Planning Board Minutes 06/14/2010
The regularly scheduled meeting of the Millbury Planning Board was held on Monday, June 14, 2010, at 7:00 p.m., in the Municipal Office Building, 127 Elm Street, Millbury, MA. Chairman Richard Gosselin presided.

Present:  Anna Lewandowski, Richard Gosselin, Paul Piktelis, Jeffrey Markarian, Associate Member Edd Cote

Absent:  Gary Schold

Minutes

Motion by Anna Lewandowski, seconded by Paul Piktelis, to approve the Executive Session Minutes of April 26, 2010, motion carried unanimously.

Motion by Anna Lewandowski, seconded by Paul Piktelis, to approve the Minutes of May 24, 2010, motion carried unanimously.

7:25 p.m.       Eastview Acres Performance Guarantee

Robert Vigneau was present on behalf of TPR Homes.  He is requesting approval of the performance guarantee for Eastview Acres.  Town Planner Connors advised the Board that final approval of Exhibit “B” has not yet been received from town counsel (this document states how the escrow account will be held by Morgan Stanley).  

Mr. Vigneau asked the Board to consider approval of the bond and to have the Planner hold the documents pending approval of Exhibit “B”.  The bond will release lots 1-5 and 15-19 from the covenant.  He advised that sewer is available now, the road is cut in, and tree work has been done.  They are approximately 1 ½ - 2 months from base coat.

Ms. Connors reviewed a draft letter to the Building Inspector, indicating which items must be completed prior to issuing building permits and which items must be completed prior to receiving occupancy permits.  

Motion by Jeffrey Markarian, seconded by Anna Lewandowski (for discussion) to accept Performance Bond Secured By Escrow Account in the amount of $785,000 to guarantee the construction of the ways and municipal services serving the subdivision of land shown on a plan entitled “Eastview Acres” Definitive Subdivision of Land in Millbury, Massachusetts, dated September 13, 2004, as amended September 2, 2008, prepared by Thompson-Liston Associates, Inc, 51 Main Street, Boylston, MA and recorded at Worcester Deeds Plan Book 870, Plan 116, pending approval of Exhibit “B” by Town Counsel. Vote:  2-2-0, motion failed.

The Board agreed to schedule a Planning Board meeting for Monday, June 28, 2010, at 7:15 p.m., to allow town counsel time to review Exhibit “B”, having as its only agenda item, the Performance Guarantee for Eastview Acres.  

Motion by Anna Lewandowski, seconded by Jeffrey Markarian to schedule a meeting for Monday, June 28, 2010 at 7:15 p.m., motion carried unanimously.

8:05 p.m.       Grafton Street (Map 54, Lots 108 & 111) Site Plan Review
                and Stormwater Permit Public Hearing, cont.

Clerk Jeffrey Markarian read letter dated June 10, 2010 from DPW Director John McGarry which stated that he has reviewed the details of the structural engineering plan and is satisfied with the plan design.

Clerk Markarian read letter dated June 11, 2010 from Tighe & Bond which advised that they did not see any problems with the structural design.  

Mike Weaver reviewed the plan revisions as agreed on at the last meeting.  

Motion by Jeffrey Markarian, seconded by Anna Lewandowski, to close the public hearing.  Motion carried unanimously.  

Associate Member Edd Cote is a voting member in the absence of Gary Schold.

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to grant a waiver from Section 12.45 ( o ) curbing, to allow the applicant to install vertical curbing along the radius of the driveway entrance and along the edge of the walkway abutting and providing access to the building.  Cape cod berm shall be installed around the perimeter of the remainder of the paved driveway and parking areas. Motion carried unanimously.  

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to grant Site Plan Review Special Permit under Article 1, Section 12.4 and Section 14.11 ( l ) of the Zoning Bylaws, and a Post-Construction Stormwater Management Permit under Section 16-3 of the Millbury General Bylaws, subject to conditions a – s, plan entitled “Existing Conditions Plan for Grafton Street Map 54, Lots 108 & 111 in Millbury, Massachusetts”, dated March 30, 2010, last revised on June 14, 2010, prepared by Guerriere & Halnon, Inc., 1029 Providence Road, Whitinsville, MA. Motion carried unanimously.  

Executive Session

Motion by Jeffrey Markarian, seconded by Anna Lewandowski, to enter into executive session for the purpose of discussing pending litigation and to return to open meeting solely for the purpose of adjournment.  Upon unanimous roll call vote the Planning Board entered into executive session.

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to adjourn.  Motion carried unanimously.  Meeting adjourned at 9:05 p.m.
