williams

Guests: Cherilyn Bulger, Attorney Kiritsy and Clealand Blair, Jr.  

Open meeting: 6:31pm.

Review minutes of 2/13/15:
Addison moved to accept with corrections, Marilyn 2nd, all in favor.

Bear Hill II Bond Request from Mr. Blair at last planning board meeting:
Chairman stated that he spoke with Attorney Cranston.  Attorney Cranston spoke with Attorney Kiritsy to inform him that he needs a copy of the plan.  Board may have an answer in two weeks.

ANR – Miliken Brook/Schwartz property (Ridge Road and now on East County Road/Clealand Blair, Jr. and Attorney George Kiritsy:
Plan was reviewed.  Check for #439 in the amount of $400 was received.
Addison moved to approve, Marilyn 2nd, all in favor.  

Cherilyn Bulger/Demond Pond ROW:
Cherilyn(former Selectman) is here this evening to discuss property.  She communicated that she purchased property on Demond Pond Row (15 years ago). The road does not have frontage (never did). She would like to split property in half (sell the house she is living in and just keep the land to have a place to come to (on the other ½ of the property).  Over the years she has driven in off Irish Lane over the years over the corner that touches Demond Pond ROW.   Plan (for tax purposes only) was reviewed.  Discussion ensued to include:
  • Property owned by Mark Elbag, Jr. with a letter from Attorney Cranston stated Mr. Elbag had legal frontage.
  • Cherilyn owns 4.43 acres.
  • Plan was reviewed and discussed.  Perhaps she could speak with Mr. Elbag about purchasing a portion of land owned by him to meet the frontage requirement to apply for an estate lot.  
Cherilyn was advised to obtain a legal opinion as Board would not sign a plan without a legal opinion.

OLD/New Business:
  • Upcoming Solar public hearings on 3/10/15:
Chair suggested that the Board go back and take a look at the Treasure Valley file.
Solar bylaw and site plan approval regulations were referenced.  
  • Suggestion  was made to start a Pilot Group Committee pertaining to Solar:
Discussion ensued about hiring a professional consultant to assist the group.
Attorney Cranston agrees but also informed Chairman that a local committee should be formed to work with this person.
Committee members: Bonnie Bessie, Addison Redfield, Dick Williams and Norman Anderson and Marilyn as Chairman.   Marilyn will set up a By-law Subcommittee meeting.

  • Bylaw Subcommittee looking for articles to submit to Annual Town Meeting (3/2/15):
Committee needs to work on/look over:
  • Revisions to Dog Bylaw and write a
  • Solicitors Bylaw
  • Release of Covenant request (Olivia Lane) Central Tree Estates:
Entire subdivision was bonded however there is no release of covenant in file.
Chairman will send a response stating the Mr. Blair or Attorney Kiritsy need to be contacted for this information.  House is being sold.

  • Mylars on Brice Lemon:
Chairman will contact Mr. Blair to let him know that the mylars were never picked up from the Planning Board office.
There being no further business the meeting adjourned at 8:13pm
