Meeting Minutes for Thursday May 7, 2009 @ 7:15

- CALL TO ORDER: Thomas Stansfield (Chairman), Lorraine Lucas, Anthony Savarese
Martin Bothroyd (Vice Chairman), Allen Kinsella, Rick Wadhams Town. Excused: Ray Turri
- PUBLIC HEARING: None
- READING OF THE MINUTES: The April 2, 2009 meeting minutes were mailed to the Commission prior to the meeting for review.
IN A MOTION made by Mr. Bothroyd, seconded by Ms. Lucas it was voted to approve the April 2, 2009 meeting minutes. Vote Unanimous.
- OLD BUSINESS
- Colby Engineering & Consulting LLC for Dr. Howard Pease, 399 Milton Rd.,
After the fact application for installation of walkway, stairs and deck.
Mr. Colby and Dr. Pease were present to discuss with the Commission. Mr. Colby stated that he will have to approximately cut 1foot off the deck to get it back onto Dr. Pease’s property. He also submitted Dr. Pease’s deed which stated he was allowed to have a deck, stairs and mechanical assistance to access the water if needed, therefore Dr. Pease thought he already had permission to do the work and that is why he proceeded without the proper permits.
IN A MOTION made by Mr. Bothroyd, seconded by Mr. Kinsella it was voted to approve the application for Colby Engineering & Consulting LLC for Dr. Howard Pease, 399 Milton Rd., After the fact application for installation of walkway, stairs and deck. Vote Unanimous
- Naren Sonpal for Gun Sonpal, 187 West Side Rd., construct a shed with solar panels. Mr. Sonpal was present to answer questions from the Commission. The work is within the regulated area not within the wetlands. Mr. Stansfield told Mr. Sonpal to check with Martin Connor, AICP, Wetlands Enforcement Officer before any work begins to see what he wanted installed for Sedimentation and Erosion controls.
IN A MOTION made by Mr. Kinsella, seconded by Mr. Bothroyd it was voted to approve the application for Naren Sonpal for Gun Sonpal, 187 West Side Rd., construct a shed with solar panels.
- NEW BUSINESS:
- Joseph S. Alicata, AIA for Patrick & Victoria Daly, 57 Sherbrook Drive, remove existing deck and entrance portico and construct patio and entrance portico within the regulated area. This item has been handled by an agent determination.
- Alan Bongiovanni for Henry & Judith D. Budney, Trustees, 610 North Street, Cease and Desist Order for placing stones/rocks within a watercourse. Mr. Bongiovanni was present for Mr.& Mrs. Budney. They were unaware that they needed a permit for the hoop house. They are now moving the hoop house outside of the regulated area so it no longer require a wetlands permit and they will contact the Zoning Enforcement and Building Official for the proper permits. The Budney’s were creating a pool for their grandchildren to fish in. They had planned to take all the stones out at the end of the summer. However, they have currently restored it to it’s natural conditions and the disturbed area is seeded and stabilized. They need to do some seasonal maintenance but they are not
asking to put the stones back into the pond.
Mr. Stansfield stated that this is not the first time the Budney’s have done work without the proper permits and hopes that this will be the last. Mr. Kinsella stated that this is a very valuable brook and all proper permits must be taken to ensure the protection of Goshen’s public water supply.
The Commission would like Mr. Bongiovanni to submit either in writing or by way of testimony that he has spoken with the Budney’s prior to next meeting and they understand before they do any additional work within 75 feet of the watercourse they must come and get a wetlands permit.
IN A MOTION made by Mr. Savarese, Seconded by Mr. Kinsella it was voted to accept the application for Alan Bongiovanni for Henry & Judith D. Budney, Trustees, 610 North Street, Cease and Desist Order for placing stones/rocks within a watercourse. Vote Unanimous.
IN A MOTION made by Mr. Stansfield seconded by Mr. Bothroyd it was voted to add to the agenda Torrington Country Club, 250 Torrington Road, Excavation and pond dredging in a regulated area- Permit Modification. Vote Unanimous. The original plan had not indicated the pump house. Plans were submitted to show the pump house and where lines will run. The pump house will be no larger than 20’ x 20’.
IN A MOTION made by Mr. Stansfield seconded by Mr. Bothroyd it was voted to approve Torrington Country Club, 250 Torrington Road, Excavation and pond dredging in a regulated area- Permit Modification. Vote Unanimous.
IN A MOTION made by Mr. Stansfield seconded by Mr. Wadhams it was voted to add to the agenda 5 Year Extension on Permit # 05-04-01, Brendon Sandor, lot 477 Sherbrook Drive, construct a dwelling. Vote Unanimous. The Commission reviewed the file
IN A MOTION made by Mr. Stansfield seconded by Mr. Wadhams it was voted to approve a 5 Year Extension on Permit # 05-04-01, Brendon Sandor, lot 477 Sherbrook Drive, construct a dwelling with the understanding that all previous conditions still apply. Vote Unanimous.
- INLAND WETLANDS OFFICER’S REPORT: The Commission received and reviewed the Inland Wetlands Officer’s Report.
IN A MOTION made by Mr. Stansfield, seconded by Mr. Savarese it was voted to accept the Inland Wetlands Officer’s report. Vote Unanimous
- CORRESPONDENCE: Ms. Holda told the Commission that Mr. Valentine said the plans for Tyler Lake Dam are finished and they are in the process of applying to DEP for a permit. Mr. Valentine will keep the Commission informed of what is happening.
- ADJOURNMENT:
IN A MOTION made by Mr. Savarese, it was voted to adjourn the meeting at 7:45 PM. Vote was unanimous.
