The Planning Board met in the Duxbury Town Offices on Monday, November 6, 2006 at 6:30 PM.

Present:        Amy MacNab, Chairman; George Wadsworth, Vice-Chairman; Angela Scieszka, Clerk; John Bear, Brendan Halligan, and Jim Kimball.

Absent: Harold Moody; and Associate Member Douglas Carver.
Staff:  Christine Stickney, Planning Director; and Diane Grant, Administrative Assistant.


Ms. MacNab called the meeting to order at 6:25 PM. Open Forum was deferred until the end of the meeting.

CONSULTING ENGINEER INTERVIEWS
Fay, Spofford & Thorndike, Burlington: Mr. Frank Tramontozzi, Senior Vice President; Ms. Beth Debski, Project Manager; and Mr. David Glenn, Civil Engineer and Construction Inspector, were present for the interview. Each made a presentation, followed by Board questions regarding the applicants’ experience and qualifications.

Vollmer Associates, Middleboro and Boston: Mr. William Mertz, Project Manager; and Mr. Ron Headrick, Landscape Architect, gave presentations representing their firm, which has 24 locations in New England, followed by Board questions regarding the applicants’ experience and qualifications.

Hancock – McMahon Associates, Lakeville: Mr. Mark Louro, Senior Project Manager; Mr. Dan Bremser, Project & Office Manager; and Mr. Garry McNaughton, Transportation Engineer, were present for the interview with this firm which has seven locations on the East Coast. They also shared qualifications for Joe Peznola, Land Development Division Manager, as their 40B expert, and Tom Keogh as wetlands scientist. They responded to Board questions regarding the firm’s experience and qualifications.

Amory Engineers, Duxbury: Mr. Walter Amory, Principal, and Mr. Ryan Trahan, Civil Engineer, were present for the interview of this firm which currently serves as Consulting Engineer for the Planning Board. Mr. Trehain stated that Ms. Peggy O’Connor would serve as his landscape architect consultant. Mr. Amory and Mr. Trehain answered questions regarding the firm’s experience and qualifications.

Horsley Witten, Sandwich: Ms. Christine Wallace, Project Manager; and Mr. Mark Nelson, Principal, were present for the interview of this firm which currently serves as Consulting Engineer for the Planning Board. Ms. Wallace apologized that Mr. Rich Claytor, Principal, could not attend due to a scheduling conflict. Mr. Nelson made a presentation, followed by questions to him and Ms. Wallace regarding the firm’s experience and qualifications. Ms. Wallace stated that Mr. Nick Cracknell and Mr. Nate Kelley would provide future fiscal analysis consulting services.

Vine Associates, Hingham: Mr. Peter Williams, Principal, was present and made a presentation on behalf of this firm which has three locations. He then answered Board questions regarding the firm’s experience and qualifications.

Mainstream Engineering, Kingston: Mr. Tom Sexton, Principal, was present for the interview of this firm which currently serves as consulting engineer to the Board. He answered Board questions regarding the firm’s experience and qualifications.

Board Deliberations: Ms. Stickney advised the Board to consider a two-year contract to lock in rates.   Ms. Stickney stated that she would create a draft contract and would ask Mr. Kimball and Town Counsel, Atty. Robert S. Troy, to review it. The Board agreed to resume deliberations on selecting consulting engineers at a future meeting.


OTHER BUSINESS
40B Comprehensive Permit authorization: Ms. Stickney noted that Town Counsel had submitted a memo to Town Manager, Mr. Richard MacDonald, at the Zoning Board of Appeals’ (ZBA) request regarding their right to endorse a plan. In the memo, Atty. Troy stated that the ZBA has the authority to approve or disapprove a plan and the Planning Board would endorse it “as an accommodation to this process.” Ms. MacNab stated that she disagreed with Atty. Troy’s opinion. Ms. Stickney stated that ZBA Chairman, Mr. James Lampert, feels that there can be constructive approval, but Ms. Stickney said that she disagreed with that interpretation as well since no application would be filed that starts a time clock running. Mr. Bear stated that Atty. Troy’s opinion is not in the best interest of the Town.


ADJOURNMENT
The Planning Board meeting was adjourned at 10:25 PM. The next meeting of the Duxbury Planning Board will be held on Monday, November 13, 2006 at 7:00 PM at the Performing Arts Center in conjunction with Special Town Meeting.
