BOARD OF SELECTMEN MEETING APRIL 29, 2002
The meeting was called to order at 7:31 p.m. Present were Selectmen John Tuffy, Chair, Elizabeth Sullivan, Andre Martecchini, as well as Rocco Longo, Town Manager.

There was no one present under the Open Forum.
BUSINESS
Town Manager's Brief
Mr. Longo gave a brief overview of the budget figures that the Town adopted for 2003 vs. Governor's proposed budget for 2003 vs. the proposed House Budget for 2003. If the proposed House Budget for 2003 was adopted, the total deficit for State Revenue for the Town of Duxbury would be $550,994 and the town would receive only $69,133 in Chapter 90 funding.
Mr. Longo also updated the Board on the following issues:

Dehumidification System at the Pool
Well Cleaning
Regional Transportation
Applicants for the Planning Director as well as the DPW Director
DISCUSSION - DUXBURY BAY WIDE STUDY
Present for discussion with the Board of Selectmen: Joe Grady, Conservation Administrator, Heather Durant, Intern, Dick Finnegan, Deputy Assessor, Bill Tenhoor, John Hegarty of the Bay Preservation Group, John McCluskey, Dan Baker of the Duxbury Beach Committee, Margaret Kearney, A. William Bennett, David Sullivan from Battelle, Don Beers, Harbormaster, and citizens representing other boards and committees in Town.
Joe Grady, Conservation Administrator introduced Heather Durant, graduate student at Bridgewater State College and presently an intern for the Town of Duxbury.
Mr. Grady did an overview of the harbor plans presently in existence in the Commonwealth and explained that it would take approximately 1-2 years to do a similar program for the Town of Duxbury. The cost to do a more limited harbor management plan as was done in Hull would be somewhere around $50-$100,000. Mr. Grady displayed a map showing Duxbury bay and a thorough study would involve Marshfield, Plymouth, and Kingston at a later time but that Duxbury needs to focus on itself first.

The cost to do a more extensive bay wide study is unknown. Mr. Grady will inquire how much was spent for the Pleasant Bay study on Cape Cod which is an excellent example of a comprehensive study.
Mr. Grady recommended that the Selectmen appoint a steering committee comprised of many different people to begin the lengthy process of drafting a comprehensive bay wide management study. Much of the initial work will be gathering existing resources such as maps of the bay and shoreline, water quality data and Geographical Information Systems.
Bill Tenhoor and John Hegarty presented to the Selectmen a memorandum asking for advice on the following issues as the Town Meeting in March approved a committee to study piers along with an allocation of $10,000 to study in order to make recommendations to the 2003 Annual Town Meeting:
Membership of the committee to perform the study
Interaction of the committee to perform the study
Their plan to conduct this study
Process for receiving and spending allocated and raised funds
Proposed seven step Planning Process:
Prepare the Charter of the Committee
Initiate the Planning Process
Identify the issues, obstacles and opportunities
Collect and analyze data and comparable experience
Establish goals, objectives and policies
Develop strategy and implementation plans
Prepare final report and recommendations for 2003 Town Meeting
Dick Finnegan, Deputy Assessor said the assessors have certain concerns outlined as follows:
Deeded Beach Rights for Inland Homes, Docks, Piers and Boathouses
Seaward Boundaries
This valuable information would help the assessors in their assigned duties.
After a lengthy discussion, it was decided to place on the Selectmen's agenda under Business the following dates and issues:
Monday, May 13, 2002 - Discussion concerning the makeup of the Bay Wide Management Committee.
Monday, May 20, 2002 - Appointment of the Committee.

BUSINESS
One Day Liquor License Request - Duxbury Beach Preservation Society
The Board of Selectmen favorably voted to grant a one-day liquor license to the Duxbury Beach Preservation Society on Saturday, June 22, 2002 from 7:00 p.m. - 12:00 a.m. The event will be held at Battelle Labs on Washington St.
Resignation - Duxbury Cultural Council
The Board of Selectmen accepted with regret the resignation of Julia R. Kispert from the Duxbury Cultural Council.
Resignation - North Hill Advisory Committee
The Board of Selectmen accepted with regret the resignation of Michael Shuipis from the North Hill Advisory Committee.
Bonus Shellfish Season (May)
The Board of Selectmen favorably voted to:
Declare a temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of May. Regulations as attached (Please see Attachment B & C)
Declare a temporary Bonus Shellfish Season for the commercial harvesting of quahog clams for the month of May. Regulations as attached. (Please see Attachment A & C)
Committee Appointment - Design Review Board
The Board of Selectmen appointed Sarah B. McCormick to the Design Review Board for a three-year term to expire on June 30, 2005.
Forum on Emergency Planning
The Selectmen unanimously felt that the Forum on Emergency Planning should be held sometime in June. The formal exercises for Pilgrim are scheduled for Wednesday, May 22, 2002 at the EOC. Mr. Longo will contact Mrs. Lampert, Chair of the Nuclear Advisory Committee to advise her of the Selectmen's decision.

The Board of Selectmen voted to approve the minutes of April 23, 2002 as drafted.
MISCELLANEOUS
Tom Murray, Wadsworth Road voiced his complaint about the Bay Road project. Mr. Murray felt that there was hazardous waste on the project. Mr. Longo stated that the soil is being disposed of in accordance with D.E.P. regulations. Mr. Longo will be in touch with Mr. Murray tomorrow to discuss the matter further.
At 9:00 p.m. Mr. Tuffy moved to go into Executive Session to discuss strategy with respect to the taking, purchase, exchange, lease or value of real property and to reconvene in Open Session in accordance with Mass. General Laws, Chapter 39, Section 23, Subsection 6. A roll call vote was taken - Mrs. Sullivan - "aye", Mr. Martecchini - "aye" and Mr. Tuffy - "aye."
At 10:32 p.m. there was another roll call vote taken by Mr. Tuffy as the Executive Session adjourned. Mrs. Sullivan - "aye", Mr. Martecchini - "aye" and Mr. Tuffy - "aye."
