Minutes

Present:          Scott Gilroy, Chairman
Karin Prucnal, Vice-Chairman

                       Randy Mizereck, Health Agent

  • Opening of meeting by the Chair:  Scott Gilroy opened the meeting at 6:15 p.m.
  • Review & Acceptance of Minutes:  Scott Gilroy motioned to accept the minutes of February 10, 2014.
Karin Prucnal seconded.  All in favor.

The Board of Health will be referred to as the “Board”.

New Business:    

6:15 p.m. Forrest Price – Update Region 2 and PHEP Public Health Issues

             The Board met with Forrest Price to review Rutland PHEP Brief report and Region 2 Scoreboard.  Attached to minutes.

6:30 p.m. 2 & 4 Campbell Street – Septic System and Well

The Board met with all parties – owners of 2 & 4 Campbell Street - (See attached list of attendees).  Julian Votruba, N.E. Environmental Design was also present.  A plot plan of 2 Campbell Street designed by N. E. Environmental Design was reviewed. Mr. Votruba stated in his opinion the cesspool does not meet Title 5 criteria.  
Both owners discussed a water sample that was taken from 2 Campbell Street by Peter Heaney.  
Randy Mizereck stated in his opinion this is a civil issue.  He says this is a legal procedure.  Peter Heaney has to prove the cesspool is his. Randy Mizereck is also concerened about the Title 5 inspection and the safety of the grandchildren that live at 2 Campbell Street. He suggested maybe having an additional water test conducted.  
Mrs. Guillotte, 376 Pommogussett Road expressed concern about safety of grandchildren.  She has spoken to a lawyer and knows she has to prove the cesspool is hers.  Mrs. Guillotte stated that her son, Steve Guillotte, 2 Campbell Street, would like to sell the house eventually.  Sandra Hume, 30 Davis Street, stated that she would like to talk with Guillotte family to make arrangements to resolve this situation.

Butch Nadeau is concerned about the safety of the grandchildren who reside at 2 Campbell Street.

Scott Gilroy stated that the Board cannot approve of any permits/licenses if they don’t know who owns the cesspool.  The group has to contact the Board once there is an agreement either through the court or outside of the court system. He stated that the Board does not have any record of a passed Title 5.  Mr. Heaney cannot sell his home if he wanted to.


Old Business:

Casella – Regarding Communication Received inquiring about Town Wide Trash & Recycling Service

        The Board discussed. Will put on the next agenda for discussion.
