BOARD OF SELECTMEN MEETING July 29, 2002
The meeting was called to order at 6:45 p.m. Present were Selectmen John Tuffy, Chair, Andre Martecchini, Elizabeth Sullivan and Rocco Longo, Town Manager.
OPEN FORUM
There was no one present under the Open Forum.
UNITY INTERFAITH COMMUNITY SERVICE FOR REMEMBRANCE OF 9/11/02- DUXBURY INTERFAITH COUNCIL
The Board of Selectmen voted to approve the Unity Interfaith Community Service for Remembrance of 9/11/01. This event will be held on the Town Green on Wednesday, September 11, 2002 from 7 p.m. - 8:30 p.m.
CHESTNUT ST. UPDATE
Mr. Longo read an in-depth report concerning an update on the Chestnut Street project that was prepared by Tom Daley, DPW Director. This report is attached and made part of these minutes.
MISCELLANEOUS
Mr. Martecchini made an announcement that the Board of Selectmen would be having a joint meeting with the Planning Board starting at 7:30 p.m. on Chapter 40B.
BUSINESS
Town Manager's Brief
Mr. Longo updated the Board on the following issues:
Delano Property Closing - moved to later in August
Board will need to sign a P&S Agreement
Merlet Property
MBTA - Representative Marini drafted an amendment to allow our regional
elderly effort to proceed, passed the House, and going to the Senate.
Beede Disposal Site/Waste Oil Clean Up
The Town will pay the EPA the De Minimis settlement offer of $9,593.75. Town Counsel made this recommendation. Many Massachusetts communities are involved and they are paying the De Minimis settlement.
The town has a draft report from CDM relative to potential corrective action for the Snug Harbor Blue Fish Shared Septic Systems. This is scheduled for an agenda item on Monday, August 12th.
Still need a Wright Building Committee.

Mr. Longo also read a press release entitled "MASSACHUSETTS BEGINS POTASSIUM IODIDE (KI) DISTRIBUTION." This document is attached and made part of these minutes.
BONUS SHELLFISH SEASON (August)
The Board of Selectmen favorably voted to declare a
Temporary Bonus Shellfish Season for the commercial harvesting of softshell clams for the month of August. Regulations as attached.

EXECUTE AMENDMENT TO DELANO PURCHASE & SALE
The Board favorably voted to execute an amendment to the Delano Purchase & Sale agreement. The closing date has been extended from August 26 to September 15.
EXECUTE CONSERVATION RESTRICTION ON MERLET PROPERTY
The Selectmen favorably voted to execute a restriction on the Merlet Property.
$1,000 - DONATION OF A GIFT TO THE MARGE PARCHER FUND - HALIFAX VFW
The Selectmen favorably voted to accept a donation of $1,000 to the Margery Parcher Fund from the Halifax VFW. A thank you letter will be sent to the members of the VFW.
APPOINTMENT - PLYMOUTH COUNTY ADVISORY BOARD MEMBERSHIP
The Selectmen favorably voted to appoint John Tuffy to the Plymouth County Advisory Board.
RESIGNATION - NUCLEAR ADVISORY COMMITTEE
The Board of Selectmen accepted with regret the resignation of John Anderson from the Nuclear Advisory Committee.
COUNCIL ON AGING - APPOINTMENT
The Board of Selectmen voted to appoint Richard Whitney to the Council on Aging for a three-year appointment to expire on 6/30/05.

The Selectmen favorably voted to accept the minutes of July 8, 2002 and July 19, 2002 as drafted.
DISCUSSION - DUXBURY SENIOR CENTER ALCOHOL POLICY
Present for discussion with the Board of Selectmen: Oliver Woodruff, Henry Milliken, Chair, and Patricia Ryan from the Council on Aging
After a short discussion and review of letters from the Friends of the Council on Aging and the Council itself, the Selectmen voted to formulate a policy allowing for a case by case review of temporary liquor licenses for the Senior Center but will not extend that policy to other town buildings at this time.
Mrs. Sullivan stated that the "current policy limits the town's ability to support our own groups but revising it will allow the Senior Center to help themselves and offset budget request."
Mr. Longo will prepare a draft of the "Temporary Liquor License Policy" for the Senior Center for the Selectmen's meeting that is scheduled for Monday, August 12, 2002 for the Board's review.
MISCELLANEOUS
The Selectmen favorably voted to execute a document for the precincts to be open for the September primary on Tuesday, September 17, 2002 at the Duxbury Middle School. Hours for the polls will be 7 a.m. - 8 p.m.
SHELLFISH AQUACULTURAL GRANT HEARING
Present for discussion with the Board of Selectmen: Donald Beers, Harbormaster
The Board of Selectmen approved the application for Michael George as to location and concept pending all State, Federal, and Local reviews and approvals. Primary License requested: Approximate 1500' east off southeast corner of the basin.
