Approve Minutes from November 3, 2015 – Motion made by Eric, seconded by Peter; vote approved at 7:50 PM with Nancy abstaining.

Notice of Intent, 270 Pommogussett Road
Repair of the septic system. Septic will be same spot. The leech field will be 20 x 40, and the closest point to the wetlands will be 65 feet to 70 feet, but the septic will be about 80 feet.
Gary Kelleher, DPW, Off Muschopauge Road
Gary called Joe and asked if the Conservation Commission flagged wetlands. Joe told them that we check the flags, but we don’t flag them. Gary told Joe that the Solar Committee wants to build a solar farm in town for town benefit. We can give opinions but we are not licensed to set up the flags/lines. Joe wanted to check with the Board to see if they would be willing to do a walk through and give an opinion to the solar Committee. The Board is okay with it so Joe will call Gary to set up a time and date to go look at it.
By-laws
Earthworks Board By-law
There are 3 by-laws that we are working on. The first is a by-law for an Earthworks Board. If everyone agrees with this, Peter will ship it to Margaret (town administrator) in the morning. This is solely about the Earthworks Board, and this one must happen in order for the other by-laws to be done. The only change is removing the word “approved” and replace it with the word “accepted” at the bottom of the page. Eric asked if we need to say how often they have to meet in the by-law. Shawn thinks that would be up to the Board. Adding “Meeting Frequency – the Board shall determine the frequency and times of its meeting”. This is good to go to Margaret, and Peter will forward to her in the morning.
Like-Kind Soil By-law
The second is a Like-Kind Soil by-law. The Earthworks Board is the authority for the Like-Kind by-law. Peter was unsure of the actual number that should be used for “bore samples”. Joe will research more on this. There will be 2 new sections added: “Deliveries” and “Other Fees”. We will resume review at the next meeting.
