Excused: Dick Williams
Guests: Mr. Mark Elbag, Julian Votruba, Clealand Blair Jr., Attorney George Kiritsy, Rick Travis (brief visit).
Open meeting: 6:30pm
- Review minutes of 1/28/14:
- Regular meeting minutes: Addison moved to approve with correction, Marilyn 2nd, all in favor.
- Demond Pond R.O.W. hearing minutes: Review next meeting.
- Update on Demond Pond R.O.W.:
A brief discussion ensued prior to tonight’s public hearing continuation.
Attorney Cranston’s (town counsel) letter was referenced.
Chairman stated that he spoke with DPW Chief who thinks the conditions are horrific and does not think any houses should be built the way it is. Chairman also went for a ride with the Fire Chief who sees this as a one lane roadway. He also spoke with the Police Chief.
Chairman stated that Attorney Cranston informed him that the Board cannot condition the special permit to upgrade the road. The road needs to be upgraded first then the applicant can come in for the Special Permit.
Board will suggestion: Applicant put on a good gravel base and decent swails with culverts at the driveways to obtain a particular width.
A brief discussion ensued with Rick Travis, Building Inspector.
Meeting recessed at 7:00pm for public hearing continuation on Miliken Brook and public hearing continuation on Demond Pond R.O.W.
Meeting reconvened at 7:26pm.
- Motion on application for estate lots Demond Pond R.O.W:
A lengthy discussion ensued. Tim moved to approve the 2 estate lots, Addison 2nd.
Board requests a letter from Mr. Elbag, Sr. agreeing to upgrade and to give specifics to improve the road prior to the sale of the first house.
Tim withdrew his motion; Addison did not withdraw his 2nd.
We subsequently did take a vote which was unanimous.
Discussion ensued. Mr. Elbag will do sufficient work on the road and will gravel and grade what’s there. He will email a letter to the Chairman before the Board writes up their conditions and findings. Board will sign the plan on 2/25 after which it will be brought to the Town Clerk (2/26). Twenty-one day appeal will begin.
Added to motion: Mr. Elbag will send proper documentation to the Planning Board to be put with the letter. Vote: 4 to 0. Accepted 2/11/14 written on the plan, all in favor.
- Moose Crossing/Mr. Julian Votruba:
Mr. Votruba presented the plan which is in the first phase. The road has been completed. He now needs to put a base coat so a transformer can be installed. Julian would like to change the two phase project to three phase. Plan was reviewed. Julian would like to build the first two houses but needs power to do so. He will open up six lots (9, 10, 11, 17, 18, 19).
Affordable house was referenced. He would like to have two lots released which is a minor addendum to the plan and he will put in a base coat.
Tim moved to endorse a minor modification to the approved subdivision phase plan, Addison 2nd, all in favor.

- Rutland Heights regarding re-zoning:
Chairman stated that he gave a copy of the form 7 to Mr. Michael Sullivan to complete with public hearing notices. Mr. Sullivan dropped it off to Anita however nothing has been filled out. Chairman spent time with Anita completing the form.
- Assessor, Alyce Johns regarding Mr. Blair plans:
Assessor, Alyce Johns spoke with Chairman. She is looking for a deed reference for Beverly Hills Drive. She asked him to look for the plan which he found.
There being no further business, the meeting adjourned at 8:30pm
