Board of Selectmen Minutes
Municipal Office Building – Selectmen’s Meeting Room
May 26, 2009                                                                    7:05 p.m.


Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian W. Stowell.   

Robert Spain, Town Manager, Edd Cote, Tom Reilly, The Millbury-Sutton Chronicle, and concerned citizens

Chairman Plante opened with the Pledge of Allegiance

Chief Handfield spoke regarding the Bureau of Justice Asst. Grant.  The Millbury Police Dept was granted $27,890 to be used with restrictions.  $9,680.60 to project DREAM; $10,752.40 for (RAD) Rape Aggression Defense Training program; $7,454 left over going to reinstitute the bike patrol for more exposure in the center of Town and the mall.  
He has also applied for COPS Hiring Recovery Grant for three officers.  He will probably hear about this in September.  Chairman Plante does not want to hire any new officers if the grant does not cover their whole salaries and benefits.  It is one thing to fill vacant positions, he will not support any increase.

Finance Director Brian Turbitt- He needs authorization for the Manager to sign the three pieces of the FEMA grant from the ice storm of December 11, 2008.  1st project-cleanup-FEMA estimated $10,560 of which 75% is $7,920.00, 2nd is emergency services during 72 hr period $20,101.38 of which FEMA will pay $15,076.04 and the 3rd  is  insurance deductibles for town property damaged- two vehicles and the school backstop was damaged.  The amount submitted was $2,000.00 of which FEMA will reimburse $1,500.00.  The total that was originally submitted was $32,661.38-that does not include the work that in ongoing now. The grant money that we will be getting is $24,496.04.  We will continue to be reimbursed the remainder of $18,000 which brings the total that we will recoup from FEMA to a little over $42,000.00.
Motion made by Selectman King, seconded by Selectman Schold to allow the manager to sign the grants and associated paperwork.
Motion carried unanimously.

FTC Red Flag Policy Draft-it is designed to protect the town against identity theft-only account that it could affect is the sewer account.  Worked very closely with Aquarion and they have a very thorough policy.  Two online payment systems MCC and Unipay-MCC has submitted their policy and they are in compliance.  Waiting on Unipay.

Motion made by Selectman Coggans to approve the license, seconded by Selectman Schold.
Motion carried unanimously.

REAPPOINTMENTS:  
Board of Appeals-Paul Nigosian, Daniel Mezynski:
Motion made by Selectman Coggans to reappoint Paul Nigosian and Daniel Mezynski to the Board of Appeals, seconded by Selectman King.  Motion carried unanimously.
Earth Removal Board-Tom Brown-Motion made by Selectman Coggans to reappoint Tom Brown to the Earth Removal Board, seconded by Selectman Stowell.  Motion carried unanimously.
Butler Farm Re-Use Committee-Francis King, Norman Gonyea:
Motion made by Selectman Coggans to reappoint Francis King and Norman Gonyea to the Butler Farm Re-Use Committee, seconded by Selectman Schold.  Motion carried 4-0-1 (Selectman King abstained)
Board of Fire Engineers-Marc Auclair:
Motion made by Selectman Coggans to reappoint Marc Auclair to the Board of Fire Engineers, seconded by Selectman Schold.  Motion carried unanimously.
Central Mass. Metropolitan Planning-Francis King
Motion made by Selectman Coggans to reappoint Francis King to the Central Mass. Metropolitan Planning Commission, seconded by Selectman Stowell. Motion carried
4-0 1.Selectman King abstained.
Central Mass. Regional Planning Commission- 2nd delegate-Francis King, Alternate- Bob Spain.  Motion made by Selectman Stowell to reappoint Francis King and Bob Spain to the CMRPC, seconded by Selectman Coggans.  Motion carried 4-0-1.
Special Police Officers:  E. Bernard Plante, Joseph Coggans, Kenneth Schold, Francis King, Brian Stowell, Robert Spain, Patricia Rutherford, Sheryll Davis, Lori Prue, Patricia Gibson, Fred McConaghy, Gerard Kelly, Timothy O’Leary, Douglas Raymond, Paul Russell, Arthur Allard, George Valery, William Wilkinson, Ronald Richard and Richard O’Brien.  Motion made by Selectman Schold to reappoint the Special Police Officers, seconded by Selectman King.  Motion carried unanimously except on Paul Russell, Selectman Coggans abstained.
Millbury Affordable Housing Trust- Janet Cassidy.  Motion made by Selectman Coggans to appoint Janet Cassidy to the Millbury Affordable Housing Trust, seconded by Selectman Stowell. Motion carried unanimously.
Kopelman & Paige:  Motion made by Selectman Coggans to reappoint Kopelman & Paige, seconded by Selectman Schold.   Motion carried unanimously.
Mirick O’Connell:  Motion made by Selectman Coggans to reappoint Mirick O’Connell, seconded by Selectman Schold.   Motion carried unanimously.

Vacancies announced and would like people to join: Board of Appeals Alternate; Cemetery Commission; Fair Housing Committee/Local Housing Partnership; Historical Commission; Industrial Development Finance Authority; Millbury Affordable Housing

Town Planner Laurie Connors-She applied for a memorial on behalf of the Town -met with Veterans Council.  They agreed that they should apply for the memorial, but did not agree with placement on town hall grounds.  2nd suggestion was town common but historical commission did not agree it should be on the common, 3rd suggestion was the library; librarian was not for the idea of it on the library grounds.
Motion made by Selectman Schold to place the memorial on Town Hall grounds and have the Chairman sign a letter of support seconded by Selectman King.
Motion carried unanimously.

Town Manager Report
We have set a second town meeting for June 23 at 7:00 p.m.  

We have to pay an Aquarion bill from ‘07 and ‘08 as there was an issue regarding who owned the hydrants-the amount is $567.19.

Mr. Spain explained revolving accounts and what their uses are.  

We need to call a special meeting to close the warrant.  Motion made by Selectman King to hold a special meeting on June 8 at 5:15 p.m. seconded by Selectman Schold.
Motion carried unanimously.

There was damage to town property due to the hail storm on Sunday, May 23, 2009.  The DPW, Fire, Police, and National Grid-all did a great job.  

National Grid will be doing a project to replace fixtures from June to Sept.

Motion made by Selectman Coggans to concur with the above reappointments, seconded by Selectman Schold.
Motion carried unanimously.

Old Business/New Business
Chairman Plante wanted to thank Ray Tremalay Jr. of Central Mass. Power Washing for cleaning the civil war monuments and WWII monuments for Memorial Day.

Bob wanted to acknowledge the Friends of Asa Waters who kept the war memorial looking so nice and working so hard.

Selectman King wanted to thank Steve Sharon for tilling the gardens at Butler Farm.
Motion to approve the minutes of the May 12, 2009 meeting made by Selectman Schold, seconded by Selectman Coggans.
Motion carried unanimously.

Citizen Speak
Anna Lewandowski-wanted to know who appoints the Asa Waters Task Force.  They are appointed by the Town Manager.

Executive Session
Motion made by Selectman Coggans, seconded by Selectman King to move into Executive Session at 8:20 p.m. under Chapter 39, Section 23B, Paragraph 4 to discuss deployment of security personnel or devices.

Chairman Plante stated that the Board will leave Executive Session solely to adjourn; no other business will be conducted.

The Board returned to open session as 9:04 p.m.

Motion made by Selectman Coggans, seconded by Selectman King to adjourn at 9:05 p.m.  Motion carried unanimously.
