Present:  Board of Selectmen:  E. Bernard Plante, Chairman; Joseph F. Coggans, Jr., Kenneth Schold, Francis B. King and Michael Moore.  

Richard Handfield, Acting Town Manager, Attorney Mark Zarrow, Bernice O’Gassian, Nicole Smith, John McGarry, Edward H. Massei, Jr., Tom Riley, Millbury Sutton Chronicle, Donna Boynton, Telegram & Gazette, and concerned citizens.
Vacation:  Town Manager, Bob Spain

Chairman Plante opened the meeting with the Pledge of Allegiance.


CLASS I LICENSE:   Edward H. Massei, Jr.-147 North Main Street-Scooter Sales
Motion made by Selectman Coggans, seconded by Selectman Schold to approve the license of Millbury MotorSports with conditions set forth by the Millbury Board of Appeals.
Motion carried unanimously.

DRAINLAYERS LICENSE:-Ronald Knapik- Knapik Builders-Grafton, MA
Motion made by Selectman Coggans, seconded by Selectman Schold to approve the Drainlayers license of Ronald Knapik.
Motion carried unanimously.

ONE DAY LIQUOR LICENSES
Cardoos Gourmet Caterers-Asa Waters- October 25, 2008.
Motion made by Selectman King, seconded by Selectman Schold, to approve a one day liquor license for Cardoos Gourmet Caterers on October 25, 2008.
Motion carried unanimously.

SIGN STATE WARRANT:  
Motion made by Selectman King, seconded by Selectman Schold to sign the state warrant.
Motion carried unanimously.

SIGN U.N. PROCLAMATION:  
Motion made by Selectman Schold, seconded by Selectman Moore to sign the U.N. Proclamation.
Motion carried unanimously.

DPW DIRECTOR JOHN J. MCGARRY, P.E.:  
Progress on sewer construction:   He is pleased to announce the completion of Lake Singletary and Laurel Heights areas.  They are prepared to allow customers to tie in, 274 homes are included; West Main Street from 162-276, Harris Avenue, Budrow Road, Singletary Road, Brenda Drive, Hemlock  Drive, Sutton Road, Laurel Drive, Juniper Drive, Ridgewood Drive, Birchwood Drive and Oakview Drive.
Thank you to the citizens for their patients during the construction.  People can go to website to find out how to tie in or call Fran Pearson in the Sewer Dept office.

Park Hill Avenue project- They are preparing to put down binder pavement and dig trenches.   Tie in’s will not be available until spring.

Grafton Road construction area--they have not been working for a few weeks on Grafton Road because they had a contamination issue they moved to Oak Street -will begin working on Grafton Road again-hoping to get off by the middle of November.  They will get back to Oak Street as soon as possible to complete their project.

Bridge on McCracken Road-completed installation of Steel Guardrails on west bound side and will install more jersey barriers in the east bound lane.  Will appear before Conservation Commission to remove stone wall abutment-wants to remove overburden weight-will begin process to budget for 2009-will talk to road advisory committee for funding and solutions.

Drainage for Stowe Road--found a detailed design which was prepared in 2000.  FedCorp offered to install a drainage system for about $114,000.00.  We do not have funding for that right now-will look to the road advisory committee.  Bob Murray and Mr. McGarry came up with the idea to install steel guardrails to secure that road and make it safer for this winter.  Have to decide to go Chap 90 route or fund it ourselves.

Selectman King wanted to know why they were not going with riprap.  Just the pipe alone would be $8,800 and would have to rent the excavator and get the stone.  They could not come up with the material right now.  How much of the road will we be losing by putting up guards and riprap?  It will be 19 feet-might have to talk to the chief to lower speed limit on that road.    Will you put up signs at each end of the road to let people know?  He will ask for a permit.  Selectman Coggans suggested asking the Cronin Brook people to get the riprap from them-the developer said they were not selling it.
Motion from Selectman Schold, seconded by Selectman King to put up guardrails on Stowe Road.
Motion carried unanimously.

HEARING:  Belfont Hotel-Hearing on Serving Minor
Selectman Moore - recused himself as his brother was the arresting officer.
Attorney Mark Zarrow represents Bernice O’Gassian.
Chief Richard Handfield read into record the police report (see attached report).  Attorney Zarrow admits it is the responsibility of the bar owner.  There is a video camera in the bar-there is no physical contact.  Nicole Miller worked with Jacqueline  Zocco-when was trained as a bartender by Jacqueline Zocco-The bartender believed she was 23 years old from having worked with her in the past.  All of the bartenders have been certified- Nicole has been terminated at the bar.  There is a strict rule that everyone present identification before being served. They took steps to correct this problem so that it never will happen again.
Selectman King is bothered that the bartender was untruthful to the police but looks as if they have corrected the problem in their terminating her.
Selectman Coggans commends the owner for terminating the bartender and made a motion to suspend license for three days, but with a suspended sentence of one year, seconded by Selectman King.
Motion carried unanimously.

Selectman Moore reentered the room.

TOWN MANAGER REPORT:
Acting Manager Chief Handfield read a memo from Robert Spain to appoint new Finance Director-Brian Turbitt.  
Motion made by Selectman Schold to ratify and sign agreement, seconded by Selectman King.  Motion carried unanimously.

Appointment of Tom Brown to Disabilities Commission:
Motion made by Selectman Moore to appoint Tom Brown to the Disabilities Commission, seconded by Selectman Coggans.
Motion carried unanimously.

Cronin Brook- all lights are on!

Private street billing- has been billed but not collected--We hope that the new DPW director gets a handle on this.

Blackstone Valley Regional Economic Development Council-Sign participation agreement.
Motion made by Selectman Moore to sign participation agreement, seconded by Selectman Schold.
Motion carried unanimously.

MAIL:
Letter from Edward Augustus-regarding State funding going down the tubes.
Governor will announce budget cuts tomorrow.  We will probably not get level funded next year.  Chairman Plante said that we will need to look at any dime we are going to spend.

Resignation of Donna Sousa-effective September 29, 2008 from the Millbury Library Trustees-no longer has time to devote to the Board.

OLD BUSINESS:
Chairman Plante has public safety concerns on West Main Street, Canal Street.  He is happy that we have low gas prices but it is causing traffic concerns.  Also there are cars parked on West Main Street for that auto repair garage.  The Chief will look into these concerns.
