Members Present: Chairman David Craig, Vice Chairman Harry Piper, Greg Mattison, Ed DiPietro, Chris Golomb, Laura Todd, clerk, (Bob Todd asked permission to attend the Master Plan meeting because there were 5 voting members of the ZBA present, Dave granted permission)
Dave Craig opened the meeting @ 7:02 PM, minutes from the previous meeting were approved by Dave and 2nd by Chris, unanimous.
Caroline Benner, 127 Bog Brook Road, Map/Lot 9/32-2, application for an “Equitable Waiver of Dimensional Requirement” regarding a deck built within the 20” side setback line.
Dave introduced the application and asked the applicant to speak.
Ms. Brenner explained her son and friends built the deck 1.5 – 2 yrs ago. At the time the corner marker was covered with debris, so they were not aware they were within the 20’ setback line. They also were not aware a building permit was needed.
Harry noted the dimensions of the lot, saying that there is no problem with site distance.
Dave and Harry discussed how much of the deck was actually encroaching and determined it was a 5’ triangular portion. It was also noted that the closest abutters lot was wooded and the deck was not visible during the summer, and only slightly during the winter.
The board discussed the letter from the abutter(s) regarding their concern that the deck not be enclosed and made into a 4-season addition. It was decided that if that would be done a building permit would be required and it was not necessary for the board to address that issue.
Craig reviewed the criteria as written by the applicant. He asked that the abutter’s letters be noted as not opposed to the application.
Greg Mattison made a motion to approve the application with the condition that she apply for an as-built from the building inspector for the deck. 2nd by Harry, passed unanimously.
Greg made a motion to adjourn @ 7:15PM, 2nd by Harry.
