Conservation Comm. Meeting - 2009/12-01
The Conservation Commission held a meeting in the Mural Room, Lower Level of Town Hall on Tuesday, December 1, 2009 beginning at 7:00 p.m.  Members present included Samuel Butcher, Thomas Gill, Dianne Hearn, Barbara Kelley, Holly Morris, and Corey Wisneski.  Chairman Joseph Messina was absent.   Dr. Gill was Acting Chairman.  Also present was the Conservation Administrator Joe Grady.

PH, DUXBURY CONSTRUCTION, 70 FAIRWAY LN., DRAINAGE
Representing the applicant was Freeman Boynton.  The proposed project is to improve the drainage on the golf course by replacing drainage pipes and creating an artificial wetland.  An abutter, Edward Lawson of Sunset Rd. had concerns with regards to chemicals being used on the golf course and water quality.  He asked if the project included any water quality monitoring.  The Commission discussed whether to require the applicant to do any monitoring.  The sense of the Commission was not to require monitoring as part of this proposal.  No DEP file number had been issued.  Mr. Butcher made a motion that was seconded to continue the public hearing to December 15, 2009 at 7:20 p.m.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DUXBURY CONSTRUCTION, 21 RIVER LN., SE 18-1520
The DEP file number had been issued.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, LAWSON, 34 SUNSET RD., SE 18-1519
The DEP file number had been issued.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

CONT’D. PH, DYROFF, 27 ELDERBERRY LN., SE 18-1521
The DEP file number had been issued.  Mr. Butcher made a motion that was seconded to issue Orders of Conditions.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

EXECUTIVE SESSION – POTENTIAL LAND ACQUISTIONS
At 7:40 p.m. Ms. Kelley made a motion that was seconded by Mr. Butcher to go into executive session.
Motion:  to go into executive session to consider the taking, purchase, exchange, lease or value of real property which, if discussed outside of this session could have a detrimental effect on the negotiating position of the governing body.  
Vote:  A roll call vote was taken:  6 – in favor; 0 – opposed.  Motion passed.  

At 7:52 p.m. Ms. Kelley made a motion that was seconded by Mr. Butcher.
        Motion:  to reconvene into open session.
        Vote:  A roll call vote was taken: 6 – in favor; 0 – opposed.  Motion passed.

ADMINISTRATIVE MATTERS
The Commission reviewed requests for Certificates of Compliances for SE 18-1469 (120 Goose Point); SE 18-1506 (1 Abrams Hill); SE 18-1077 (81 Hornbeam Rd.); SE 18-1491 (735 Congress St.); SE 18-1305 (675 Bay Rd.); and SE 18-1476 and SE 18-1457 (67 Harden Hill).
Ms. Kelley made a motion that was seconded to issue Certificates of Compliances for SE 18-1469.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

Ms. Wisneski made a motion that was seconded to issue Certificates of Compliances for SE 18-1506.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

Mr. Butcher made a motion that was seconded to issue Certificates of Compliances for SE 18-1077.   The vote was 6 – in favor; 0 – opposed.  Motion passed.

Ms. Wisneski made a motion that was seconded to issue Certificates of Compliances for SE 18-1491.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

Ms. Kelley made a motion that was seconded to issue Certificates of Compliances for SE 18-1305.  The vote was 6 – in favor; 0 – opposed.  Motion passed.

The Conservation Administrator was unable to recommend Certificates of Compliances for SE 18-1476 and SE 18-1457.  Mr. Grady reported that for SE 18-1476 a Certificate of Compliance can not be issued until after two growing seasons for plantings.  As for SE 18-1457, the Orders of Conditions specified the boathouse to be built on sonotubes, but the site inspection revealed the structure was built on a full-foundation.

The Commission discussed two proposed Town Meeting Warrant Articles:  one for the revolving fund for the Jaycox Tree Farm in the amount of $20,000; and the second to increase the amount for fines for to $300 for violations of the Wetland Bylaw.  Ms. Wisneski made a motion that was seconded that the Conservation Commission supports the placement of two articles in the Town Warrant, one for the Jaycox Tree Farm revolving fund and the second for the increase in fines.  The vote was 6 – in favor; 0 – opposed.  Motion passed.
