Conservation Comm. Meeting - 2009/09-15
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, September 15, 2009 beginning at 7:00 p.m.  Members present included Chairman Joseph Messina, Samuel Butcher, Thomas Gill, Barbara Kelley, Holly Morris and Corey Wisneski.  Dianne Hearn was absent.  Also present was the Conservation Administrator Joe Grady.

PH, POST, 644 WASHINGTON ST., AMEND ORDERS, SE 18-1497
The applicant, Charles Post was present for the discussion.  The proposed amendment to the Orders of Conditions is to correct the existing coverage calculation that was referenced in the Orders and on the approved plan.  The site plan with a revised date of 7/21/2009 showed the correct existing coverage within the 100-foot buffer as 16.3%.  Dr. Gill made a motion that was seconded to amend the Orders of Conditions for SE 18-1497 to reflect the correct existing coverage as 16.3 % and to accept the revised plan dated 7/21/2009.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PH, STANTON, 62 POWDER POINT AVE., LANDSCAPING
Representing the applicant was David Heath.  The proposed project is to remove the invasive species vine that has infiltrated and killed the rosa rugosa along the coastal bank and to construct a small stone landscape wall to separate the lawn and the vegetated bank.  The applicant also proposed to bring in some fill to level the area on the upland side of the wall.  No DEP file number had been issued.  Dr. Gill made a motion that was seconded to continue the public hearing to October 6, 2009 at 7:05 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION LLC, 29 QUAIL RUN, ADD’T., SE 18-1516
Since the DEP file number had been issued, Mr. Butcher made a motion that was seconded to issue Orders of Conditions for the proposed addition project.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

PM, TOWN OF DUXBURY, ALDEN ST., DIKE REPAIR
The Conservation Administrator, Joe Grady explained the project.  The proposed project is to repair the dike at the bird sanctuary behind the Alden School.  The work includes filling in washouts along the dike; reconstructing the flume structure; removing overgrown vegetation and re-grading the cart path, and installing a gate at the entrance to prohibit motor vehicle access other than for maintenance purposes.  Mr. Butcher made a motion that was seconded to issue a negative determination that a Notice of Intent is not required for the maintenance and repair work on the dike.  The vote was 6 – in favor; 0 opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed a request for a Certificate of Compliance for SE 18-1384 (53 Union Bridge Rd.)  Mr. Butcher made a motion that was seconded to issue a Certificate of Compliance for SE 18-1384.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Commission reviewed a request for issuance of a duplicate original for a Certificate of Compliance for SE 18-559 in order that the document can be recorded at the Registry of Deeds.  Mr. Butcher made a motion that was seconded to issue the duplicate original Certificate of Compliance for SE 18-559.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Conservation Administrator reported that he had found a 2004 Toyota Tundra to replace the old truck used by the Conservation Department.  The total cost was $13,799 of which $799 was needed from the Conservation Fund.  Mr. Butcher made a motion that was seconded to approve the expenditure of $799 from the Conservation Fund towards the purchase of the truck.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Conservation Administrator summarized the report from the consultant, Wetland Strategies Inc. with regards to site inspections at 201 Marshall Street for the revegetation plan (SE 18-1492).  It was reported that a large oak tree had died and the property owner had agreed to not remove the dead tree at this time, but to plant another oak in another location; and for wildlife habitat let the dead tree stand until it fell naturally.   Mr. Butcher made a motion that was seconded to accept the site inspection report from Wetland Strategies Inc. and to direct the Conservation Administrator to send a letter to the property owner commending him for keeping the dead tree for wildlife habitat purposes.  The vote was 6 – in favor; 0 – opposed.  Motion passed.
