Planning Board Minutes 02/22/2010
The regularly scheduled meeting of the Millbury Planning Board was held on Monday, February 22, 2010, at 7:00 p.m., in the Planning Board hearing room, Municipal Office Building, 127 Elm Street, Millbury, MA.  Chairman Richard Gosselin presided.

Present:  Jeffrey Markarian, Richard Gosselin, Anna Lewandowski, Paul Piktelis, Associate Member Edd Cote

Absent:  Gary Schold

7:15 p.m.       Minutes

Motion to approve the minutes of January 11, 2010 by Paul Piktelis, seconded by Anna Lewandowski, motion carried on a 3-0-1 vote.  Jeffrey Markarian abstained as he was absent from this meeting.

7:25 p.m.       Edward & Nancy Moroz, 16 Ackerman Road, ANR Plan

Nancy Moroz addressed the Board and advised that they would like to create an additional building lot.  

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the ANR Plan of land located in Millbury, Massachusetts, dated November 3, 2009, prepared by HUB Survey Associates, 10 Phelps Place, West Boylston, MA, property owned by Edward & Nancy Moroz, 16 Ackerman Road, Millbury, MA.  Motion carried unanimously.

7:30 p.m.       John Burns – Brierly Pond I Final Release

Two final issues were addressed – water and sewer locations were to be added to the plan.  

Motion by Jeffrey Markarian, seconded by Paul Piktelis,  to release the remaining Twenty Thousand Dollars ($20,000) from the Lender’s Agreement between the Millbury Planning Board, Brierly Pond Realty Trust, and Stephan M. Rodolakis, dated August 21, 2002, for the purpose of guaranteeing the construction of Brierly Pond Village I, plan dated August 23, 2001,  motion carried unanimously.

Draft Revisions to Zoning Bylaws – Discussion

The Board discussed final revisions to the Millbury Zoning Bylaws.  A public hearing will be scheduled in March.

Cronin Brook Heights – Discussion and Update
Town Planner Connors advised that the original, approved release for $2,500 was never recorded and was apparently lost by the bank.  A second release will have to be executed by the Board.

Snowplowing of the subdivision was being done by a prospective purchaser, however,  since the bank may not sell the property to him, he will no longer be plowing.  Ms. Connors has attempted to have the bank plow, but they will not.  

Most of the streetlights have been turned off for non-payment.  

8:00 p.m.       Silver Fox Bus Lines Pre-Application – Attorney Peter Keenan

Attorney Peter Keenan, Norman Hill, Land Planning, and Steve Fox were present.  

Attorney Keenan advised that Silver Fox Bus Lines would like to construct a four lot industrial subdivision, to include the current site and three additional ones.

Silver Fox Drive was constructed approximately 20 years ago, and was built to subdivisions standards at that time.

Norman Hill, Land Planning, told the Board that these were small sites, and will provide an additional tax base for the town.  There are approximately 40 acres available, however they are encumbered by wetlands and power lines.  

The width of the future road and top-coating was discussed.  Stormwater management calculations will be required if there are any new, paved areas.  Streetlights will be considered.  Fire Department regulations, granite/concrete monuments and soil testing will be complied with.  A waiver for sidewalks will be requested.  Applicant will consider contributing to the bike bath instead. The Board agreed to waive development impact statements.  There is a “T” turnaround proposed, a cul-de-sac (involving additional pavement) may be required.  Mr. Hill responded that the “T” configuration is in compliance with the Subdivision Rules & Regulations.  If a cul-de-sac is required parking and one lot will be lost.  Ms. Connors offered advice as to how to include the cul-de-sac.

Sewer connections are available on Riverlin Street now.  Ms. Connors advised that, pursuant to the Subdivision Rules & Regulations for the Town of Millbury, if the property is within one thousand feet of a public sanitary sewer line the subdivision shall be required to extend public sewer to the development.

8:55 p.m.       Modifications to Subdivision Rules & Regulations Public Hearing

Clerk Jeffrey Markarian read the public hearing notice.  He also read letter dated February 19, 2010 from Mike Kennedy, Chair of the Millbury Commission on   

Disabilities requesting curb cut ramps with detectable warnings be included within the regulations.  A modification was made, changing the word “may” to “shall”.  

There were no comments from the public.

Motion to close the public hearing by Jeffrey Markarian, seconded by Paul Piktelis, motion carried unanimously.

Modifications voted on are as follows:  (see attached for complete proposed language)

  • Section 5.3(8)( c ) (1) Approval with Bonds or Surety:  Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the modifications, as proposed, motion carried unanimously.
  • Section 5.3(8)( c ) 2 Approval with Mortgage Agreement:  Motion by Jeffrey Markarian, seconded by Paul Piktelis to approve the modifications, as proposed, motion carried unanimously.
  • Section 5.3(11) Release of Performance Guarantee:  Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the modifications, as proposed, motion carried unanimously.
  • Section 5.3(12) Modification, Amendment, or Rescission:  Motion by Jeffrey Markarin, seconded by Paul Piktelis, to approve the modifications, as proposed, motion carried unanimously.
  • Section 6.11 Curb Cut Ramps and Crosswalks:  Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the modifications, as proposed, with one correction – change the word “may” to “shall”, in sentence three, motion carried unanimously.
March 8, 2010 Meeting:  The Planning Board unanimously agreed to cancel this meeting.

Adjournment:  Motion to adjourn by Jeffrey Markarian, seconded by Paul Piktelis, motion carried unanimously.  Meeting adjourned at 9:15 p.m.
