Present:          Scott Gilroy, Chairman

Opening of meeting by the Chair:  Scott Gilroy opened the meeting at 6:00 p.m.

The Board of Health will be referred to as the “Board”.

6:00 p.m.

Review and Acceptance of Minutes:

Scott Gilroy motioned to accept the minutes of November 26, 2018. Karin Prucnal seconded.  Vote was unanimous.  

New Business:

Schultz Farm – Land Certificate renewal

The Board discussed the certificate renewal application.  They did not have any issues at this time.  
Scott Gilroy motioned to approve the letter to renew the certificate.  Karin Prucnal seconded.  Vote was unanimous.  

377 E County Road

Rich Stevens contacted the tenant that is living at this property.  She has applied for fuel assistance.

Correspondence reviewed as received

Charnock Hill Landfill  Third Party Inspection Report – 11/28/18

The Board reviewed the Inspection Report submitted by Mark Popham.  They did not see any issues at this time.  Scott Gilroy signed the report and it was mailed to the DEP on 12/19/18.

Community Rules for Bigelow Village

The Board received a letter from the Attorney General’s office regarding community rules for Bigelow Village.  The office also received a letter from the Department of Housing and Community Development.  Both letters have been shared with Bonnie Besse on what is expected regarding these rules.

Health Agent’s Report

38 Brintnal Drive complaint –  Karin Prucnal has abstained from this discussion.

Richard Stevens updated the Board on the status of the property issue.  Rich said the water appears clear.  The owner has hired an independent engineering firm.  He believes the builder has done everything that he has requested regarding the issue.   

Inspections/Complaints

Rich spoke with the Board about housing inspections/complaints.  Currently, when a complainant/individual contacts the office/Rich, they individual is unable to forward a fee for Rich’s inspectional services regarding the complaint/issue.  Rich’s salary is based on inspectional fees collected from applicants. Rich explained to the Board that he sometimes can spend a lot of time investigating the problem, between phone calls, going to the property (sometimes more than once) utilizing his time and personal gas.  The Board requested that Lynn contact Dan Haynes, Town Accountant to see if it would be possible to pay Rich for inspectional services out of the revolving inspectional services account.  Dan Haynes did say it was alright to pay for these special services out of the revolving inspectional services fund.  

Evan Starbard – 2019 Installers Application letter

Rich Stevens spoke to the Board about a request that the office received from Evan Starbard about his 2019 Installers Permit.  Evan received a permit for 2018 but he did not do any installations in Town due to family matters.  He is requesting the Board to carry over his permit fee from 2018 to his permit for 2019.  

Scott Gilroy motioned to approve to carry over the 2018 installers permit fee towards his 2019 permit fee.  Karin Prucnal seconded.  Vote was unanimous.

21/25 Finn Park Road ZBA applications

Rich spoke to the Board about the ZBA applications received for 21/25 Finn Park Road.  He shared his memo that was submitted from him to the ZBA with his concerns about the proposed plans to build two houses on these lots.  Septic plans have not been submitted to the Board of Health office.  

Rich Stevens availability

Rich Stevens informed the Board that he will be unable to do some of the functions of his job temporarily due to a medical reason as of February 13.  It is unclear at this time what duties he will be able to perform until after February 13 for several weeks. A Temporary Alternate Health Agent will be covering for him and doing any inspections/duties that he cannot perform during this time frame.  Contractors/Builders have been informed that he will be unavailable during this time on a limited basis and they will be able to contact the office or Alternate Health Agent as needed.

Old Business:  

Tobacco Control Program (Tobacco Minimum Legal Sales Age) – follow up

The Board members signed the new tobacco regulation approved on November 26.  The 7 establishments selling tobacco products have received their new signs and a copy of the new tobacco regulation.  Their permits have also been given to them.  

               
Yearly inspections/yearly permits

The majority of inspections have been completed and yearly permits have been issued.  Rich said the yearly inspections are going well. He will revisit several of the establishments throughout the year.  The schools have to be inspected twice a year also.

The Board signed the refuse hauler permits for Casella and Harvey.  We did not receive Republic’s application until after the meeting.  It will be reviewed and signed at the next meeting. The Board asked Lynn Miller to contact local towns to see how much they charge for a refuse hauler permit.  This will be discussed at the next meeting.

Next meeting is January 28, 2019 @ 6 p.m.

Adjournment:  Karin Prucnal made a motion to adjourn the meeting. Scott Gilroy seconded.  Vote was unanimous. Meeting adjourned at 6:45 p.m.
