Open meeting: 6:38pm
Review of minutes from 1/24/11(special meeting) and 2/8/11 minutes:
Dick moved to approve with corrections, Tim 2nd, all in favor
Invoices:
1. Chairman received check from Mr. Clealand Blair for outstanding Quinn Engineering invoices totaling $1,312.50.
Dick moved to submit payment to Quinn Engineering, Lester 2nd, all in favor.
2. McAllister Estates: Mr. Blair will be getting money to the Board.
Release of Covenant on Lot 38 (Highlands of Brunelle East:
Chairman stated that he received a notice from Rita Kayunis regarding her house.
Apparently Lot 38 was never released. Chairman spoke with Attorney Novak and Attorney Cranston and was informed that the subdivision was accepted and that it
was okay to sign the paperwork.
Tim moved to sign and have Town Clerk, Sally Hayden, notarize the document.
Dick 2nd, all in favor.
ANR Plans
1. Paquette property, westerly side of Maple Ave. and south side of Emerald Road:
Julian Votruba is here with Jim Soucy seeking endorsement of the plan tonight. One lot is special permit (estate lot) Lot 8 (5.32 acres).
Dick moved to endorse the plan, Tim 2nd, all in favor. Check for $1,050 (#7602 received).
2. Waiver request for 24 foot wide roadway:
Subdivision Rules and Regulations were referenced (final accepted 10/12/10).
Julian plans to go to the Zoning Board of Appeals after which he will return to the planning board to request a 50 ft. right of way. This will have to be treated as a subdivision. A public hearing will be required. He will also be asking for 30 square foot lots. Chairman informed both Mr. Votruba and Soucy that they would need to obtain a letter from the ZBA prior to a public hearing. Planning Board members, Selectmen and Fire Chief, Tom Ruchala will need to be at this hearing. Discussion ensued to include:
- Apparently, Selectmen, Steve Pantos and Joe Becker like the idea but would like to see a top coat. Base would have to be up to specs.
- Sheila Dibbs, stated that Gary Kellaher of DPW wants this to be done. He thinks gravel will be okay. Town cannot touch anything past the property line, therefore,
the road would go to the property line and not be opened up until sometime in the
future.
- A program needs to be put in place for maintenance.
- Julian and Jim will work out details with Gary Kellaher.
- Plan was reviewed. Drainage still needs to be figured out.
- Lot area needs to go to ZBA first (4 lots do not meet the lot requirement and a connector road will be built).
- This would be considered a subdivision with waivers when plan comes back to the planning board. Acreage is the only thing missing.
The Board stated that they like the plan. Jim Soucy will speak with ZBA and Gary Kellaher and was asked to keep the Select Board informed as well.
Patriot Hill letter of request:
Chairman received a letter from the Selectmen stating that Maria Hopkins has requested road acceptance for Patriot Hill Subdivision for the May town meeting. Discuss ensued to include the fence issue. Will Maria assume the cost? It was suggested that Maria obtain a letter of agreement with the homeowner. Discussion ensued.
The Board has 45 days to respond. A letter will be sent to the Selectmen stating that the Board moved to accept with the condition that the right of way and fencing issue has been resolved/finalized.
Dick moved, Tim, all in favor.
Fieldstone Estates:
Chairman referenced the agreement made with Quinn Engineering about formality of their reports and timing. Discussion ensued.
Wachusett Greenways House (trying to turn house into a Welcome Center:
Discussion took place. Even though they are non-profit and do not need to comply with our zoning, they will still need to undergo a process.
Dick believes this would be a benefit to the Town of Rutland.
