9-30 Board of Selectmen Minutes

BOARD OF SELECTMEN                                              September 30, 2002

The meeting was called to order at 7:30 p.m.  Present were Selectmen John Tuffy, Chair, Elizabeth Sullivan, Andre Martecchini and Rocco Longo, Town Manager.

OPEN FORUM

There was no one present under the Open Forum.

JOHN ALDEN FIRST SITE HOMESTEAD

Mr. Alden Ringquist, Acting Director, Alden Kindred of America, Inc. presented the Board with a list of proposed projects that would be undertaken if they are able to assume responsibility for the Alden First Site from the Town of Duxbury.

The Board noted the concept of developing and preserving the site was wonderful, however, it is located next to playing fields and there is a concern regarding the site’s close proximity to children.  Also, Ms. Julia Kispert, Co-Chair, Duxbury Historical Commission informed the Board that the National Historical Commission might not have a record of the site.  

The Board recommended the following:

Mr. Ringquist should begin to have conversations with the School Committee, because they are in control of the site.
Determine the value of an Archeological Program.  
The Town Manager will continue to work with the Historical Commission and Alden Kindred of America, Inc.  
This would need to go to Town Meeting.

MEMORANDUM OF UNDERSTANDING BETWEEN THE COMMONWEALTH OF MASSACHUSETTS, DEPARTMENT OF FISHERIES, WILDLIFE AND ENVIRONMENTAL LAW ENFORCEMENT, DIVISION OF MARINE FISHERIES AND THE TOWNS OF DUXBURY AND KINGSTON

Mr. Donald Beers, Harbormaster provided the Board with an overview of the above noted Memorandum of Understanding.  This memorandum is attached and made part of these minutes.

The Board voted favorably to endorse and sign on to the Memorandum of Understanding between the Commonwealth of Massachusetts, Department of Fisheries, Wildlife and Environmental Law Enforcement, Division of Marine Fisheries and the Towns of Duxbury and Kingston.

   
BUSINESS

FY04 Budget Overview – Town Manager

Mr. Rocco Longo, Town Manager, presented a “Preliminary FY 04 Budget Projection” to the Board.  He stated that the numbers forecasted are not as significant as the discussion that goes along with it.  This report is attached and made part of these minutes.   

Forty percent of the budgets have been submitted.  The remaining budgets are expected within the next two weeks.

Mr. Longo plans to meet with the Finance Committee and Fiscal Advisory Committee later next month, at which time he will present the budget.

Town Manager's Brief

The Town Manager’s Brief, dated 9/30/02, is attached and made part of these minutes.  Highlights are as follows:

Mr. Longo informed the Board that Matt Riggins has been appointed Animal Control Officer.  Mrs. Sullivan noted the Patriot Ledger should be notified that they currently have an incorrect name listed as Animal Control Officer.  

Mr. Longo also noted he would invite Annie Eldridge to a Board of Selectmen meeting to provide the Board with an update on donations for the new Animal Shelter.

The contract with Matt Lopes, who was involved with Metal Recycling, has been terminated by mutual agreement.  The Town has now taken responsibility for metal recycling.

There will be an Open House at the Fire Station on Saturday from 10:00 a.m. – 2:00 p.m.

Mary Beth MacQuarrie, IS Administrator, will move to the Town Hall.  Her efforts will be concentrated on working with a team on the Town’s web site.  Mr. Martecchini noted that he would like to have the CPZBIC By-laws placed on the Town’s web site.

Commendation Letter from Sheriff Joseph F. McDonough

Mr. Tuffy noted a letter of commendation from Sheriff Joseph F. McDonough in which he commended Chief Mark DeLuca for his leadership, dedication and professionalism demonstrated on Friday, September 6th, during an intense 7 hour search of an individual who escaped D.Y.S. custody.  The State Police and Plymouth County Sheriff’s Department also participated under the direction of Chief DeLuca.  

The Board commended Chief DeLuca for a job well done and also thanked him for having the foresight to have the Duxbury Police become a member of the Regional Task Force.  The Board also thanked the Sheriff’s department for their assistance and also providing the search team with over 50 meals.   

Bonus Shellfish Season (October)

The Board favorably voted to declare a temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of October as outlined in the regulation in attachments B&C.

Meeting Minutes 9/16/02

The Board favorably voted to accept the minutes of 9/16/02 as amended.

Miscellaneous

The next Board of Selectmen meeting will be held on 10/15/02.  

Mr. Martecchini noted the Comprehensive Plan Zoning Bylaw Implementation Committee (CPZBIC) plan to meet with Bob Troy, Town Counsel tomorrow evening to discuss their proposal.  

He further noted, depending upon the outcome of this meeting, it may be necessary for the Board to meet on 10/7/02 to call a Special Town Meeting on 11/28/02.
