Order of Conditions – Sondra Thomas, Turkey Hill Road – Lost originals from initial Order and never recorded.  Need to sign new Original so that they can record at Registry – Motion to sign made by Shawn, seconded by Scott; vote unanimous at 7:11 PM.

Hearings

Brice-Lemon Estates
Hearing continued from July 15, 2014.  Hearing re-opened at 7:24 PM.  Carl from Quinn Engineering reviewed the plans and revisions and discussed issues that need attention and what is not totally resolved.  Julian stated that if the water is not mapped, then it isn’t a classified tributary and DEP is requiring an Individual 401 Water Quality because of the amount of fill.  NOI’s are usually a 401 until a certain threshold is met and after that threshold is when an independent 401 is needed.  Alternative Analysis has been done already according to Julian, Marty Jablonski commented and said an Alternative Analysis was done, but it is different from a 401, but the analysis needs to be done prior to a 401, and Julian should check with him to get detailed information.  We reviewed the Quinn Engineering Report and discussed a few of the comments.

Carl said that Comment 3 – the one that was being used for recharge is no longer being used and he would like the new report to reflect that.  All areas have been moved 50 feet.  Under Comment 14 there is restoration that may be done.  Julian said this comment won’t be important because they are going into a non-disturbed area.

Comment 16 – This will be null and void when the new proposal is added.  Carl suggested that taking pictures before and after would be beneficial, and Joe said we can add that as a Special Condition with the Order of Conditions.

Comment 55 – Phasing Narrative review.  55.b – what does “near 80%” mean and at what point will they go to the next phase?  This doesn’t affect us as long as there is stability, but an answer on the definition for curiosity’s sake.


Julian said there are wetland crossings and the rule is to replicate it somewhere else on the site, which is near impossible.  They are just going to span the brook instead.  DPW doesn’t want metal culverts, they want concrete culverts.  They are not filling anything other than ORW so the span is going to help them with this.  Rebecca is concerned about getting to both sides, but the brook is narrow enough to reach one side from the other.  Eric wants to make sure we get some full-scale maps, so that we can see everything.  The small scale maps are now obsolete.  Scott agrees we need new plans.  Eric would like to understand what they are doing and believes that the full scale maps will help us.

Julian asked for a 1 month continuance on behalf of the applicant.  Joe asked if DEP was being apprised and Julian is unsure but believes that Mr. Blair and the DEP are conversing.  Joe wants to make sure that there is transparency, and would like to see this come to a close at the next meeting, if possible.  Motion to continue to October 7, 2014 at 7:15 PM made by Shawn, seconded by Eric; vote unanimous at 8:25 PM.
