Chair Smith called the meeting to order at 7:10pm.
Minutes
The Board tabled the review of minutes.
Old Business
Mrs. Sears updated the Board on the status of minor day to day business items.
New alternate member
Point of Order: Mrs. Sears left the meeting to make copies during which the Board voted to appoint Cheryl Smith as an alternate member.
MOTION by Mrs. Mooney to appoint Cheryl Smith as an alternate member for Susan Mooney, on the Nottingham Planning Board.
SECOND by Mr. Gylfphe
The Board discussed RSA 36:A-2, RSA 36: A-3, RSA 673:6, RSA 673:7, RSA 673:8. Mr. Seaverns had concerns and reviewed the RSAs, noting alternate members usually don’t tend to be specific. They also briefly discussed what an Ex-officio member was.
Ms. Smith explained that she could cover Ms. Mooney especially during the school year. The Board discussed when Ms. Smith would be allowed to be seated. Ms. Mooney and Chair Smith stated they believe that the two members of the conservation commission can not be seated at the same time. Ms. Smith explained that even though she is an alternate she will try to attend most meetings to stay updated on issues and status of cases.

Point of Order: Ms. Smith left the meeting briefly to get sworn in by the Town Clerk. Mrs. Sears returned to the meeting.
Review of the proposed Conservation Overlay District (COD)
Ms. Mooney and Chair Smith gave brief update at what happened at the public hearings. She noted that the public had concerns about: the legality of this, and that this COD was going to be mandatory, was there proper time to promote this concept with voters, as well as concerns that if this was a good thing then why not make it for the whole town.
Chair Smith noted that there may have been issues with the public if they adopt this then are they enacting or adopting SRPC district map as well. Ms. Smith explained that you make your own COD just for Nottingham and this COD is based on a compilation of information from many groups (including The Land Conservation Plan for New Hampshire’s Coastal Watershed).
Ms. Smith discussed how Ms. Bonser questioned that some residents in the white area had received letters but large land owners had not. She explained that they (Conservation Commission (CC)) had researched the procedure issue and found that the Conservation Commission did not have to bring this to the Board of Selectmen first. She noted that they had consulted an attorney and the State Conservation office that was there is no requirement for the Conservation Commission to run their business through the Board of Selectmen.
Ms. Mooney presented the maps that go with this proposal. She added that there is also input on these maps from SRPC and the community. The Board briefly reviewed the map and briefly discussed having a bonus for highly valued areas to encourage the use of COD.
The Board started its review with the draft 2008 Zoning Proposal (last amended on Jan. 22nd).
Throughout the document the Board corrected minor stylistic and grammar issues.
XXVII Conservation Overlay District
B. Propose:
The Board added “clean air” after clean water. They made a minor change to the order of the items and added the word “focus” to three areas that it was missing from. The following changes were made:
#8 Lessen air pollution and promote energy conservation, energy efficiency and other methods to reduce carbon emissions. Mr. Seaverns had concerns that this did not belong in this document it was more of a building code. Ms. Smith and Ms. Mooney noted that this was to encourage condo associations not to prohibit things like the use of clotheslines and solar panels and such like an existing development in Town already does. They explained that they were aiming for global and local environmental responsibility. At the end of the discussion they agreed to the wording above.
#9 Encourage landscaping that promotes noise reduction by minimizing the need for carbon emitting outdoor maintenance equipment. The Board discussed the wording of this topic at length and arrived at this wording. Ms. Mooney and Ms. Smith noted that these are promotions more than regulations.
#10 (moved to the new # 7) Connect habitat patches to facilitate wildlife movement and protect wildlife from the negative impacts of development.
C LOCATION: (will be moved to after Boundaries)
The Conservation Overlay District, as depicted on the map titled “Nottingham Conservation Overlay District” (dated January 14, 2008) as amended, shall be subject to the requirements of this ordinance and related regulations. This map is hereby incorporated into this ordinance by reference. The map includes conservation core focus areas and wildlife focus areas, as well as supporting landscape areas and wildlife corridor areas as defined below.
Mr. Seaverns noted that members of the public had issues with the word “subject” There was a long discussion on how to make it clear that this COD is an option for a subdivision and is not mandatory. They also need to make sure that the map is updated on a regular basis. They also need wording that is clear that this COD regulation goes with the map and vice versa. Chair Smith noted he will work on this wording and would bring it to the next workshop for input. This COD is an option to all of Nottingham and is not mandatory but is strongly encouraged; especially in those “focus” areas on the map. They noted that some “bonuses” may be given to help encourage the use of the COD in those “focus” areas. The Board will review that concept when it gets to the Subdivision
Regulations that go with this. The Board members agreed to work on possible wording of that “bonus” and bring to the next meeting.
Ms. Mooney also noted that this COD is not just for subdivisions, it was also to encourage the purchase of property to be put in conservation or for people who own property and would like to put in conservation easements.
D. BOUNDERIES: (later changed to C)
The Board referred to the existing Zoning Ordinances under Aquifer Conservation District
(Section VII, page 27 of the Nottingham Building Code and Zoning Ordinance Regulations) for proper wording and formatting. The Board agreed it would be helpful to match the existing formatting and terms. They discussed changing the order and if there was a priority to the items. Minor typos were discussed.
E. APPLICABILTY: (later changed to D)
The Conservation Overlay District may be applied to newly proposed residential subdivisions of a lot or combination of abutting lots which total twenty (20) acres or larger
F. MINIMUM DIMENSIONS: the Board left off at this item, they just changed the letter to E.
G. Areas located in the Aquifer protections District shall follow the regulations (Section VII, page 27 of the Nottingham Building Code and Zoning Ordinance Regulations (Amended 13 March 2007).
Tonight’s date will also be added on the amended dates as well.
