Board of Selectmen Minutes 11/08/2011
November 8, 2011                                                                        7:10 p.m.

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Francis B. King, Kenneth I. Schold, Brian W. Stowell, Brian M. Ashmankas; Town Manager Bob Spain, Finance Director Brian Turbitt, Edd Cote, Susan Spencer-T&G, Steve Balestrieri, Tom and Taylor Trone, Attorney Gerry Caruso, Jairo Bicalho, Mr.&Mrs. Kevin Butler and concerned citizens.    


7:00 pm—Public Hearing for Tax Classification Continued- Still waiting for numbers from the State.  Need to continue until November 22nd but will more than likely take a special meeting on or about December 6th.
Chairman Plante mentioned that we could have a cash flow problem if we cannot get the bills out on time.  
Motion to continue hearing to November 22nd made by Selectman Stowell, seconded by Selectman King.
Motion carried unanimously.


7:15 Wine Nation: Public Hearing notice read into record by Selectman Schold.
Attorney Gerry Caruso appeared for Wine Nation.  We have received the Legislation to grant the all alcoholic beverage liquor license at the Shoppes at Blackstone Valley.  The family would like to thank the town and the Selectmen for all they have done.
Motion to close public hearing made by Selectman King, seconded by Selectman Stowell.
Motion carried unanimously.
Motion to approve the Form 43 made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

Winter Parking Ban- Read by Selectman Schold: there will be no parking allowed on any Town road after the accumulation of two inches of snow-exception:  parking is allowed on the north side of West Main Street between Gould Street and Waters Court.
Motion made by Selectman Schold to approve the Ban, seconded by Selectman Ashmankas.
Motion carried unanimously.


Holiday Liquor license hours-pouring establishments only can stay open until 2:00 a.m. the Wednesday before Thanksgiving.
Motion made by Selectman King to approve the extension, seconded by Selectman Ashmankas.
Motion carried unanimously.

Appointment of Philip Miles to the Historical Commission made by Selectman King, seconded by Selectman Stowell.  Motion carried unanimously.
Chairman Plante said that he will make a fine addition to the commission.

Mary Krumsiek spoke regarding the Chain of Lights which will be held Sunday, December 4th from 11:00 a.m. - 4:30 p.m.  Thank you to Judy O’Connor and her staff for all their help.


Previous Minutes:  October 25, 2011
Selectman King asked about the Riverside issue mentioned at the last meeting.  It is a work in progress and Riverside is working on the issues.  There is a little disagreement about what the gentleman wants and what the architect at Riverside wants.
Motion made by Selectman King to approve the minutes, seconded by Selectman Ashmankas.
Motion carried unanimously.



Town Manager Report
Storm update-Mr. Spain wants to thank the DPW and EMA clearing the ways for the emergency vehicles and the plows.  Cleanup operations are still ongoing.  The brush dump is open 24-7 at the highway garage on Providence Road.  He will be doing an after action review with key department heads.  He was very disappointed with National Grid-their communication and reaction was abysmal.  It took a lot longer than it should have and they should have had more workers available.  Selectman King wanted to mention that trees in wires should never be touched.  The DPW made the right decision for not touching a downed tree that was in wires.  

Chairman Plante read a statement about National Grid and their poor response and miscommunication to the town.  We are going to start looking into our own town power company.  

7:30 pm- Integrity Motors hearing notice read into record by Selectman Schold.
Jairo Bicalho spoke regarding the taxes.  He was under the impression that the landlord was paying the taxes.  Selectman Stowell spoke regarding the seven pages of police complaints and customer complaints that this Board is not happy about.  He is trying to do better business.  Selectman Stowell said that it is unacceptable to have the police tied up 30-40 times within three years.  Mr. Spain said that there are more complaints for Integrity Motors than all the other Class I and II licenses in Town.  Mr. Spain recommends revocation of license.
Mr. Bicalho pleaded with the Board not to revoke the license; it is his only income for his family.  Chairman Plante said that he finds it difficult to support a business with so many complaints about it.  
Motion to revoke the license made by Selectman Stowell, seconded by Selectman Schold.
Motion carried unanimously.
Motion to close hearing made by Selectman King, seconded by Selectman Stowell.
Motion carried unanimously.


Mr. Spain wanted to say that Veterans Day is Friday, please thank a veteran and remember what they have done for us.


On a Good Note
Chairman Plante mentioned the dedication of a portion of the bike path to Former Selectman and Former State Representative Richard Dwinell last Friday.  He kept his integrity and it was a pleasure to recognize this well deserving man.

The brush dump at the Highway Garage is open 24/7 until November 27, 2011.

Citizen Speak
Kevin Butler-27 West Main Street is looking for information on the 146 interchange plan.  State surveyors are looking for access to his property.  Rob McNeil met with DOT in Boston on October 13th.  They have looked at conception ideas.  The design public hearing will be sometime after the 1st of the year.  They are surveying to make sure the property lines are correct.  Mr. Butler wants to make sure he is not held liable if injury occurs on his property when they are there.

Old/New Business
Selectman Ashmankas spoke regarding more information on regionalization of dispatchers.  Chairman Plante thinks we should talk to the Chief and ask for his input on this.

Chairman Plante announced the Board would return only to adjourn.

Motion made by Selectman King, seconded by Selectman Schold to move into Executive Session at 8:05 p.m. under Chapter 39, Section 23B, Paragraphs 2,3 and 6.
