Conservation Comm. Meeting - 2009/06-16
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, June 16, 2009 beginning at 7:00 p.m.  Members present were Samuel Butcher, Dianne Hearn, Barbara Kelley, and Corey Wisneski. Chairman Joseph Messina, Thomas Gill, and Holly Morris were absent.  Mr. Butcher was Acting Chairman.  Also present was Joe Grady, Conservation Administrator.  

PH, KOURAFAS, 848 FRANKLIN ST., ADDITION, SE 18-1509
The property owner, Jane Butler explained the project which was to construct a 7’ x 14’ addition located approximately 90 feet from the bordering vegetated wetlands.  The proposal conforms to the Conservation Commission regulations; however the applicant must apply for a Special Permit from the Zoning Board of Appeals.  It was recommended that the public hearing be kept open until after the meeting of the Zoning Board in case there are any revisions to the site plan.  Ms. Kelley made a motion that was seconded to continue the public hearing to July 7, 2009 at 7:05 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PM, FLAHERTY, 128 BAY ROAD, ADDITION
Barbara Kelley recused herself from the public meeting since she is an abutter to the property.  As a result there was no quorum of the Conservation Commission so the public meeting was continued to July 7, 2009 at 7:07 p.m.

PH, FEDERICI, 21 HUMMOCK LN., S.F. DWELLING
Representing the applicant was Paul Mirabito from Ross Engineering Co.  The proposed project is to raze the existing dwelling and construct a new single family dwelling centered on the lot.  Project is located on a barrier beach and in AO flood zone.  The structure is to be built on a pile foundation.  The Commission noted that the regulations do not allow a continuous footing so Mr. Mirabito agreed to revise the plan to show individual footings.  Abutters from 15 Hummock Lane (Kevin Carr) and 17 Hummock Lane (Bruce Carson) had concerns with regards to parking and blocking of the right-of-way on the property.  Currently no parking area is proposed but Mr. Butcher indicated that if the applicant puts in any parking area or driveway then the applicant would need to get approval from the Conservation Commission.  Mr. Mirabito indicated that there is no proposed change in grade.  Mr. Carson had concerns regarding excavated material during construction.  The Commission required that any excavated material must be removed off site and any stockpiles during construction must be covered so sediment will not wash into the street.  No storage is permitted underneath the dwelling.  The DEP file number had not been issued.  Ms. Kelley made a motion that was seconded to continue the public hearing to July 7, 2009 at 7:15 p.m.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

PROPOSED LAND ACQUISITION
The Commission reviewed a letter from the Andresen family dated 6/8/2009 that offered their parcel at 4 Wamsutta Way for purchase by the Town.  Mr. Grady reported that 28 acres of the parcel currently has a conservation restriction on it.  The Commission directed the Conservation Administrator to send the Andresens a letter that indicated at this time there are other potential land acquisitions with a higher priority.

ADMINISTRATIVE MATTERS
The Commission reviewed the minutes of the meetings on 5/5/2009 and 5/19/2009.  Ms. Kelley made a motion that was seconded to approve the minutes of the meeting on 5/19/2009 as drafted.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

Ms. Wisneski made a motion that was seconded to approve the minutes of the meeting on 5/5/2009 as drafted.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed an expenditure request for interns from the Conservation Fund.  The request was $4,500 for salaries and $1,200 for supplies.  Ms. Wisneski made a motion that was seconded to approve the expenditure for interns for a total amount of $5,700 from the Conservation Fund.  The vote was 4 – in favor; 0 – opposed.  Motion passed.

The Conservation Administrator reported on vandalism of two of the conservation property signs at Delano Farms and Mathews Bog.

The Commission unanimously recommended the re-appointments of Barbara Kelley and Joe Messina to the Conservation Commission.
