Draft Minutes

 

1.    CALL MEETING TO ORDERChairman Stewart called the Regular Meeting of the North Stonington Planning & Zoning Commission to order on Thursday, April 3, 2008 at 7:00 p.m. at the New Town Hall, Conference Room. 

 

COMMISSIONERS PRESENT:  G. Russell Stewart, Chairman, Elaine Boissevain, Vice-Chairman, Vilma Gregoropoulos, Secretary, Louis Steinbrecher (arrived at 8:30 p.m.), Joseph Siner and Alternate Members Susan Grufstedt (arrived at 7:02 p.m.), Duncan Schweitzer and Ann Brown     

    

COMMISSIONERS ABSENT:  None

 

 STAFF PRESENTAdministrative Assistant Cheryl Konsavitch, P&Z Attorney Michael Carey and Contracted SCCOG Planner, Jamie Rabbitt

3.  PUBLIC COMMENT:    

 

Nita Kincaid reminded the Commission about the upcoming Energy Fair.

 

A.  PUBLIC COMMENT REGARDING PROPOSED REVISIONS TO ZONING REGULATIONSNone

 

MOTION by V. Gregoropoulos, SECOND by J. Siner to go into Executive Session to discuss pending appeal of Garden Court at 7:10 p.m.  MOTION CARRIED UNANIMOUSLY.

 

 

 

 

5.  EXECUTIVE SESSION:

 

The Planning & Zoning Commission to discuss pending appeal regarding RC #07-060 and ZC #07-061 (Garden Court L.L.C.)

Present:  R. Stewart, E. Boissevain, V. Gregoropoulos, J. Siner, S. Grufstedt, D. Schweitzer, A. Brown, Atty. Carey

 

MOTION by V. Gregoropoulos, SECOND by J. Siner to come out of Executive Session at 7:20 p.m.  MOTION CARRIED UNANIMOUSLY.

 

The Commission discussed the pending appeal regarding RC #07-060 and ZC #07-061 and no action was taken.

7.  COMMISSION REVIEWNone 

 

8..  PENDING APPLICATIONS:

 

SUB #07-156 (Babcock Ridge Subdivision) Application of Concord Equity Group, L.L.C., c/o Dana Barnes, 16 William F. Palmer Road, Moodus, CT  06469 for a 9-lot subdivision, property of Heirs of Thurman Main for property located on Babcock Road, North Stonington, CT  06359.  Map #110, Parcel #3901      (PH closed on 3/13/08 (extension granted); Commission received on 10/11/07 & Commission must act on or by 5/17/08)

 

Seated:  R. Stewart, V. Gregoropoulos, J. Siner, E. Boissevain, A. Brown seated for L. Steinbrecher

 

The Commission deliberated on this application.

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to table SUB #07-156 to 4/10/08.  MOTION CARRIED UNANIMOUSLY.

 

9.   NEW APPLICATIONSNone 

 

10.   SENIOR PLANNING & ZONING OFFICIAL’S REPORT/ISSUESNone 

 

11.  NEW BUSINESS:  

 

Bond request release for SUB #06-017 (Shunock River Estates) Application of Joseph Mascaro, Raymond Trebisacci, Stephen Reck & Steven Bossie, 53 Oshwigochie Hills Road, Niantic, CT  06357 for a 5-lot Subdivision on property located at 126 Babcock Road from the intersection of Wyassup Road and Babcock Road, 1 mile east on Babcock.  The property is on the south (right) side of Babcock Road.  Tax Map #110/2742, Lot #31/8197 for the release of the $3,090.00 for monumentation and $19,800.00 for Erosion & Sedimentation Control. 

 

The Commission discussed this request and has not gotten a report yet from the Town Engineer, Pat Lafayette on a final inspection.  The Commission also discussed the Open-Space dedication and the Conservation Easement violation.

 

The Commission tabled until 4/10/08.

 

11. OLD BUSINESS

 

SPEC #07-005 (Special Permit) Application of Kidds & Company, L.L.C., 172 Providence-New London Turnpike, North Stonington, CT  06359 for an approved Child Daycare Facility on property located at 172 Providence-New London Turnpike, located about ¼ mile west of Route 2 rotary, North Stonington, CT  06359  Tax Map #121/2741, Lot #25/7483  to discuss landscaping.

 
Mr. Richard Ponzo and Ms. Christine Hare of Kidd’s & Company came before the Commission to discuss changes to the landscaping for an approved Child Daycare Facility.  Staff will review and table until 4/10/08.

   

12.  PLANNING ISSUES & DISCUSSION:      

 

A.  Avalonia Land Conservancy/Shunock River Estates

 

No discussion on this item.

 

B.  Zoning Regulation Discussion

 

Mr. Rabbitt discussed the working drafts of the proposed regulations and distributed Sections 600 to 1000 to the Commission for their review.

 

MOTION by V. Gregoropoulos, SECOND by L. Steinbrecher to amend the agenda to move Item C as last on the agenda.  MOTION CARRIED UNANIMOUSLY.

 

13.  CORRESPONDENCE   

 

The Commission went over the correspondence in their packets. 

 

14.  REVIEW MINUTES:     

 

Review minutes of Regular Meeting of 4/03/08

 

MOTION by V. Gregoropoulos, SECOND by J. Siner to approve the regular meeting minutes of 4/03/08 with the necessary corrections.  MOTION CARRIED UNANIMOUSLY.

 

12.  PLANNING ISSUES & DISCUSSION:      

 

C.  ZEO/Planner position Applicants/Applications:  Possible Executive Session for ZEO/Planner position and consideration and discussion of applicant’s & applications for ZEO/Planner positions.

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to go into Executive Session to discuss the ZEO/Planner position applicants.  MOTION CARRIED UNANIMOUSLY.

 

Present:  R. Stewart, E. Boissevain, V. Gregoropoulos, L. Steinbrecher, J. Siner, D. Schweitzer, S. Grufstedt, A. Brown, Ex-Officio member Nicholas Mullane, 1st Selectman and Contracted SCCOG Planner, Jamie Rabbitt

Mr. Rabbitt was called into the Executive Session at approximately 9:10 p.m. to give his views on the candidates and stayed for the remainder of the session.

 

The Commission discussed the candidates they interviewed.

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to come out of Executive Session at 10:30 p.m.  MOTION CARRIED UNANIMOUSLY.

 

No action was taken in the Executive Session.

 

The Commission resumed discussion of the candidates and it was agreed by consensus to offer the position to Candidate 1 with Candidate 2 being a back up if Candidate 1 declined the job offer. 

 

It was agreed that Mr. Mullane would contact Candidate 1 and offer her the position and find out if she was going to accept the job before the other candidates were contacted about the results, in case she declined.

 

MOTION by L. Steinbrecher, SECOND by V. Gregoropoulos to amend the agenda to discuss zoning enforcement duties.  MOTION CARRIED UNANIMOUSLY.

 

L. Steinbrecher stated he is unable to keep reviewing applications for Single-Family homes.  A. Brown, D. Schweitzer and J. Siner all volunteered their services.

 

15.  ADJOURNMENT:

 

MOTION by V. Gregoropoulos, SECOND by E. Boissevain to adjourn the meeting at 10:40 p.m.  MOTION CARRIED UNANIMOUSLY.
