Board of Selectmen Minutes 10/13/2009

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian W. Stowell.   

Robert Spain, Town Manager, Brian Turbitt, Finance Director, Anna Lewandowski, Ron Bordeau,  Donna Boynton, Telegram & Gazette, Tom Reilly, The Millbury-Sutton Chronicle, and concerned citizens

Chairman Plante opened with the Pledge of Allegiance

Finance Director, Brian Turbitt, spoke regarding the Red Flag Policy that he is looking to put in place to prevent identity theft.  It incorporates Aquarion Water’s policy so that they can work together.
Motion made by Selectman Coggans to adopt the policy, seconded by Selectman Stowell.
Motion carried unanimously.

Selectmen Appointments
Motion made by Selectman Schold, seconded by Selectman King to appoint the following individuals to the Energy Advisory Committee:  Bob Blackman, Laurie Connors, Brad Turner, Rick Bedard, Brian Stowell, George D’Auteuil, Jim Dunn and John McGarry.
Motion carried unanimously.

Motion to appoint Armand White to the Historical Commission by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.

Motion to appoint Sgt. Mark Moore and Sgt. Stephen McFaul as Liquor License Agents made by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.

Motion to appoint Harold Proodian to the Millbury Affordable Housing Trust made by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.


One Day Liquor License-Bicentennial Committee
October 24, 2009 at Asa Waters.
Motion to approve the one day license made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

One Day Liquor License-Charles F. Minney VFW Auxiliary
September 27, 2009 at VFW Post Pavilion.
Motion to approve the one day license made by Selectman Stowell, seconded by Selectman King.
Motion carried unanimously.

New Drainlayer:  John Magill, Jr., Grafton.  Has a job on Greenwood Street.
Motion made by Selectman Schold, seconded by Selectman Coggans.
Motion carried unanimously.

Previous Meeting Minutes
Motion made by Selectman Schold, seconded by Selectman Coggans to approve the minutes of the Tuesday September 22, 2009 meeting.  
Motion carried unanimously.

Motion made by Selectman Coggans, seconded by Selectman Schold to approve the following minutes of the Executive Session meetings:  July 26, 2005, July 12, 2005, January 10, 2006, January 24, 2006, March 11, 2008, March 25, 2008, May 13, 2008, June 10, 2008, August 12, 2008, September 23, 2008, October 28,2008, December 9, 2008, February 10, 2009, February 17, 2009, April 6, 2009, May 26, 2009, July 14, 2009, September 9, 2009.
Motion carried unanimously.

Town Manager Report:
Appointments:  Mr. Spain has reappointed the following:
Motion made by Selectman Stowell to concur with the reappointment of Glenn Hand as the Assistant Building Inspector, seconded by Selectman Coggans.  Motion carried unanimously.
Motion made by Selectman Stowell to concur with the reappointment of Mary Griffith to the Asa Waters Task Force, seconded by Selectman Coggans.  Motion carried unanimously.
Motion made by Selectman Coggans to concur with the reappointment of Roy Ahlen, Roger Thornberg and Richard Clark to the Ponds & Lakes Commission, seconded by Selectman Schold.  Motion carried unanimously.
Motion made by Selectman Stowell to concur with the appointment of Edd Cote to the Bicentennial Committee, seconded by Selectman Coggans.  Motion carried unanimously.
Motion made by Selectman Stowell to concur with the reappointment of John Caron to the Cultural Arts Council, seconded by Selectman Coggans.  Motion carried unanimously.

Friday, November 6, 2009 will be Student Government Day.

Mr. Spain would like to thank the Youth Group from St. Brigids Church for fixing the shed at the cemetery.  It really looks great.

National Grid will be doing some construction from October 2009 to February 2010, they are updating their transmission lines.

There has been some vehicle movement.  The plates were returned on the grader, the town manager’s car was totaled, we are getting rid of white sewer vehicle, the 2007 crown vic will be the sewer dept car, and one old cruiser will be sold.


Legislature passed a conflict of interest law- each year has to receive a summary of the ethics law.  Each new employee needs to get it within 30 days.  It is required by April 2, 2010 everyone has to take online training and every two years, the Town Clerk will keep track of it all.
There will be changes to the open meeting law but this doesn’t start until July 1, 2010.  Specific requirements in reviewing exec session minutes, they have to be reviewed every 30 days for release.

Mr. McGarry supplied answer Selectman Coggans wanted regarding the Sewer expansion on Riverlin Street; the cost to hook up the remaining houses would be 1.3 mil.

Thank you to all the donations to the Marines serving at Camp Leatherneck in Afghanistan.

Mr. Spain will be on vacation from Saturday, October 17 - Saturday October 24, 2009- Chief Handfield is acting town manager.

John McGarry, DPW Director-explained how “the list” works.  Will be making monthly calls to the citizens who are on the list to explain when their work will be done.  *see attached.

Selectman King wanted to know about Wedgewood Dr., sidewalk bids, snow plowing.  He didn’t see a lack of help.  

Citizen Speak:
Anna Lewandowski spoke to caution the Selectmen from accepting open space-some have retention/detention ponds.  Caution on accepting land with those ponds.  

Mail:
Thank you from Helen Collette’s family for presenting Mrs. Collette with the Boston Post Cane Plague.  

Mary Krumsiek spoke regarding the chain of lights.  It will be held on Dec. 6th - there will be no charge for businesses this year.

New Business:
Selectman King made a motion to have the Town Manager look into different options for the transfer station and bring a report to the Selectmen within 6 months, seconded by Selectman Coggans.
Motion carried unanimously.

Selectman Stowell wanted to let everyone know that the Habitat for Humanity project is going on right now at 41 MacArthur Drive.  He also wanted to thank everyone who has helped so far, but they are still looking for more donations.




Citizen Speak:
Ron Bordeau-118 Grafton Street, Autumn Gates.  He does not want to be forgotten. There are bond issues and it is in litigation; we can’t speak about it.  


Executive Session
Motion made by Selectman Coggans, seconded by Selectman King to move into Executive Session at 8:30 p.m. under Chapter 39, Section 23B, Paragraphs 2 to discuss deployment of security personnel and 3 to discuss collective bargaining or potential litigation.

Chairman Plante stated that the Board will leave Executive Session solely to adjourn; no other business will be conducted.

The Board returned to open session as 9:30 p.m.
