Opening of meeting by the Chair: Scott Gilroy opened the meeting at 6:07 p.m.

Review and Acceptance of Minutes:
Scott Gilroy motioned to accept the minutes of October 15, 2018. Elliott Nadeau seconded. Vote was unanimous.

Health Agent’s Report
38 Brintnal Drive complaint – Karin Prucnal has abstained from this discussion.
Rich Stevens spoke about the issue that the owner of the property discussed with him. Rich has been to the property several times and is working with Clealand Blair Jr. (the builder). The owner complained that there is an odor coming from his property and suspected there to be gray water. Rich wanted to run a test to make sure the septic system (installed in 2018) to the house was not leaking so they poured dye down his toilet. No dye has appeared at all through the ground. They have been monitoring it over a month. The owner says there is still some odor. Rich spoke to Clea Blair Jr. and he had the septic installer remove yard debris and stumps that were buried on the property. Rich has since gone back out and said the groundwater appears to be clear. Rich feels the owner
needs to speak to Joe Dell’Aquila from Conservation Commission. Rich believes the work was done (removal of the tree stumps) and has done what he has requested. The groundwater may be different after 1 full season.

Public Hearing: Tobacco Control Program (Tobacco Minimum Legal Sales Age)
Present: Keith Tuttle, Rutland Pharmacy employee
No other establishments that sell tobacco products were present or delivered any correspondence to the Board. No residents attended the hearing.
The Board discussed the current tobacco regulations and how the current age limit to sell tobacco products to is age 18. There was discussion of whether to change the age limit to 21 with no clause to allow anyone under 21 but at least 18 by December 30, 2018 to purchase tobacco products.

Keith Tuttle did not have any concerns regarding the discussion. Pharmacies by law have to no longer sell tobacco products as of December 30, 2018.
Scott Gilroy made a motion to raise the legal age limit to 21 in the Town of Rutland to purchase tobacco products effective December 30, 2018. Elliott Nadeau seconded. Vote was unanimous. The current regulations will be edited and signed by the Board at the December 17, 2018 meeting.
Establishments have been contacted and will be sent the new regulations prior to December 30, 2018. They have been given new signage in relation to the new age limit. Also, a legal notice was placed in the Worcester Telegram and Gazette regarding the hearing and a summary of changes has been placed on the town website and bulletin board. The State Tobacco Control Program has also been notified of the age limit change.
New Business:
Yearly Permits
Rich Stevens is continuing to conduct all inspections related to Tobacco, Food Establishments and Milk and Cream permits.
Old Business:
Flu Clinic follow up – The Board discussed the outcome of the flu clinic. The flu clinic went very well. Sixty two adults were vaccinated and sixty two children. At this time, the Board does not plan on having any more clinics this flu season unless it is deemed necessary. Children can still be vaccinated if individuals contact the Board of Health office. Several doses of state supplied vaccine are still available. Lynn Miller will also reach out to other towns to see if they could use the vaccine.

Adjournment: Elliott Nadeau made a motion to adjourn the meeting. Scott Gilroy seconded. Vote was unanimous. Meeting adjourned at 6:50 p.m.
