The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, October 19, 2010 beginning at 7:00 p.m.  Members present included Chairman Joseph Messina, Samuel Butcher, Dianne Hearn, Barbara Kelley, Holly Morris, and Corey Wisneski.  Thomas Gill was absent.  Also present was the Conservation Administrator, Joe Grady.

PH, BAY FARM ASSOC. TR., 100 PARK ST, SE 18-1542, DRAINAGE
The purpose of this public hearing was to review the Notice of Intent application filed by the Bay Farm Association Trust.  The applicant was not present for the discussion.  The Conservation Administrator explained the project, which was to install a drain control gate and drain pipe and to clean out the existing drainage swale.  The Commission reviewed the site plan and photographs of the area provided by Mr. Grady.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PH, BALDWIN, 161 HIGH ST., BARN, SE 18-1543
The purpose of this public hearing was to review the Notice of Intent application filed by John Baldwin for construction of a barn.  Mr. Baldwin explained the project.  The existing barn is to be razed and a new structure built in the location shown on the site plan dated 9/29/2010.  The proposed project conforms to the regulations.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION, 237 GURNET RD., SE 18-1540
Representing the applicant was Freeman Boynton.  As requested by the Commission, the applicant submitted a pile foundation plan dated 10/13/2010 and a revised site plan with elevations shown dated 10/6/2010.  After reviewing the new information, Ms. Kelley made a motion that was seconded to issue Orders of Conditions.  The vote was 4 – in favor; 0 – opposed; 1 – abstention (Messina).  Motion passed.

PM, TOWN OF DUXBURY, TOWN LANDINGS, GENERAL MAINTENANCE
The purpose of this public meeting was to review the Request for Determination of Applicability application filed by the Town of Duxbury for routine maintenance of the town landings.  All work would be coordinated with the Conservation Administrator.  Mr. Healey from Landing Road commented about the loss of sand at the town landing at the end of Landing Road.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for routine maintenance at the town landings, provided the work is approved by the Conservation Administrator.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PM, CASO, 30 BRADFORD RD., DRIVEWAY
The purpose of this public meeting was to review the Request for Determination of Applicability application filed by David and Deborah Caso.  Representing the applicant was Jay DeMarais from Duxbury Gardeners.  The proposed project is to replace the existing gravel driveway and parking area with Pavestone eco-venetian stone (pervious paver).  The Commission reviewed the site plan, information regarding installation of the pavers, and photographs of the area.  The Commission noted the proposed pervious pavers meet the requirement for pervious only for this particular site.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the proposed driveway project.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed draft meeting minutes, but could only act on the minutes for 7/20/2010 because of quorum issues.  Ms. Hearn made a motion that was seconded to approve the minutes of the meeting on 7/20/2010 as drafted.  The vote was 4 – in favor; 0 – opposed; 2 – abstentions (Butcher, Messina).  Motion passed.

The Conservation Administrator reported on a complaint regarding an unleashed dog on conservation land.

Ms. Morris and Mr. Grady volunteered to share a position on a committee regarding harbor dredging.

Mr. Grady reported on two emergency certificates that were issued: one for a beaver control problem behind Plantation Drive and the second, to add sand behind the seawall off Gurnet Road, where the footing was exposed in order to keep the seawall from falling.  Mr. Butcher made a motion that was seconded to reaffirm the issuance of the two above-mentioned emergency certificates.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

Mr. Grady reported that there are taxes owed on parcel 100-502-066 in the amount of $764.61.  Mr. Messina made a motion that was seconded to approve the expenditure of $764.61 from the Conservation Fund for the unpaid taxes.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

Mr. Messina reported on a meeting of a subcommittee of the Duxbury Bay Management Commission regarding Sealeg recreational vehicles.
