MINUTES: JUNE 21, 2016

Motion to approve June 7, 2016 minutes – Motion made by Peter, seconded by Eric; vote unanimous at 7:34 PM.


Darragh Farm and Swartz Avenue – Motion to send letters to the Board of Selectmen stating not interested made by Shawn, seconded by Peter; vote unanimous at 7:50 PM.


Motion to suspend meeting to jump into Open Space Committee – Motion made by Peter, seconded by Shawn; vote unanimous at 7:54 PM. Meeting resumed at 8:45 PM.

Motion to close meeting – Motion made by Peter, seconded by Willard; vote unanimous at 8:55 PM.


Hearings  

Notice of Intent, Ronald Ernenwien, 175 East County Road

Hearing opened at 7:13 PM. Green cards received. Bruce Williams presented for the applicant. They are looking to improve the school bus yard, and add a building. There is a stream south of the property line but the work will not be done near it. Septic system is outside of the 100 foot buffer zone. There will be vegetation planted to help stabilize after the building is done. The closest point of the building to the BVW is 55 feet. They will pave to allow the buses to go to the garage. The only thing closest to the buffer zone is the septic system. Joe said they need to move their diesel system. There is to be no fuel of any kind near or in the buffer zone. Joe told him he is only bringing it up because it may hinder them with this new project. The problem is it is in the buffer zone and the magnitude of the change makes Joe think that the current placement wouldn’t be grandfathered. Joe asked when a site walk can be done and Bruce is open to when the Commission wants to go. The site walk will be 10:00 AM on Saturday, June 25th. Motion to continue the hearing until next meeting made by Peter, seconded by Willard; vote unanimous at 7:32 PM.  

Discussions
Craig Bacon, Brintnal Drive

Adding silt fencing and they are outside of the buffer zone. There is a Request for Determination and this piece of the property will be a Determination of Applicability but he will need Notice of Intent’s on other parts of the property. We will issue a Negative Determination at the next meeting.


Like Kind Soil By-law

Peter has a question about whether the threshold will be volume based or soil based and thinks we will need a lower number than 100,000 cubic feet as a trigger. Jake suggests “outside a 15 mile radius from Town”.

The board is concerned about the fueling on site. Jake suggested adding “no wet fueling on site or to have a designated area for fueling. They have a fueling pad in the buffer zone, but it should be specified that they should move the whole thing out of the buffer zone in the Special Conditions.
