RUTLAND PLANNING BOARD MINUTES
February 28, 2012

Minutes of 2/14/12 were approved with corrections.
- Discussion (4 items) with Gary Kellaher, DPW:
- Gravel Roads Maple Ave. 4 lot subdivision/James Soucy:
Mr. Soucy got a variance to put in 4 lots instead of 2. He has decided, from a cost issue perspective, that this would not be the best thing to do as he would need to put lines in the ground first for water and sewer before the road is constructed.
- Sunnyhill Estates Subdivision Senior Housing Plan:
DCR shut down 80% of the plan which leaves only 3 units in the back corner. Gravel road (Cheryl Ann Drive) was referenced. Chairman asked Mr. Kellaher if he would accept a gravel road should there be a proposal to put on in. Mr. Kellaher said that he would accept it as long as it’s going by state specs (22 feet wide).
- Carlson’s Way:
- Mr. Kellaher stated that an apron was put at the end of the driveway which left a ¾ inch lip which poses a plowing issue. Discussion ensued.
Conditions: A letter will be sent to the Selectmen stating that the Planning Board will recommend favorably if both of the above issues are completed by town meeting. If not, the Board will not recommend favorably.
*Mr. Kellaher is not willing to accept the bridge unless Mass Highway informs him that they will accept it. He has a concern over a number of welds design (not concrete structure) and needs a letter from DOT. He is willing to meet and discuss with Mass DOT, Mr. Blair, and Mr. Quinn of Quinn Engineering.
- *Bridge at Brice Lemon was also referenced. This may have to go through Mass Dot as well. No official plans have been submitted. The Board will speak with Mr. Blair later this evening after which Mr. Kellaher will be contacted to set up a meeting.
- East County Road addition/Mr. David and Barbara Putnam:
Mr. Putnam will submit abutters list with stamped/addressed envelopes for Susan to mail. A public hearing will be set up for 3/27/12 at 6:30pm for Site Plan review. Susan will contact Mr. Putnam with date/time of hearing and will submit legal ad to Central Mass Classified and will post at town hall.
- Solar Facility on Glenwood Road/Kevin Buettel:
The process is moving on pretty quickly. Discussion ensued. Public hearing will take place on 3/27/12 at 8:00pm. Susan will have legal ad advertized, will post at town hall and will mail abutters.
- Quinn Engineering 12/5/11 Carlson’s Way $105.00
- Blair Bridges discussion with Mr. Clealand Blair, Jr. and Attorney George Kiritsy:
Discussions ensued to include the following:
- Chairman reiterated what was discussed earlier this evening with Mr. Kellaher. Once the bridge comes under town ownership it will come under Mass DOT (who provides funds for maintenance and repair at no cost to the town). Unfortunately, they will not accept the bridge because it does not meet DOT specs.
- Mr. Blair stated that his recollection is that a meeting ensued (and plans were reviewed previously) with Mass Highway. They determined, at that time, that the bridge met code. Mike Marone has written 2 reports. Mr. Blair will check to see if he has documentation from DOT. Another meeting must be set up between Mr. Kellaher of DPW, DOT and Mr. Blair to further discuss.
Tim referenced the subdivision binder and found a letter from Spaulding Assoicates. Cullinan Engineering and Mr. Marone’s stamps are on the document. Mr. Blair also stated that the bridge was designed according to structural standards. According to the initials of Steve Parker (previous planning board consultant) a book was given to Mr. Kellaher to review on 9/15/10. Mr. Blair stated that he will look into this and will get a book to him if need be.
RE: Brintnal: Tow more crossings have to be done. The bridge will have concrete arches and will be 30 feet long.
Chairman will ask Mr. Kellaher to set up a meeting with DOT.
Attorney Kirtisy will do general research and will return on 3/13 at 7:00pm to discuss internally before going to the state.
Meeting recessed for public hearing at 8:00pm (creation of an estate lot/Jim Soucy).
Meeting reconvened at 8:20pm.
