Board of Selectmen Minutes 09/13/2011

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Francis B. King, Kenneth I. Schold, Brian M. Ashmankas; Town Manager Bob Spain, Finance Director Brian Turbitt, Tom Riley, Edd Cote, Susan Spencer-T&G, Steve Balestrieri and concerned citizens.
Absent: Brian W. Stowell

Motion to sign and send in the UN Proclamation made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

Rob McNeil-DPW Director:  spoke regarding the 1st Reading of the Mail Box Policy proposed.  The post office regulations require the mailbox to be 6” off road.  If the mailbox sticks out into the traveled way, the Town will not be responsible to replace it.  The postmaster and Mr. McNeil will visit people that have issues and help explain how to make it work better.  The Town needs to protect itself from people placing things in the town’s right of way. Selectman Ashmankas wanted to make sure the residents were aware of the policy and they had a remedy for the situation.
2nd Reading of the Street Opening Rules and Regulations:  Chairman Plante said that it is a good thing to have a document in place.  Mr. McNeil noticed that some utilities cuts had gone unnoticed and they are working to get the pavement restorations complete and do inspections.  


Laurie Connors-Town Planner:  She needs public acceptance of Braney Road and Brian Circle.  All the preliminary work has been done and approved by Town Counsel.
Motion by Selectman Schold to accept a deed of the fee in Brian Circle, together with appurtenant easements, from Longwood Development Corp., conditional upon the Grantor providing to the Town a signed title certification in a form acceptable to Town Counsel, seconded by Selectman King.
Motion carried unanimously.
Motion by Selectman Schold to accept a deed of the fee in Braney Road, together with appurtenant easements from Cronin Brook Heights LLC, conditional upon the Grantor providing to the Town, immediately after Grantors record the deed, acceptance, and street acceptance plan, a signed title certification in a form acceptable to Town Counsel seconded by Selectman King.
Motion carried unanimously.
She has bad news regarding Jessica J Drive.  Town Counsel did a preliminary title look, and we need 4 waivers singed.  Three waivers have signed, one has refused.  He has been very difficult and is making this very expensive for the town.  She is looking for guidance from the Board.  
Selectman King motioned that if the person signs the waiver the Town will get a survey, seconded by Selectman Ashmankas.
Motion carried unanimously.

The Felters Mill has been abandoned for 20 years now.  It is in deplorable condition.    The fire department will only fight a fire from the outside.  There have been some contamination issues with the building.  Country Candle donated the building to a nonprofit and it was bought at auction by the Romeo’s.  The building is important to Millbury and we would like it redeveloped.    There is a State tax deduction of 10% for the redevelopment of abandoned property.   Gianni and Mario Romeo bought the building and they are intending to keep 45,000 sq ft and demolish the rest for parking.  They are looking at about 1.1 or 1.2 million in renovations.  They already have a tenant waiting.   He bought the Calabria building years ago and did a great job with it.  They would appreciate any help that they can get.  Chairman Plante said that they are excited to see what they do with this building.  
Laurie needs the Board to designate this as an Economic Opportunity Area then she will draft and file the rather lengthy application to the State.
Motion made by Selectman Schold to support establishment of the 22 West Street Economic Opportunity Area and authorize the Town Planner to complete and submit the Economic Opportunity Area Designation application to the Economic Assistance Coordinating Council, seconded by Selectman Ashmankas.
Motion carried unanimously.

Public Hearing:  7:45 pm-Applebee’s Transfer and Pledge of License
Attorney Demarkis appeared for Applebees New England LLC who is buying all the Applebees in the Northeast.  This is inverted process approved by the ABCC first.
Motion to approve the Form 43 made by Selectman Schold, seconded by Selectman Ashmankas.
Motion carried unanimously.
Motion to pledge the license by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.
Motion to close public hearing made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

One Day Liquor License-Cardoos Catering-Asa Waters Mansion September 24, 2011
Motion to approve the one day license made by Selectman Schold, seconded by Selectman Ashmankas.
Motion carried unanimously.

One Day Liquor License-Bicentennial Wine Tasting-Asa Waters Mansion October 29, 2011
Motion to approve the one day license made by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.

August 23, 2011- Motion made by Selectman Ashmankas to approve the minutes, seconded by Selectman King.

Town Manager Report
Reappoint Phil Buso as Veterans agent.  Motion made by Selectman King to concur with the appointment, seconded by Selectman Ashmankas.  Motion carried unanimously.

Mr. Buso has been our agent since 1989 and he does wonderful work for us.  He does a terrific job.

We dodged a bullet with Hurricane Irene.  Found out later on that the schools were out of power.  Thanks to the DPW, Fire and Police department.  Acting Chief Desorcy hunted down National Grid and stayed on them.  The Board agreed with Mr. Spain that it was handled very well.  

There was a chemical spill at Lewcott.  The troops did a great job once again.  Their training showed and everything went fairly smooth.  The chemical called phenol was spilled.  12 people went to the hospital, all treated and released.  Chairman Plante sat in a meeting with the Fire Marshalls and the Town should be very proud of how our personnel handle themselves.

Cell Tower is moving along, spoke to Bay Communications and trying to work out the new lease.

Dam Safety Legislation- Requires the state to write emergency plans for all dams.  This allows the use of the Water Pollution Abatement Trust to fund repairs for dams.  Selectman Schold mentioned that we should use this for Brierly Pond Dam.

Surplus equipment bids are due on Friday, September 16, 2011.  

McCracken Road update-the Mall is willing to participate in the engineering of the road.  They have committed some money to the project.  

The Providence Road Bridge was tarred today.  Hopefully it will be open by October 1st.  

Met Tower is up and getting data.

Greenwood Street Bridge is paved and smooth now.  Shout out to Tom Donnelly for getting that done for us.


Old/New Business:
Selectman Schold wanted to know what is going on with the Transfer Station Committee.  They are meeting and moving along.  He also wanted to know if there was any news on cemetery expansion.  They are still trying to obtain the area where the trailers are.  
Chairman Plante mentioned that people are putting things up that do not belong on the cemetery and it is getting out of control.  The cemetery commission is working on that now.
Selectman Schold mentioned that the sidewalks weeds are unruly.  We cannot spray until we get the plan updated.  We will be very aggressive with it next season.
Selectman King wanted to know when the Capital Budget Committee will be formed.  It will be appointed as soon as the by-laws from Town Meeting are certified.
Selectman Schold mentioned the Veterans Memorials have been taken care of and do look good now and he would like the street lines painted in August.


On a Good Note
Thank you to Ruth Grundstrom who took care of an area of sidewalk that was overgrown on West Main Street.

Congratulations to Kevin and Jen Krassopoulos on their new baby Nikoli Ian.

The Fire Department Field day went well; Edd got some nice aerial photos of the town.  The old timers musters team won which the Vice-Chair was a part of.

Welcome to Susan Spencer from the T&G-hopefully we will get coverage now.

Letter from Bill Borowski regarding the Shirley Ave block party to be held on October 9, 2011.
Motion to close the road made by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.

Selectman Ashmankas mentioned that the Millbury Federated Church Block Party is this Saturday from 1-6; please all attend.
